Q: Why is Item No. 12 (December Monthly Treasurer’s Report) on the informational calendar instead of the consent calendar? (Moore) Staff response: On February 7, the City Council adopted a Cupertino City Council Procedures Manual that included revisions to the order of business. Among the changes is a new category for “informational items.” These items are included in the agenda for distribution to Council in the public but require no Council action or direction to staff. Generally, information items should be comprised of reports on operational matters or implementation of Council policy that do not require Council input. In contrast, the consent calendar should generally be comprised of routine items of City business that require Council approval (e.g., contracts in excess of the City Manager’s approval authority, meeting minutes). With respect to the Monthly Treasurer’s Report, Government Code Section 41004 states: “Regularly, at least once each month, the city treasurer shall submit to the city clerk a written report and accounting of all receipts, disbursements, and fund balances. The city treasurer shall file a copy with the legislative body.” Cities can comply with this requirement by distributing the Monthly Treasurer’s Report to Council as an off-agenda memorandum—a process that is consistent with Municipal Code section 2.24.030. However, because of Council interest in Monthly Treasurer’s Report, the City Manager has elected to take the additional step of including this item on a published agenda under the informational items section. Informational items are not intended for discussion by Council, although members of public have the opportunity to comment on such items during oral communications.
