Policy and waiving the commemorative fee for Marilyn Francesco.

No Council action required, although the Council may “accept”, “acknowledge” or
“receive” the report
Discussion
Councilmember had the following questions and staff has provided responses to each.
Each question can be identified as Q1: and each response as A1:
Q1: Was there no dedication of bench or bench plaque before 2015? Or we donʹt
know?
A1: Based on the research, staff was able to locate two instances where the benches were
donated. Once in 2015 and the other in 2016. Staff reports are attached for information.
Q2: The proposed fee of $5000 covers the cost of the bench and the installation and
maintenance for 10 years. Thatʹs good to know.
The staff proposes a fee waiver of $5000 for the applicant, Marilyn Francesco whose
request was basically denied in May 2022.
Thatʹs gifting of public fund, an existing public bench to her. I would like to know
whether there is any reasons to justify such gift of public space and fund.
A2: Marilyn Francesco proposed to install a plaque on an existing bench instead of
purchasing a new bench. Council could deny the waiver and request Marilyn Francesco
to comply with the proposed policy.
Q3: Itʹs a matter of fairness. We donʹt want the public space (in a park) and the public
resources (the city fund) be made available only to people with special access to the
city staff to request a bench and a plaque.
The donation of bench and the plaque and the donation policy should be placed on
the Council or the Parks and Rec Commission agenda for approval.
This is not an operational item since the bench, even if fully paid for, will take up
public park space.
Please recommend a process which will inform the public of a bench application and
location and allow people to get informed and to comment, in case of any objection or
comment.
A3: The staff recommendation establishes a process that avoids discretionary elements
that could create first amendment conflicts. Staff does not recommend a public process
associated with this item.
Q4: The staff report states: ʺStaff also performed research on the Commemorative
Bench Dedication Policy by reviewing policies of multiple neighboring agencies:
Mid‐Peninsula Open Space, Town of Los Gatos, San Mateo County, City of Palo Alto,
City of Saratoga, and City of Los Altos. Specifically, the evaluation compared the
terms and cost of the benches to ensure the City’s proposed policy is comparable to
the neighboring agencies.ʺ
Itʹs good to know that the staff did this research. But none of them are included in the
agenda packet.
Could you send me copies of their policies and any comparison analysis?
A4: Please see attached documents of policies from other agencies. A summary
document “Memorial Bench Policies Summary” is also attached for reference.
Iʹm curious to know what options the staff considered but did not include? What
options the staff choose to include, but not all the cities have?
A4: The main options that were considered for comparison are fee, term of duration and
the process for determination of bench locations.
Q5: ʺon May 3, 2022, for consideration to approve an installation of a plaque
requested by Marilyn Francesco on a bench at Memorial Park in memory of Robin
Andy.ʺ
I would like communications on this request to understand how Marilyn
Francesco learned of this possibility of dedicating plaques.
A5: See attached email. Resident will sometime contact city staff via phone to inquire
about bench donations.
Whatʹs the background of Robin Andy and his/her connection to Cupertino?
A5: According to Marilyn Francesco, Robin Andy is her friend. She was a community
volunteer for years, on School Site Council at Garden Gate, head of the Senior All Night
Party at Monta Vista, a PhD, researcher, etc.
Q6: ʺthis policy takes precedence over Resolution No. 17‐102 “Donation Policy”; and
Resolution No. 17‐103 “Naming of City Facilities” since these policies do not include
specific guidelines to address these amenities.ʺ
These two resolutions mentioned should be included in the agenda packet. Which
parts of those two resolutions conflict with the proposed policy would be
superseded?
A6: Both Resolutions No. 17‐102 and 17‐103 are attached for reference. The quoted
language is included so as to provide clarity over time of which policy applies in the
case of memorial benches.
Q7: This item is NOT on the Councilʹs work program, which is already very full.
There are quite a few things that the Council requested to be brought back and they
are not always followed up, due to staff workload. Totally understandable.
But this particular item somehow is important enough to be followed up. Thatʹs
curious.
I would like to know whether this item falls under the City Managerʹs operational
items, if not under Council work program, and how many other items like this are
there so that the Council and the public have visibility to the workload and that there
is no surprises on where the city staff spends their time.
Ideally this item should have been included in the Councilʹs work program for 2022‐
22, as other policy items.
A7: Staff agrees that similar items would best be included in the work program. In this
case, with a resident waiting for resolution of the item, staff felt it important to bring it
back to the Council for consideration.

Q8: ʺon June 2, 2015, when the City Council accepted a bench with a plaque in
memory of Mrs. Virginia Logan, at Memorial Park,ʺ
How much was the donation amount from the requestor? Who requested it? Did the
city cover the cost of the bench? Did the city cover the cost of the installation?
A8: Staff report is attached for reference. The daughter, Mrs. Marcia Alicea, donated the
bench and plaque to honor her mother, Virginia Logan. Check in an amount of $1,503.94
was received by the City for the bench which did not cover the cost of the installation.
Q9: ʺon September 6, 2016, when City Council accepted a donation of a bench with a
plaque in memory of Erik Chen to be placed at Creekside Park.ʺ
How much was the donation amount from the requestor? Who requested it? Did the
city cover the cost of the bench? Did the city cover the cost of the installation?
A9: Staff report is attached for reference. The father, Mr. Leon Chen, donated the bench
and plaque to honor his son, Erik Chen. Check in an amount of $2,024.50 was received
by the City for the bench which did not cover the cost of the installation.
Q10: I looked up the minutes from the May 3, 2022 meeting. Here is the approved
motion:
ʺFinal motion summary:
Chao moved and Moore seconded to direct staff to bring back to Council proposed
policy and procedures, including historical information regarding similar types of
donations to the City in the past, for considering requests for donation of objects on
City public property, including potential locations for memorial plaques, prior to
consideration of further action on the current item, and that the current and any
similar pending proposal be re‐considered subsequent to the results of the
consideration by Council of proposed policy and procedures for memorial plaques.
Further, that staff bring back to Council recommended policies and procedures
regarding movement of donated objects on City property. The amended substitute
motion carried unanimously.ʺ
From this motion, itʹs clear that the Council wants to consider the donation policies,
including location of memorial plaques, BEFORE taking any action on any specific
request.
Iʹm curious what other background information is not shared to push for a fee waiver
on one specific request, which seems to go against the Council direction.
Trying to assume positive intent, likely there are other reasons that warrant the staff
time spent on this item to push for the approval of this plaque? I feel Iʹm missing
important background info.
A10: In this case, with a resident waiting for resolution of the item, staff felt it was
important to bring it back with limited scope for Council consideration.
