ENVIRONMENTAL DETERMINATION: Negative Declaration Recommended
The Zoning Codification was completed fast year, this is the subsequent clarification. Michele
handed out a list of modifications to members. The modifications included text
clarification and new definitions. Some text is proposed for deletion. The intent of the
Ordinances will essentially remain the same. The modifications are not creating an
environmental impact. Bert moved for a Negative Declaration seconded by Bob Cowan. Vote
3-0, Wally Dean arrived too late to vote.

ENVIRONMENTAL DETERMINATION: Negative Declaration Recommended
The zoning requires that the applicant complete a development plan showing long term phased growth.
Development plans include the changes over the next decade which would include new buildings and
landscaping. Staff is not prepared at this time to make an environmental recommendation . The three
issues of concern are: 1. The majority of Deep Cliff is in a flood plain. Ordinances require all structures
have floor levels at or above flood level. Can the structural height be met? 2. Long term planting plans
include the planting of 300 trees over the next 10 y:ars. .How many trees will be removed? 3. New
traffic and parking needs as a result of the growth.
The General Manager from Deep Cliff responded that only trees that are a hazard or are diseased
will be removed. Their plan is based on an arbocists report by Able Tree Surgeons. Any specimen trees
will be identified and protected. Staff will need identified the specimen species and location proposed for
removal.
There are no plans to expand parking at this time. Staff asked that the applicant come back in two weeks
0 with more detail.

general plan amendment and the rezoning, not the tentative map at this time. The concern with the
change in The General Plan designation is the net cumulative effect to other buildable lots in the c--nvon.
Bert moved for a negative declaration. John Bautista and Wally voted against a negative declaration at
this time. The motion was withdrawn. The item was continued for two weeks in order for Staff to come
back with additional information on the cumulative impacts of the project.

Colin indicated that the Tentative Map was being continued pending a decision on the general plan
amendment and rezoning. Historically, the semi-rural designation specifically applied to Regnart
Canyon only. Colin presented study maps for the Regnart Canyon area to look at overall policy
implications in a general plan change to one particular piece of property. All lots have been subdivided
according to the semi-rural formula except the Mahon property. Parcels range in size from 1 acre to 9
acres in this area, with the Mahon property being 13 acres. Land use changes should be treated
consistently. If the Regnart Canyon is changed to semi-rural, it will allow building on other lots with a
potential of 6 additional building lots, 4 new homes. In a larger context, if the Regnart Canyon area
were removed from the 5-20 acre slope density formula,only 2 other property owners would be affected
by the parcel consolidation policy. (#2-38). The adjoining Kaiser property is outside the urban service
area. Bob feels that this should be qualified and recommended to limit to Regnart Canyon. Could this
open up lot line adjustments and future subdivisions? This is hard to evaluate and may require an EIR

report. Scale and intensity differentiate this from the diocese property proposal for which an EIR was
required. Dynamics arc larger here than just Cecil's lot. The lack of sewers dictates the size of lot that
can be developed. A concern is the potential for further land division. The ERC committee should make
a recommendation defining the scope. Bob recommends that we go to Council with a report showing the
scope of this. Boundaries must be set. Recommendation: Go to Council on January 3, 1994 for
direction. Bert moved,Bob seconded. 3-0 in favor. This item will be removed from the Planning
Commission agenda at this time. City Attorney input is requested v+en this is presented to Council. The
motion was modified to reflect this.

ENVIRONMENTAL DETERMINATION: Negative Declaration Recommended
Tree removal- 2 arborists reports have been completed. 35 trees arc in ill health but they will be
maintained for the time being. One pine tree will be removed. 250 new trees, 50 per year over the next
5 years,will be planted. This is a 6:1 replacement ratio. Flood plain issues-no significant problems
with placement of proposed structures. Finished floors will be at or above the flood plain level. Traffic-
new teaching center is in the conceptual stage to be constructed between now and 1995. This includes 14
putting pads for practice of strokes. This will cause no significant traffic impact. Parking is the major
consideration. Management is looking into restriping the parking lot which would provide 16 additional
spaces. Residents on Clubhouse Lane are concerned about overflow parking. Noise level-a complaint
has been received regarding the microphone system. No complaints to Code Enforcement about this.
Lighting-also in the conceptual plan is lighting for the parking lot and for the practice area. Bert voted
for a negative declaration,Bob seconded. Vote 3-0 in favor.

ENVIRONMENTAL DETERMINATION: Negative Declaration Rcco-z!imended
Tom Robillard explained that there are two proposals, one a 15 P ,Y:1il,the second a dirt berm with a 6 ft.
high wall to span the swalc. This wall would cut down on noise and act as a visual barrier. Staff feels
that the wail will create a bigger impact than it will mitigate. A sound study was done identifying four
units with an above acceptable noise level. The General Plan now discourages the use of walls. Bert
Viskovich stated that the wall would have to be.landscaped with trees and ivy. Gary Kootz explained
that Cal Trans was to build a wall but it was not done. Sound and visual impact are the two
considerations. To do the berm we must encroach on Cal Trans property. This has to go to Sacramento
for final approval and it is in this process now. Drainage must be addressed and it must be landscaped
and irrigation provided even on the Cal Trans side. He expressed that the wall will be built next summer.
He will provide a conceptual landscape plan as requested by staff. Tom Robillard stated that the

that all vehicles must be parked on an impervious surface, which may not,exceed 50%of the
front set-back area unless approved by the City. In the environmental evaluation there was no
identified environmental impact, therefo►c, Staff recommends a negative declaration.

that this is strictly for residential areas.

review changing the General Plan designation for the entire Regnart.Canyon area to very low
density residential: semi-rural 5-acre slope density formula. This designation was deleted with
the last update of the Gencral Plan and we would reconstitute it for just this area. Cecil's
property would be rczoncd to RHS. With these changes, 3 existing lots in Regnart Canyon
attested by Policy 42-38, would be recognized as buildable lots. Cecil has 3 houses already, so
tic( increment would be one,additional living unit with a possible three additional houses on the
remaining lots fora total of four additional houses. The amount of traffic generated would be
relatively minor. In addition, staff will be adding an amendment ensuring that basic subdivision
pattern remains intact. Council asked ERC to review deletion of 2-38 hillside consolidation
policy. Polio H2-38 affects only 2 lets outside of Regnart Canyon. Deletion of the policy may
result in Ilse addition o1-2 new houses, one on each existing lot. Staff is recommending a
negative declaration. Staff nerds to initiate a rezoning of the remaining hillside properties. A
motion on Regnart.Canyon rc:commend.ing a negative declaration with a maximum of 4
additional houses was made by Don, Bert seconded. The motion carried 4-0.

USE PERMIT for a 3,800 sq. ft. addition to an existing church.
Michele Bjurman stated that this is an existing church with classroom buildings. They want to
expand the parish hall, add junior and high school classrooms,an office and library. They are
adding new junior and senior high classes. Use is only on Sundays during Sanctuary time, not
during the week. Two bottlebrush trees and four cypress trees are to be removed. The trees will
be replaced on a I to I basis,the bottle brush with a drought tolerant replacement. The church is
currently underparked. Thev arc required to have 125 spaces following the addition and have 95
existing. They do have a long term parking agreement with Hyde Jr. High located adjacent to the
church, Don Brown asked if there are industrial uses near the site using hazardous materials.
Michele responded there is no industry in the area. A negative declaration is recommended
based on I to I tree replacement. So moved by Bob Cowan, seconded by Orrin Mahoney and
passed 5-0.

Michele reported that in October the applicant was required to update their existing parking
study. The Oaks Center is deficient in parking by up to 200 spaces,and the new occupant will
generate a larger parking deficiency. The report was completed,and the peak or impacted hours
would be on Friday and Saturday evenings after 7 p.m.. This business will be closed at that time
so there w'iIl be no conflict. During the rest of the week there is no problem. Two suggestions
from staff: 1.)Hours be consistent with the applicant's proposal, 2.)Their use permit brought up
again if parking problems arise in the i�ture. This will enable the PC to require additional
parking mitigation if needed.
Don moved for a negative declaration,subject to staffs suggestions. Bert seconded. Carried 5-0.
3. City Council request for a report on the environmental aspects of the 2/4/94 Berg&Berg notice
of appeal of File No. 10-U-93 (mod.),a modification of a use permit to delete daycare activities,
consider offsite parking controls and consider other activity limitations for a proposed church at
10340 Bubb Road, APN 357-20-019.
® Colin passed out copies of the Staff responses. (See attached) City Council has directed ERC
�r and Planning Commission to review appeal letter submitted by Berg and Berg. In November of
1993. the church applied for a use permit and rezoning recommended for approval by the
planning commission. Because of concerns by the industrial tenants it was deferred to January.
Chemicals being used did not pose an undue risk to the church or proposed day care population.
Council tentatively approved rezoning but sent use permit back to planning commission to
ensure greater compatibility. Specifically asked that day care be deleted. Off site parking also
looked at. Back to City Council in early February for the second time. Berg,&Berg appealed
the use permit modification. Colin went over each of the 10 points from the appeal letter.
Bert moved for a finding of no new significant environmental impacts and upheld previous
negative declaration recommendations. Don seconded. Carried 5-0.

This project will be on the Monta Vista Hardware site. The general plan now calls for this site to
be primarily residential,with a significant portion for commercial. Commercial portion cannot
be supported so a general plan hearing has been granted.
This is a planned unit development that has a frontage road along Stevens Creek Blvd. They are
two story homes about 1500 sq.ft. on about 3500 sq. ft. lots. The density is about 7 units per

significant trees on the parcel. One of the significant trees will need to be removed to
build on lot I. Ms. Chen is asking for the removal of 19 trees. Micheie recommends
requiring a certified arborist to review the final construction plans and that it be
consistent with the arborists recommendation for long term health of existing trees and
that the arborist be present during grading and construction on lots i,4 and 5 and when
fencing is put in place.

Emily Chen spoke that she has been working closely with Michele and is trying her best
to maintain all the trees. Dz l suggested setbacks be changed to save trees on pertinent
lots.
Nancy Burnett spoke on behalf of the Fairgrove i-lomeowners Association on this parcel.
Their concerns are privacy, trees, smilight obstruction and wildlife protection_ Also
when the barn is demolished and the house moved it may cause flight of termites and
rats. Will there be any danger to their homes when these tall trees are felled? Mr.
Schwartz, another neighbor, spoke of his concern for privacy. Marilyn Phillips spoke
about the birds that may be affected by the removal of trees. Ms. Chen will meet with
the neighbors regarding the E.RC issues.
Bob Cowan brought up the possibility of rezoning to PD which would provide design
control for each house. This would work to preserve trees without worrying about
setbacks. There would be individual review of each home. Planning Commission
would have to make this decision.
Bert moved for a negative declaration with comments to maximize tree preservation and
pest control during demolition. The historical building will be relocated as
® recommended. Existing trees and shrubs will be retained as much as possible for beauty
and screening. Don seconded the motion and the vote was 5-0 in favor.

ENVIRONMENTAL DETERMINATION: Negative Declaration Recommended
A background was given by Ciddy Wordell. Our housing element is not in compliance with the
housing element iegislation. We have been working on amendments since then. Potential ERC
items are the actual increase in number of housing units. The state did not accept the sites we
proposed as being adequate. They want more sites so we will identify additional sites.
Constriction above the General Plan(2584 units)will not be allowed. New sites being
identified are at Maxine and Homestead, 10-20 units per gross acre,and at Stelling and 280, 20-
35 units per acre. This might be an affordable housing project site. SunnyView Lutheran Home
is a potential site for 50 units. None of these will be of significant environmental impact.

The applicant has withdrawn her original application and is resubmitting. Michele summarized
the issues.There are 40 significant trees, 12 to be removed or 5 less than the previous application.
The previous ERC recommendation was to maximize tree protection,a condition of approval for
® the demolition of the barn with regards to rodent control,and to retain the historic building.
Michele recommends following these recommendations. Under this application the house may or
may not be moved. Emily Chen spoke about her house designs and said that one story homes
would result in more trees being removed. Bert feels that aesthetically the PD configuration is
not in keeping with the cul-de-sac. If the subdivision is restricted to one story homes, it is felt
that all adjoining neighbors also be restricted from adding a second story.
Bert moved for a negative declaration,but stated from an aesthetic point of view that it is inferior
to the other plan. Blaine seconded. in discussion,Ciddy disagreed,stating that this property
requires special consideration to maintain a country atmosphere. Paul recommends imposing
conditions to maintain and protect the specimen trees that are saved. Michele can impose a
bond on each specimen tree if necessary and hold this for several years.
Four in favor,Ciddy opposed.
Ciddy moved that we retain the house,based on the previous recommendation. Bert seconded,
and modified the motion to either move the house on site or retain on the current site. All in favor
5-0.

Concentration, 2. Parking, 3. 'Traffic and 4.Noise. Of these four,all but narking
environmentally related. Proposed for concentration would be a 300 ft. separation
between uses. Traffic would generate very little impact. It would not be significant.
The noise issue would be referred to the municipal code. We would expect compliance
within the noise ordinance. A negative declaration is recommended. So moved by Don
Brown, seconded by Paul Roberts and passed 5-0.
3. Application No. 81.157 and 16-EA-94: Amendment to Cupertino Municipal Code to
add Title 20 regarding the Enactment and Amendment of General and Specific Plans.
ENVIRONMENTAL DETERMINATION: Negative Declaration Recommended.
A report was given by Bob Cowan. This application is designed to create an ordinance
which governs specific and general plans. It contains no environmental issues. Don
moved for a negative declaration,seconded by Carmen. Passed 5-0.
4. Review of Kaiser Permancnte Medical Center EIR- Santa Clara
Ciddy Wordell passed out literature on the proposed Kaiser facility. They are circulating
an EIR with a deadline to comment by July 1- Staff will provide comments. This
is a 53 acre parcel on the corner of Homestead and Lawrence Expressway. Our focus
will be with traffic. None of the project will be in Cupertino. Glenn Grigg gave a
summary on traffic. They have come to some incorrect conclusions,according to Glenn,
by using the wrong number of traffic lanes. He feels the traffic section should be
redone. We also want:to make sure there is adequate parking so it does not spill over
into our neighborhoods. Bob also wants to see them design the site to allow for
possible future highway interchange. These suggestions will be taken to the meeting
with Santa Clara staff.

Ciddy Wordeli explained that although Saint Joseph Avepue is under appeal,the court
has ruled it to remain open;this is a proposal recommending a traffic analysis be done for that
possibility.The City Council will approve a scope of work. Once agreed upon then the work
will be done. When it is published there will be a forty-five day review period,which leaves an
estimate of June before the planning commission could hold a public hearing on the new
information. There is a state law requiring re-circulation and the planning staff feels that this
proposal falls under this law.Ms.Wordell read the law out loud for the members present in the
meeting. "The Initial Study indicated that the impacts are not going to be significant,but the
study will show definitely whether or not,after which a final decision will be made.
The city of Los Altos will be working with the city of Cupertino in the scope of work so
that both cities will have input into the study. Ms. Wordell also proposed an amendment to the
Notice of Preparation. The changes are brought about because the City Attorney wants Harvey's
Study on the frog and new trees information to be re-circulated with the traffic information.'The
Harvey study did not have any new information,but is more precautionary. Ms. Wordell then
asked Bert Viskovich to explain the scope of the traffic study. Mr.Viskovich began by stating,
the existing traffic condition on Saint Joseph in the area of 280;where the court ruling is,there's
an irrevocable offer of dedication to the city;with the assumption that city will make that area a
public roadway. The council does have the right not to accept the offer once the road is opened.
If so,then a private roadway through the Forum could act as a gateway for public thoroughfare.
The alternatives that are going to be studied are,the connection with the seminary property to the
public roadway and whether the road will be public or private. If private then it acts similar to
the Forum where only the Forum traffic could utilize the Saint Joseph's road. If the seminary
becomes private then in essence it's only the two projects that may have an impact on Saint
Joseph's Avenue. If this does become a public roadway a complete loop is created for both in
going and out going traffic. The county park then could create a real impact on the Saint
Joseph's roadway if a public connection was made.
The study will evaluate twelve of the project alternatives for both public and private
odways. So, in essence there are twenty alternative views of the traffic situation. It is assumed
that gates will go up at the Forum as soon as Saint Joseph's opens; if not then everyone 11 drive
through the project.Don Brown asked about the Cristo Rey parcel area being impacted. Mr.
Viskovich explained that if it were a public road then the Cristo Rey impact will then be dealt
with. The base has to be projected because we can't predict how many cars will use the road,
and the impacts on Saint Joseph. The study will calculate if Saint Joseph's roadway is open,as
well as calculate the Forum traffic,on Cristo Rey road,and Saint Joseph. Mr.Dean asked about
the Forum's original access agreement on Saint Joseph. Mr.Viskovich explained that it was
originally agreed upon being a private roadway as it is today. Paul Roberts stated

if the roadway were private then it would alleviate the local residents using it as a scenic drive.
Mr. Roberts suggested adding new alternatives to the environmental impact report. Specifically,
the list of project alternatives on page 4,such as alternative"C"asid"D". The traffic study
provides the opportunity to study alternatives that were not looked at earlier. Ms. Wordell
clarified that the information on the studies would be close enough to extrapolate from. Mr.
Cowan explained the idea was to try to bracket a number of options so that the commission
could decide which one was preferred. Then the planning staff could focus on that one and begin
working. Mr.Roberts stated what was missing is the alternative that corresponds to the
applicant's application as it applies to the seminary parcel of how many units would be located
on the seminary parcel under the very low density residential modified half acre slope density
formula. Mr. Cowan explained that these alternatives would be covered again with the bracketed
options issued with the council and as long as the general parameters are met. Mr. Brown stated
as long as you bracketed the data driven items everything is covered.
Mr.Brown moved to recommend to re-circulate a portion of the general plan analysis to
traffic as well as the Harvey report for the red frog and tree information. Mr..Dean seconded the
motion. Vote 6-0.

Tom Robillard explained that City Council had just approved a project at the corner of
Tantau and Stevens Creek Boulevard,fc,r forty affordable housing units and 4,000 square feet of
commercial building. The city staff first thought that it would originally coincide with the
Stevens Creek Boulevard specific plan,but the City needs to amend this plan,regarding
building setback and heights on Stevens Creek Boulevard,because this particular project did not
meet these guidelines. The project approved development plan includes a 35 feet front yard
setback,a 36 feet building height,and a 20 foot rear yard setback.The existing Conceptual Plan
requires a front yard set back of 50 feet,the set back ratio was 1.5 to 1 and the rear setback ratio
of 4 to 1.Mr. Viksovich moved for a Negative Declaration,and M:. Brown seconded the motion.

Michele Bjurman explained this is a proposed six thousand square foot general
commercial building at the North West comer of De Anza Boulevard and Bollinger Road.The
previous use was a Union gas station. The proposal is for either a multi-tenant or a single-tenant
general commercial user. Two issues were analyzed,the first being traffic and the second was
hazardous materials. According to our traffic engineer no traffic analysis is required because
the project is not estimated to change the levels of service at the intersection. As far as
hazardous materials,Union Oil did have a leaky gas tank,and there was soil contamination,but
the staff has received a release letter from Santa Clara Water District who is the overseer of
Hazardous Materials.The soil contamination has been cleared of any further investigation as the
site is clean. Bert Viskovich motioned for a Negative Declaration and Paul Roberts seconded
the motion.Vote 6-0.

personnel or equipment,but do have the capacity for one additional person. The traffic impacts are not
significant. The applicants daily site trips average six employee trips,two business trips,and an average of
1.7 emergency vehicle trips per day. The circulation will be approved because they would be able to enter
and exit from Prado Vista.The real significant impacts are aesthetic,visual and noise.The aesthetics
relates to the setback which are five feet,this makes it quite close to the adjacent property lines and the

wall plans are quite high. The architects are currently trying to step back the rear of the building about five
feet. The apparatus room may not be moved over or altered so they are considering some landscape
screening. Even though this is significant the staff is still recommending a mitigated Negative Declaration
because this can be reduced to less than significant during the Use Permit process.The noise impacts have
also been identified as having significant impacts because some of the noises exceed the cities noise
standards. The noise really relates to the testing of the portable equipment. The other noise impacts
would be due to the construction, the problem is this would be difficult because it is typical of all
construction. 'The applicant will either have to show that they have mitigated the construction noise to
meet the City's ordinance or the City will need to amend our construction noise standards.The staff is
suggesting that a Negative Declaration to be adopted because before approval the applicant will have to
demonstrate that they can reduce those portable impacts to less than significant. Mr.Brown moved
for a Negative Declaration. Mr.Cowen seconded the motion.

'ibis a proposed Use Permit to replace and expand a existing fire station on an adjacent parcel. The
applicant would like to get off of Stevens Creek,and be able to exit onto Vista Drive to Stevens Creek
Boulevard and to return on Randy Drive. The applicant has indicated that they need a change to increase
their access,they have had some earthquake structural problems,and need to adapt to new personnel,
which is now a mixture of men and women. The traffic impacts are not significant the daily averages are
15 employee trips a day,3 business trips,and vehicle response average of about six to seven a day. (66%
of these responses are between seven am.and seven p.m.,and the quietest times is between 1 i p.m.and
seven a.m.) The circulation changes will include a light control at Banley,and modification to medians so
the fire truck will be able to make left-hand turns.The vacant lot change in land use is significant due to
tl:e fact that this has been an unimproved vacant lot,with problems of storage of vehicles,and no
structures. The staff is proposing that the change in land use will be mitigated through the setbacks,and
t zough last gate screening. The setback will have to meet the Stevens Creek Conceptual Zoning Plan.
The mitigation's and the relationship with the neighbors will be evaluated during the Use Permit process
and mitigated to the satisfaction of the City Council. The noise impacts are from the stations portable
equipment testing. This testing exceeds the City's standards. The construction noise will be addressed the
same as mentioned in the above item.Mr.Kenney the homeowners association's president to the adjacent
condominium complex stated their concerns. They do not care for the site plan,and the apparatus making
noise up and down the residential street. A representative for the applicants stated that a meeting with the
Homeowners Association was scheduled for February 28, 1995,at the Senior Center.Ms. Wordell
recommended a Negative Recommendation. Mr. Viskovich moved for a Negative Declaration. Mr.
Brown seconded the motion.

This is a application for a Use Permit,to contrast a 6,430 square foot retail building.The project is on
Homestead where Homestead meets Grant Road.This is the last parcel before you enter Los Altos
properties.The staffs primary environmental concern was whether there was hazardous materials that had
contaminated the soils. There had been,but Mr.Hagman was able to provide a clearance letter for the
site,so the site had been cleaned up. The only other concern would have been traffic. The traffic division
reviewed the proposal and found they had no concerns about the new use changing the level of service or
whether a percent of traffic increase on Highway 280. Ms.Bjurman explained due to no foreseeable
environmental impacts the planning staff'was asking for a Negative Declaration.Mr.Cowen moved for a
Negative Declaration.Mr.Roberts seconded the motion.

This is a Use Permit to locate a 6,400 square foot restaurant in an existing building which is located at the
northwest corner of Stevens Creek Boulevard and Blaney. The proposal is for a restaurant to occupy a
portion of an existing 9,000 square foot building which had been occupied by a music store,copy store and
a real estate agency.The only concern the staff had is whether the restaurant use would have any traffic
impacts at the intersection. The traffic department found there would not be any level of service impact.
Since there are no environmental impacts Ms.Bjurman recommended a Negative Declaration. Mr.Brown
moveu for a Negative Declaration. Mr.Viskovich seconded the motion.

generally bounded by Voss Avenue,Alcade Road,Santa

This is a Rezoning proposal to various hillside properties in the Inspiration Heights area from,RI-10,RI-
40,and RHS to RHS-and OS,or other appropriate zonirg designations as described in Exhibit A.
Excluded parts are areas zoned BQ. The purpose of this rezoning is to get the properties in conformance
with current General Plan designations and the Generai Plan policy in effect for the hillside. These
guidelines provide a more stricter regulation of development in hillside areas, limiting house sizes,limiting
the amount of grading,protecting natural features,and avoiding geological hazards. This is really to
enhance the environment and there are no foreseeable environmental problems. Mr.Jung stated that staff
was recommending a Negative Declaration. Mr. Brown moved for a Negative Declaration. Mr.Viskav'Qh
seconded the motion.

This proposal is to amend various residential zones of the Cupertino Municipal Code,which includes
adding provisions regarding residential group homes. This applicant will apply to all agriculture,
residential,and quasi-public zoning districts in the city. Currently there is nothing in any ordinance or
zoning districts to control the number of habitants per dwelling unit. The City is proposing some
guidelines and Use Permit restrictions to control these types of environments. The two types of living
environments are,residential care types of facilities(groups of individuals who live in housing but have
caretakers)and the other types that are not therapeutic are congregant care facilities(which are people who
live together,i.e.:a fraternity house). The City has determined the threshold of licenses and unlicensed
people who can live under one roof as defined by state law. For a residential carehome with seven or
more,or a congregant care home that has eleven, the City will place some restrictions. These restrictions
include buffering restrictions. This may be considered as part of the Use Permit process. This ordinance
will provide the City with some very specific findings that would have to be made in order for City
Council or Planning Commission to grant a conditional Use Permit. This will allow the City to have some
control over the proximity,the number of parking spaces,and the square footage of outdoor area. This
also will aid the environment because the ordinance is being created in comparison to what the City
currently has. Staff is recommending a Negative Declaration. Paul Roberts moved for a Negative
Declaration. Ciddy Wordell seconded the motion.

Location: Properties along or near Stevens Creek Boulevard from
Highway 85 to the eastern City limits.
This application is the Heart of the City Specific Plan.The Specific Plan itself is an implementing tool for
the General Plan.It is designed to be implemented with the concept of the General Plan,guidance for the
allocation of the development in and around Stevens Creek Boulevard,and designed to provide some
additional development standards of architectural guidance for new development. Most of the physical
impacts with a project of this size has been analyzed in the 1993 General Plan Environmental Impact
Report. The Specific Plan provides some additional refinement and detail to where exactly the new
housing units will be located,the density,the design of the buildings,the sitting of the buildings,and the
streetscage. The environmental impacts of this project in the public improvements and the specific land
use,use directions that were called for in the current plan being drafted for the Planning Commission,to
verify the difference with the General Plan. The schools stated they were neutral in regards to this project
as they could not foresee any future environmental impacts. Other potential impacts that have been
analyzed,is that some street trees may be removed and replanted with the trees that have been
recommended in the Specific Plan. The staff feels the trees being removed will be compensated by the
large number of additional trees the City will be planting in and along Stevens Creek Boulevard. In
regards to other Environmental Impacts the staff believes there will be some short term noise impacts due
to construction renovations,and the noise while moving the sidewalks. The staff expects there to be a
short-term increase in the rate of removal of natural resources,such as rock,sand and gravel for the
purpose of installing the sidewalks. Traffic impacts were analyzed in the 1993 Cupertino General Plan
Environmental Impact Report. In that report it was forcasted that there was going to be minor traffic
congestion. 'There are two exceptions, those are intersection of Stevens Creek Boulevard and De Anza
Boulevard,as well as De Anza Boulevard and Bollinger Road. The General Plan accepted the level of
service of"E"with no more than a 45 second delay in order to implement the Heart of the City concept.
Public Services impacts of additional development was again analyzed in the 1993 General Plan,and this
v,as well within the capacities of the City without a need for substantial increase in services. Most
neighborhoods have parklands with over 3 acre per thousand,and have a residential park.Staff is
recommending a Negative Declaration recognizing that this an implementing tool for the General Plan.
Paul Roberts moved for a Negative Declaration with the agreement that a minute order would be attached.
Carmen Lynaugh seconded the motion.

Springs Ranch development located to the south. These reports identified a 40 & 50 foot
setback from the Monta Vista fault which runs through this area. Bob Cowan
recommended various minimum lot sizes based upon these two geologic reports
recommended setbacks and the estimation of the fault line location. Bob Cowan made a
motion that this application be forwarded to the Planning Commission with the
recommendation that tot 9 be zoned RHS-15, lots 10 and 1.1 be zoned RHS-40, and lots 7
and 8 be deleted from this application. to be combined with a pending tentative map
application . Bert Viskovich seconded the motion.

environmental issues are traffic and potential noise from trash compactors and increased
deliveries to the food market. The applicant had consultants prepare a traffic analysis report,
which was reviewed by the City Traffic Engineer, who found that the project met the City and
Congestion Management Agency's traffic level of service standards. Staff is also proposing a
deceleration lane in front of the driveway to the shopping center to alleviate traffic congestion as
cars are entering the shopping center. The applicant also had consultants prepare a noise report.
The consultants advised installing a sound wall along the rear property line,a higher sound wall
along the loading docks, and a roof that covers the loading docks. This will meet the City's
ordinance for noise standards as well as meet the General Plan guidelines. Don Brown moved

Staff indicated that the General Plan Amendment request had been previously reviewed by ERC
on July 13, 1995,and would not be discussed at this meeting. Staff indicated that the project
environmental impacts would be considered from the standpoint of the difference in environmental
impacts from the previously approved project(1989)as compared to the proposed project for this site.
Staff described both the 1989 approved project and the 1995 proposed project. The 1989 project was a
195 unit apartment complex.The design was podium style with access through to Blue Jay. The
proposed project is a 140 unit apartment complex with at-grade construction without access to Blue Jay.
Staff reviewed the 1989 environmental impacts. The primary 1989 environmental impacts considered
included traffic,air quality,and noise.The traffic report stated there would be a significant increase of
traffic generated from the site to the adjoining roads. There were required roadway improvements at
Blue Jay,Homestead&De Anza Blvd.These improvements have been completed to meet City
standards. The noise study identified decibel level impacts`rom surrounding roadway vehicle noise to
the site and required building design mitigations. The air quality report concluded no significant
impacts.
Staff then discussed the potential environmental impacts of the proposed project and
recommended additional studies or actions to be taken. Last year a potentially protected burrowing owl
was discovered on Phase III. According to biological standards the animal was passively relocated and
the burrow was excavated.A new burrowing owl survey was conducted on this portion of the site and no
burrows were found. Regarding traffic, staff recommended an amended traffic report be conducted
because the through drive to Blue Jay is proposed for closure. The report would focus on turning
movement changes to both the intersection of Homestead and De Anza Blvd and the new entrance on
Homestead. Staff recommended an amended air quality report because the traffic on Homestead, De
Anza&280 has significantly increased since 1989. Staff recommended an amended noise study because
the building types,their locations and minimum setback distances to the surrounding roadway:have
changed. :Staff suggests that this item not come back to ERC if the reports identify no significant impact
and that the mitigations identified by the respective experts be integrated into the project conditions of
approval, if the project is approved. Bert Viskovich moved for a Negative Declaration with the condition
that the environmental studies be completed prior tc the Planning Commission meeting. Bob Cowan
seconded the motion.

view sheds which has been identified in the RHS zoning district. The applicant has proposed to
do some grading to set the tank.into the ground to offset the 8 foot width increase. The applicant
has also proposed to paint the steel tank a dark green color,as well as landscaping the area. Staff
does not believe that the aesthetic effects will be significant. The last possible environmental
impact is geological. The applicant has provided a geologic study which stated that the closes
fault line is the Borequal which is a thousand feet away. Staff feels because of the distance and
the design standards of the tank,the fault should not cause impacts. The staff does not foresee
any envirorunental impact and is recommending aNegative Declaration. Bert Viskovich moved

Lindy Lane. The re-zoning is part of the City program to re-zone all hillside areas to the
revised RHS zoning ordinance. These areas are presently zoned single family Rl zoning.

purpose of the re-zoning is basically to establish additional protective measures in terms
of more restrictive development regulations in order to avoid hazardous areas of

designation was changed in 1993 for this parcel. The applicant is planning a small lot single family
development. The environmental issues of concern are traffic noise levels along Stevens Creek
boulevard that exceed general plan standards. The applicant is proposing to construct a soundwall along
a portion of lot I to mitigation noise levels from auto traffic. In addition, trains traveling to Stevens

Creek quarries pass this site three times a week, one roundtrip per day. Because of tcderal regulations
that require train whistles at crossings, there are no mitigation measures for this noise. The consultants
report shows there is no contamination of the site other than light spills of tar and oil which are
superficial(I to 2 inches in depth).

This project consists of three lots with three single family dwellings currently on
each lot. The applicant is proposing to demolish these homes, and re-subdivide the lots
into eight lots. Staff explained that the environmental impacts would only be in regards
to the trees currently on the lots.According to the applicant's three arborist reports,the
concern is in regards to nine trees. Four of these trees have been proposed to removed.
Two are Italian Cypresses,(which are of ordinance size), one is a English Walnut, and
the last is a Monterey Pine. According to the arborist reports,The Monterey Pine may
only last ten to fifteen years,and is not guaranteed to survive the construction. The
recommendations are to replace the tree with a native tree in a different location. Staff is
recommending that the tree be removed. Bert Viskovich moved for a Negative
Declaration with a motion that the Planning Commission consider options to save the
Monterey Pine Tree. Wally Dean seconded the motion.

Colin Jung presented the application for a use permit to extend the hours of an existing
restaurant/bar to 2 a.m., Monday thru Sunday, and to allow karaoke music/singing. The name of
the restaurant is San Wang and was previously known as Johnny Z's. The restaurant began the
karaoke before receiving approval and got complaints from the neighbors about the noise. As a
result, the city's attorney filed an injunction against the owners and pulled the plug on the
karaoke and extended hours. A noise report was conducted and the maximum noise level on the
exterior was 40 decibels which was 10 decibels below the max allowed by the ordinance. Staff
indicated that from an environmental standpoint, the noise level is not significant however that
doesn't mean it wouldn't be an impact. The committee made a motion to grant a mitigated
negative declaration contingent upon the applicant demonstrating that they can control the
parking after 10 p.m., sevens days a week and that they can assure that the sound from the
karaoke bar will not be audible at the property line adjacent to the residents.

Colin Jung presented the application for the proposed Andronico's market at the Oaks shopping
center. The applicant is proposing the demolition of the 730 seat cinema, the 4050 sq. ft. Italian
Restaurant and the space that is occupied by the dance academy., They are proposing a new
32,160 sq. ft. supermarket, with the market on the bottom level, a cooking school and offices on
the upper level and the loading dock in the back. The supermarket will be oriented toward the
bulk of the parking lot. They will have pedestrian features such as a flower kiosk, outdoor
produce, and some tables. etc. There are twelve matured trees proposed for removal. One of
which is a city street tree. The most significant sized ones are a 12"and 1 S"oaks. The idea is to
relocate the most significant sized oak trees to another part of the shopping center. The city's
Arborisi will determine what the best solution is for the removal/re-planing of the trees. The
landscaping plan includes a total of 14 Coast Live oaks and among those, some 24" box ash
trees, Chinese Pistash, Crepe Myrtle, and African Sumac. The applicant is also proposing to
eliminate 21 parking stalls. However, because they are replacing a high traffic/parking
generating cinema, etc. with a lower traffic/parking generating supermarket, there will not be a
traffic impact.
From an environmental point of view, the parking situation is okay, however the committee
would like an evaluation of the parking standards for other Andronico stores and of trips per
square foot in the market area. In addition, the applicant will also be required to pay the cost for
the city retaining an Arborist to evaluate the replanting or relocating of trees.
Staff recommends the adoption of a negative declaration contingent upon tree
relocating/planting,traffic and parking mitigation.

Michele Rodriguez presented the application for a city initiated rezoning of the Fairgrove
neighborhood. The neighborhood consists of about 220 single-family homes. Homeowners
approached the Planning Commission and asked them to create some mechanism for protecting
the architectural styles of their Eichler homes. Staff has been working, for about a year, with a
subcommittee to develop an amendment to the single-family residential ordinance. Accompany
the ordinance are design guidelines that would create some recommended regulations. This
project is a rezoning to Rle, single family residential Eichler. This zoning designation will be a
manner of notifying future home buyers that there is something special that applies to their
home. This will also enable staff to advise people that come into the office of these additional
regulations.
There are no environmental impacts and staff recommends the adoption of a negative
declaration.

allow hotel use.
Ciddy Wordell presented the application for the construction of the 217 room, 130,580
square foot hotel and restaurant/bar. The restaurant will face the plaza area and. have a
separate identity and direct access. The proposed hotel is going to utilize part of the four
corners plaza for a sidewalk and turf block for fire access. Staff identified a number of
significant impacts. The first deals with conformity to the Heart of the City and General
Plan in relation to height. The proposed mitigation'would be to provide transition elements
between the lower and higher parts of the building and superior design. The second impact
deals with change in land use. That change will be mitigated through building design and
materials in relation to the four seasons corner and surrounding buildings. The third
impact is parking. The hotel provides for 142 spaces; however the code requires 268
parking spaces. The applicant conducted a parking study and concluded that the adjacent
garage has capacity to absorb the extra cars at the hotel's peak time. The next impact is the
relationship of the hotel to the four season square (plaza). The goal is to create a pedestrian
walking environment that will go around the perimeter of the park. The hotel has an
outdoor eating area that interfaces well with the plaza. A final impact is sewage treatment
and disposal. The applicants have given the sanitary district a deposit to determine if the
local lines are adequate to serve the hotel as well as the proposed apartments. Staff
recommends the adoption of a mitigation negative declaration contingent upon the
measures outlined above.

Creek Boulevard at City Center).
General plan amendment to exceed the allowed height of 75 feet and to penetrate
the 1:1 setback ratio from Stevens Creek Boulevard.
Various exceptions to the Heart of the City Specific Plan which may include
allowing an apartment use, maximum height of building and side and rear setbacks.
Michele Rodriguez presented the application for construction of a new 205 unit, 293,137
apartment complex. The general plan amendment allows 75 feet in height and the
applicant is proposing 105 feet at the highest point. The exception for the Heart of the City
is also for the height. The Heart of the City limits the height also to 45 feet. The use
permit is for approx. 300,000 sq. ft. of building area, 7000 of which will be retail. The
environmental impacts include the relationship to the park, the sanitary sewer system, and
the storm drainage system. Other environmental impacts that are related to the project but
are not significant include fire, traffic and grading. As far as fire is concerned, what has
been proposed for mitigation is a fire path around the building. In addition to that, there
will be on-site storage of water and the ability to fight the fire in the high rise portion of the
building. As for the traffic, the traffic department will make improvements to both the
Stevens Creek and Rodrigues intersections & increase cue time at Stevens Creek and
Torre. For parking,the adjoining surface lot will be used for 30 spaces. The parking study
did indicate that the most encumbered time would be between 8pm and 5:30pm, which is a
different peak than the homeowners. A parking study concluded that at no time, was there
a deficiency on the surface lot but rather up to 100 available spaces. Also, the applicant
will be required to use plexi-glass or some other material on the outdoor balconies to
minimize noise from Stevens Creek Boulevard. Staff recommends the adoption of
mitigated negative declaration contingent upon the measures outlined above.

Michele Rodriguez presented the application for construction a 40,000 square foot office
building. The office building requires an amendment to the General Plan in order to draw
down from the retail square footage and convert it to office space. An economic study was
conducted. The project environmental impacts relate to saving an oak tree, housing and the
General Plan Amendment. As for traffic, there was no report required because the
restaurant generated higher traffic than the office building at peak hours and because of the
low traffic volume in the area. As far as the General Plan Amendment, staff is proposing
mitigation for the draw down to try to offset the retail loss in the long-term. The
conclusion of the economic study was that there is not a huge demand for additional retail
in the city at this time, so there was no impact. Furthermore the study indicated that we
could not identify for the long-term what the demand for retail space is. Staff is proposing

story, 77 room hotel. One environmental impact is the size of the sanitary sewer line down
Stevens Creek from De Anza down to Wolfe. That impact is being addressed through. the work
on the city center project. As mitigation, the iine may need to be replaced by a larger one and the
applicant will share in the cost. Another impact is the large specimen size tree on the property.
The applicant is mitigating the removal of the tree by planting more palm trees as part of their
proposal. Another concern is construction noise. Staff will require in the conditions of approval
limiting the hours of construction and the use of mufflers. in addition, the GPA allocates a total
585 hotel rooms. With the new proposed projects. the total number of room exceeds 27 rooms.
From a policy standpoint, staff indicated that this matter can be mitigated at the hearing level.
Staff recommended the adoption of a negative declaration. Richard recommended that the project
have a"hole in the fence"—a walk through area for pedestrians.

has sparked a number of traffic concerns from the residents. Staff indicated that these concerns
do not apply to environmental impacts. They deal with operational issues such as the timing of
the lights, etc. The Planning Commission has requested for staff to re-evaluate this project and
look at the current traffic counts generated by the traffic engineer. Staff concluded that there is
not a deterioration in the level of service at Stevens Creek and Mary. Staff recommended a
mitigated negative declaration contingent upon traffic timing mitigation, operational concerns
and cut thru mitigation in the future. The committee members reaffirmed the previous
recommendation based on the revent data received.

Peter Gilli presented the application for the demo of 19,105 square feet of commercial and the
rebuilding of 46 residential units on a podium. Six thousand square feet will be office and 5,600
retail square feet. The complex will have underground parking. The parking for the entire site still
needs to be refined to serve both uses. The project is a three story condo complex. The office and
retail portion will face Stevens Creek Blvd. Environmentally there are impacts however staff
indicated that they are not significant. Those impacts relate to change in land use, displacement of
soil, and the extension of sewer main. The traffic will not increase according to the ITE standards.
The project also requires an exception to the Heart of the City in regards to setbacks. Staff has
asked the applicant to provide more of a setback on Blaney, which reduces the setback between the
apartment and office from 20 to 15 feet. There are no significant environmental impacts and staff
recommends the adoption of a negative declaration.

Considerations for modification to the Cupertino Municipal Code regarding construction noise.
Colin Jung presented the application for the modification to the municipal code in regards to construction
noise. One section of the ordinance states that certain activities such as grading and street activities are
prohibited within 750 feet of a residential area on Saturdays, Sundays, Holidays and between 8pm and lam
on weekdays. Another section of the ordinance states that construction demolition activities are allowed to
exceed noise limits during the daytime hours if the equipment have high quality mufflers. During the
nighttime hours, these types of activities are not allowed unless they meet the nighttime noise standards.
® Staff would like to take a look at the citizen complaints and modify the ordinance to address construction
hours or change the way construction is defined. The committee suggested that the cutoff time for
construction should be 8pm. In addition, the committee would like to see that construction begins later and
end earlier on Saturdays and no construction on Sundays.
