Consider authorizing an increase in the total contract amount with Guerra
Construction Group for the Wilson Park Basketball Court Project (Project No. 2022‐
11).
Recommended Action
1. Authorize the Director of Public Works to execute any necessary change
orders for an additional construction contingency amount of $40,000 and
increase the authorized contract amount to a not‐to‐exceed total of $369,421.40
to Guerra Construction Group; and
2. Adopt Resolution No. 23‐xxx approving budget modification #2223‐271
increasing appropriations by $40,000 in the Capital Improvement Program
Capital Projects Fund (budget unit 420‐99‐252) for construction contingency
and transferring the funds from the Capital Reserve (budget unit 429‐99‐001).

When was the Wilson Park basketball court approved?
Staff response: The project was part of the FY 2021‐2022 CIP and Budget programs approved
at the June 15, 2021 Council meeting. As indicated in the staff report, Council awarded the
construction contract for the court on January 17, 2023. Staff is requesting approval of a
contract amendment to complete the construction of the project because of unexpected
conditions discovered during excavation activities.
Q2: Councilmember question (Moore):
I also noticed that the basketball courts mentioned by Rhoda Fry are adjacent to
residences, and appreciate this follow up. While I appreciate basketball as a sport,
managed a State title one year, it can provide annoying pounding sounds and I am
wondering what the process was to push the courts up against homes which were
already impacted by Regnart Creek Trail, with many unhappy neighbors from that
expected noise experience.
Generally, the city wants to ‘circle the wagons’ when there is some controversy
brought up, but in this case, did the City perform due diligence and ask the neighbors
who would be most impacted by the noise, if they minded it? And do we have that
on record? Were they noticed and do we have that on record?
Please provide the documentation that the neighbors adjacent to the Wilson courts
were noticed and asked about the new basketball courts and what responses did the
City receive? It may be that they don’t mind, but I would like to know what people
within a 300’ radius had to say.
Staff response:
The requested recommendation before Council is to amend the approved contract for the
additional unanticipated increases in construction costs, as outlined in the staff report.
For background purposes, staff provides the following information. This design and location of
the basketball court are not agendized for discussion at the April 4 City Council meeting.
The project was part of the FY 2021‐2022 CIP and Budget programs approved at the June 15,
2021 Council meeting. Council awarded the construction contract for the court on January 17,
2023.
The lack of accessibility to a full‐size basketball court in City parks was identified as an area
for park improvement in the Parks and Recreation System Master Plan. In a community‐wide
survey for the Master Plan, basketball was the top recreation activity for teen respondents <18
years and was in the top 3 for respondents younger than 30 (excluding walking). Sites
identified in the Master Plan include Creekside Park, Hoover Park, Jollyman Park, Monta
Vista Recreation Center, and Wilson Park. Of these sites, Wilson Park was the only park
identified in the Master Plan for short‐term implementation of a full‐size basketball court. It is
also located on the eastern side of the City, an area deficient in access to outdoor recreation
opportunities.
As part of the FY21‐22 CIP proposal review with the Parks and Recreation Commission at the
April 8, 2021 meeting, the sites proposed for the full sized basketball court were reviewed with
the Commission and the public. The Parks and Recreation Commission agreed with the
recommendation. In addition to social media postings and calendar listings, Staff produced
and mailed a postcard to 435 residents (500’ radius) announcing the project and a community
meeting on November 30, 2021. Residents were in favor of the project and the City
incorporated a small berm between the court and the creek and residences to the south to help
address concerns regarding sound. Additionally, the Regnart Creek Trail project recently
installed new fences to help attenuate sound for those residents who had concerns over
increased use of the trail and park. The court will not have lighting and will be ‘open’ during
regular park hours only.
