2. Subject: Receive Email Phishing presentation from the City’s Infrastructure
Division
Chief Technology Officer Mitchell introduced Infrastructure (IT) Manager Yu.

IT Manager Yu presented a Phishing PowerPoint on file with the Commission records.
The presentation focused on:
Common Cyber threat landscape
Ransomware/Phishing/Malware
City’s cybersecurity defense
Question & Answers
As part of presentation, IT Manager Yu discussed global ransomware attacks, domestic
infrastructure ransomware attacks, and unfortunate successful recent attacks.
Yu concluded the informative presentation by highlighting the City’s cybersecurity defense,
consisting of training and campaigns, and ended with Q & A.
The Commission thanked IT Manager Yu for the informative presentation.
OLD BUSINESS
3. Subject: Review TICC FY22-23 Work Program
Chief Technology Officer Mitchell provided the following updates:
License Plate Recognition (LPR) Background: In partnership with the County Sheriff,
install LPR devices for the automated detection of license plates. This data will only be for
official law enforcement purposes, including identifying stolen or wanted vehicles, stolen
license plates and missing persons. It may also be used to gather information related to
active warrants, homeland security, electronic surveillance, suspect interdiction, and stolen
property recovery.
Update: The Santa Clara County Board will soon be reviewing City of Cupertino request to
be added in their Privacy system. Thereafter a Policy will be developed by staff based on
review and research of existing policies in surrounding cities. Implementation is the easiest
part that will follow. Mitchell will provide an update on expected timeline at the May
meeting.
Cybersecurity Background: Provide education on cybersecurity to City residents, guests,
and businesses. A subcommittee was formed consisting of Commissioners Soundararajan
ad Du.
Update: Deferred to Agenda Item No. 4.
Climate Monitoring and Noise Measurement background: Project Scope consists of
installing sensors to monitor Pollution and Noise Environments in the area adjacent to

Lehigh and Stevens Creek Quarry. Each location has two sensors, to monitor noise and air
quality levels.
Update: The project is complete.
4. Subject: Receive Subcommittee Report on Cyber Security Education from
Commissioners Soundararajan and Du.
Mitchell and Vice Chair Soundararajan and Commissioner Du provided the following
updates:
Due to time constraints, staff and the subcommittee are focusing solely on a Panel
presentation, and no longer pursuing a competition amongst Cupertino students and
sharing content via social media. This will be in line with the June 25, 2019, well received
TICC hosted Cybersecurity Presentation by speaker Nayaran Makaram.
The subcommittee has retained three Palo Alto Network Cyber Security professionals to
conduct community panel presentation.
Mitchell relayed the event will be based on Community Hall facility availability. He stated
he will provide Commissioners available dates to move forward with event planning. He
added the Community event will be recorded and uploaded to the City’s YouTube channel
and linked in the City website.
Commissioner Du suggested extending a panel invitation to Infrastructure Manager Yu.
She cited Yu’s background and experience in public sector make him a qualified candidate,
Mitchell agreed and added Yu can focus on addressing cyber-attacks to local governments
and the City’s proactive and managed approaches.
The Subcommittee discussed sending the three speakers an invitation letter. Mitchell
volunteered to draft letter and provide to Subcommittee for review. After approval and
date confirmation, he will send to Speakers.
Mitchell mentioned a marketing campaign will be ensued. The event will pe advertised at
the City Council meetings, flyers will be distributed across the City, the Chamber of
Commerce and Rotary will be alerted. He proposed a Subcommittee meeting for the last
week of April, after invitation letters have gone out to Speakers and to review Marketing
Campaign.

The Commission thanked Michell and Vice Chair Soundararajan and Commissioner Du for
the update.

5. Subject: Receive Commissioner Report from the Mayor’s Meeting
Commissioner Mohanty relayed he did not attend the March meeting.
6. Subject: Commissioner Updates
General comments related to ChatGPT artificial intelligence innovative
technology and how they can enhance front line city staff efficiencies
provided.
Mitchell reminded the Commission they or the Chair alone can request to have City staff
present Artificial Intelligence technology and discussed capabilities in detail further at the
next meeting.
Chair Garg requested an Artificial Intelligence demo at the June Commission meeting.
7. Subject: Review Activities Calendar
The Commission reviewed the schedule for upcoming Mayors Meetings and
made the following changes:

8. Subject: Review Action Items List
The Commission and Mitchell reviewed Action Items list.

Re: Notice of Brown Act Violation – Cyber Security Education Forum
Dear Commissioners:
I understand that the May 3, 2023 agenda for the Technology, Information, and
Communication Commission (“TICC”, or “Commission”) meeting included an item
regarding the Cyber Security Education Forum being planned by the City’s Innovation
Technology Department. It has come to my attention that a violation of the Brown Act
has occurred in connection with this agenda item. The purpose of this letter is to
identify and disclose the violation and to ensure that any action taken by the TICC on
May 3 is lawful and in compliance with the Brown Act.
As you are aware, the Brown Act requires that items within the subject matter
jurisdiction of the Commission be discussed by Commissioners in an open and noticed
meeting. Any communications or series of communications that may lead to a
concurrence among a majority of the Commissioners outside of a noticed meeting is a
violation of the Brown Act.
Following the TICC’s duly noticed meeting on April 5, 2023, where the Cyber Security
Education Forum was agendized and discussed, a series of communications via email
and/or telephone regarding the agenda item took place between Commissioner Eliza
Du, Vice Chair Rajaram Soundararajan, and Chair Mukesh Garg. These serial

communications, which occurred between April 6 and April 9, 2023, constituted a
violation of the Brown Act.
To ensure that the public is fully informed prior to the Commission’s vote on a
recommendation regarding the Cyber Security Education Forum, this letter, along with
all written communications giving rise to the Brown Act violation, will be provided to
the public prior to the Commission’s further deliberations on the item. In addition, the
Commissioners should disclose prior to further deliberations any verbal
communications contributing to the Brown Act violation, including an April 8
telephone conversation between Chair Gard and Commissioner Du.
The Commissioners are advised to be mindful of the requirements of the Brown Act to
ensure that future violations do not occur.

Good afternoon, Bill and Eliza! Valid concerns and good discussion. Thanks for bringing up. 4/10
Monday or 4/11 Tuesday 5:30 PM or 6:00 PM meeting for the sub-committee works for me. It is
important the entire sub-committee is on the same page on this important outreach to the
community.
Regarding the panelists, I wish the concerns on the panelist candidates (same company, etc) were

brought up as early as when the sub-committee first met with this first set of panel enthusiasts at
the sub-committee meeting on the planned date of 1/23/2023 which was specifically called for
communication around this topic. I understand Commissioner Eliza could not join that call
unfortunately. Also, I do not recollect any alternate meeting proposal to reschedule that meeting.
That meeting, in my humble opinion, might have helped the discussion of any concerns early on.
By the time (1/23/2023) we had the first three possible candidates (who are from Palo Alto
Networks), they were the only people we had at hand for the panel. I wished there were more
concrete reaching-outs for other potential panel candidates by the rest of the commission members
for the sub-committee to meet with. I understand Stanford and some security focused organizations
were floated around in a commission meeting, but I do not recall any concrete reach-outs or line ups
for the sub-committee to have a glimpse at and evaluate. As of now, we only have four panelists.
Furthermore, there were no concrete proposals nor names of other external experts, besides the
initial three. If we can concretely have more experts who agree to be part of the panel, we can even
consider talking to those first three members from Palo Alto Networks to choose one among them
themselves instead of all three. That said, I agree we can also run the concerns through the City
attorney and see what solution exists if there is a real issue.
In fact, at the last commission meeting on 4/5/2023, I asked if there were more experts that can be
brought in for the panel. In addition to enabling a more intellectually diverse panel discussion, a
bigger pool of experts would also be easier to shortlist final panelists from. The fact that the cyber
security event discussion was an explicit agenda item (Item #4) for the 4/5/2023 meeting, I think
that meeting could have been a perfect time for any commissioner or participant to bring up any
concern regarding the panelists. I believe we could have had a more constructive discussion with
broader commission participation on any valid concern, as opposed to these long, private email
threads back and forth. However, the reality is that no concerns about the panelists were brought up
openly in the meeting. Also in my humble view, there is nothing embarrassing to anyone on this
topic. The commission needs to be transparent to itself and the community all the time. Also, I think
an added advantage could be that we address such items in a time sensitive manner with the
broader team's perspective. A missed opportunity, again in my humble view, given that this topic
was an agenda item.
On another note, participation by high school students by means of cyber security presentations,
demo, etc is one of the components of this event I strongly proposed early on and as part of the sub-
committee report. So, I will be the happiest person if that is included in the event! I also want us to
be cognizant about high school students' exam/finals academic schedules, so that they are not
forced to choose between studying and participating in the City event. To that end, I agree with Bill’s
proposal to have the event in July/Aug to give the event ample time. I believe this would also give
ample time for the students, if, of course, the commission plans to proceed with this part of the sub-
committee’s proposals in the report. Also, if I recall correctly, Cupertino Hackathons have popularly
happened in the July time frame (or early April).
Again, we should let the tech commission discuss and decide what parts of the recommended items
in the report should be included based on the timing of the event. In the meanwhile, it would be
great if we could discuss further in a subcommittee meeting this Monday or Tuesday evening. I hope

I hope this message finds you well. I trust you enjoyed the beautiful weather today, which provided
an ideal opportunity for a hike or puttering around in the garden.
I am writing to address the points you raised in your email. Firstly, I would like to draw your attention
to the Subcommittee item on the agenda, which is intended solely for the purpose of receiving a
report. I would like to emphasize that no vote is required for this item. Furthermore, upon reviewing
the minutes from previous meetings, it has become apparent that we never voted on the events to
be included in the Cybersecurity Education. In hindsight, we should have agenized an item to vote on
this matter. I suggest that this Friday's meeting be the forum to address this issue.
I also wish to provide further information on cybersecurity events. TICC presented a cybersecurity
event on July 25, 2019, during which both Raj and I were members of the Commission. The event
was well-received, with approximately 50 individuals in attendance. The presentation was recorded
and subsequently posted on our website. It is noteworthy that the recording has been viewed 99
times, which is similar to the number of views for the Library Expansion ribbon-cutting video, which
had a similar number of attendees.
I will discuss the items you raised with the City Attorney and obtain further information on the
parliamentary procedures used by the City, which uses Rosenberg's Rules of Order.
Lastly, I would appreciate it if you could let me know your availability to conduct the subcommittee
meeting that you previously proposed. Please indicate if you are free on Monday or Tuesday

Hi Bill
During our last discussion at the March TICC meeting, we discussed postponing the cybersecurity
event to late summer or afterward. I recall you mentioning that your retirement was initially set for
June, but the city has extended it for another six months. We even joked about how you couldn't
escape this event. However, in the April TICC meeting, I don't remember any voting taking place
regarding this event. My understanding of a commission vote is that it should be explicit, with
everyone saying "Yea" or "Nay," or raising their hands to express their agreement. The meetings
were recorded, correct? We can always review the recordings for clarification.
As this is our first time organizing such an event, it's crucial to strive for success and encourage
community involvement, particularly for families. While it may not be perfect, we can always make
improvements in future iterations. My personal concern is avoiding a situation where the event has
minimal impact or, worse, leaves a negative impression.
Last week, the city attorney organized an excellent educational event. It would be beneficial to hear
their thoughts on public events – what can be done, and what should be avoided. I would also
appreciate learning from the attorney about how subcommittees function, what constitutes a vote
during commission meetings, and the proper procedures for special voting situations. Understanding
who can call for special voting, how to handle inconclusive subcommittee discussions, and other
procedural aspects would help us avoid unnecessary complications in the future.

At our Commission meeting this month, the Commission made it clear that they preferred the
panelist option and the removal of the Youth Cyber Fair. Any deviation from this decision would be
unwise and would disregard the Commission's stance.
As an advisor and liaison of the Commission, I do not possess any authoritative power. I concur that
the current matter necessitates open and collaborative communication, and that is why I proposed
that the entire Commission meet to discuss the issue thoroughly. Any further delay in this regard will
only worsen the already tight timeline.
One possible alternative that could allow for the inclusion of the Youth Cyber Fair would be to
postpone the event until July or August, allowing students greater flexibility with their academic
schedules and providing proper time for careful planning and execution. If the event includes the
Youth Cyber Fair and is proposed to occur in May or June, I will strongly advise against it.
On Monday, I will bring up Eliza's concerns regarding the panelist with the City Attorney.
Should Raj concur with Eliza's suggestion to convene a subcommittee meeting, I recommend that we
hold it either on Monday, 4/10, or Tuesday, 4/11, to address the matter. Please note that the
Commission meeting is still scheduled for Friday, 4/14. It is up to Raj's discretion to agree on the
need for a subcommittee meeting or proceed directly to the Commission meeting on Friday. Raj, let
us know your thoughts.
Please note that I will refrain from contacting the panelist (letter I asked you to review) until this
matter is resolved.

I believe it is important for us to meet next Friday before the special TICC meeting. As a
subcommittee, we should have a unified voice, not multiple voices.
We haven't been able to meet for several months now, and it's time for us to discuss and develop
solutions together. If bandwidth is an issue for you, I don't mind taking on the work.
If the budget is the problem, I would be happy to bring this issue to the Mayor, Vice Mayor, and
council members, and ask them for additional funds.
What I don't want to see is our organized efforts, which represent the city, being of subpar quality

and, worse, causing more problems than they solve, such as becoming a one-company show.

Thank you for providing the information about the voting process in the TICC. I don't
recall that a vote took place in the April meeting concerning this cybersecurity event.
Our original plan involved both the panel discussion and the student event, so
removing the student event would actually be a deviation from our initially agreed
plan.
It is inappropriate to have three panel members from the same commercial company,
even if they can provide vendor-agnostic discussions. This setup fails to achieve our
goal of offering diverse expert opinions and approaches to educate the general public.
If our cybersecurity education program only invites three panel members from Palo
Alto Network, as was brought up in the April TICC meeting, it could be perceived or
misunderstood by the public that the city is organizing such an event only to promote a
particular company to all Cupertino residents. This would not serve our intent, and it is
very improper. I have never attended a government-organized professional panel
where all panel members were from the same commercial company. In fact, it's rare to
see even two panel members from the same organization. It is generally considered
good practice to have one panel member represent one organization in general panel
discussions.

Please share your thoughts and feedback at your earliest convenience. If any changes

Thank you for your prompt and thorough response, and for taking the initiative to
develop a plan to achieve your desired outcomes. As the TICC Liaison, I must inform
you that I am not authorized to provide approval for any of the suggestions you have
proposed. To proceed, we must obtain a majority vote from your TIC colleagues during
a public meeting, which is scheduled for early May.
Considering the academic calendar and the potential impact on students' final exams, it
is crucial that we give careful thought to the proposed plan and evaluate if any
adjustments need to be made. In my opinion, it would be best to proceed with the
event as approved during the April TICC meeting, with the inclusion of the three
speakers along with Tommy, at the Cybersecurity event. Again, to deviate from what
was agreed upon at the April TICC meeting would require a majority vote from the TICC
members during a public meeting.
Alternatively, we could explore the possibility of scheduling the event for a later date or
combining it with a future TICC event when school schedules are not a concern. This
option would also require a majority vote from the TICC members during a public
meeting.
Lastly, I would like to request your feedback on the email I sent yesterday, which
requested TICC Commissioners to review my letter addressed to the current four
speakers. You will note that the event, as defined by TICC, is scheduled for late May

I greatly value your input on these matters and remain committed to working
collaboratively to find a solution that is in the best interests of all stakeholders involved.

Hi Bill
Before outlining the plan for the upcoming event, I wanted to explain my approach to
the event planning and why I may not have been as actively involved in the past.
I initially believed that others may have more experience and would be better suited to
take the lead. However, I understand now that people may be busy and may not have
the bandwidth to take on additional tasks. In light of this, I am happy to step in and
ensure the event runs smoothly by taking on any tasks that may not be covered by
others. I am confident in my experience and local contacts, and believe that I can
ensure the event's success.
The event consists of two parts: panel presentations and student presentations. To
ensure its success, I have broken down the key steps into the following tasks:
Marketing: We will reach out to the city, schools, education organizations, the library,
and Teen Commissioners to promote the event using social media, Eventbrite, and
other media platforms. I just need to be introduced to the right city contact for city
social media/email/website info. I have contacts for all rest of part: schools, education
organizations, library, Teen commissioners, etc.
Marketing Materials Preparation: I can either hire freelancers from Fiverr.com or find
local volunteers to prepare flyers and banners. It may cost $100-$200 to hire a free
lancer to do so. In case city can’t cover it, I can pay it myself.

Panel Member Invitations: We already have two confirmed panel members, with more
to be found if needed. I have many local contacts.
Student Submissions: Students can submit their projects using a simple and free Google
form. I can make the google form, find volunteers and work with them to check the
submissions.
Judge Invitations: I will reach out to other commissions for volunteer judges and find
more locally if needed.
Set-Up: The city may have custodians to set up tables and chairs, or I will reach out to
high school volunteers if needed.
Audience Organization: On the day of the event, student volunteers will assist with
organizing the audience. I will reach out to high school volunteers if needed.
Sponsorship: I will reach out to local vendors and companies for sponsorship if
necessary. (Will it be OK to have sponsorship in this event?)
The estimated budget for the event is $7500, which includes the following costs:
• Panel Member Compensation: $2000 (depending on the number of panel members
invited, $500 or $600 per member)
• Marketing Materials Printing (flyers and banners): $500
• Volunteers: a free T-shirt per person and boxed lunch ($25/person): $600
• Judges on the event day: a free T-shirt per person, a special swag and boxed lunch
($40/person): $400
• Student awards: $200 for first prize, several 2nd price ($100 each), several 3rd price
($50 each), and rest all got honorable member ($10 each): $1500
• Special swags for all participating students: (pen, notebook, or something): $1000 (if
1000 students partipate, $1/student)
• Special swags for judges before the event: $1000
• Boxed lunch for us or our own people: $150 (10 people?, not volunteers and onsite
judges lunches have been calcuated)
• Buy water bottles and cookies for the event: $350
