CC Resolution No. 8877 RESOLUTION NO. 8877 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND ENTER INTO AN AGREEMENT TO PROVIDE LOCAL LAW ENFORCEMENT AGENCY ACCESS TO THE CALIFORNIA IDENTIFICATION SYSTEM AND TO APPROPRIATE AND SEND THE CITY OF CUPERTINO'S FINANCIAL CONTRIBUTION FOR THE SYSTEM TO THE CITY OF SAN JOSE FINANCE DEPARTMENT WHEREAS, California Penal Code Sections 11105, 11112.1 et seq. provided for funding and procedures allowing local agencies direct access to the California Identification System (CaI-1D System), an automated system maintained by the California State Department of Justice for retaining fingerprint files and identifying latent fingerprints; and WHEREAS, the City of Cupertino, fourteen other cities, and the County of Santa Clara entered into an agreement in 1988 to provide local law enforcement access to the CaI-ID System and has extended and modified the agreement each year since that time; and WHEREAS, Cupertino desires to continue the original agreement and to modify its tenns with respect to its fmancial contribution and to extend the terms of the agreement for another year; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino: 1. The City Manager is authorized to execute the agreement with the County and the incorporated cities to provide local law enforcement agency access to the CaI-1D System. 2. The City Manager is authorized to appropriate fTom the general fund and to send to the City of San Jose Finance Department the City of Cupertino's financial contribution of Twenty-two thousand, eight hundred thirty-three dollars ($22,833) for the LocallD System which includes personnel and non-personnel costs for fiscal 1993-94.
