elected and appointed officials

●January 2020: Council adopts current Ethics Policy
●December 2022: Civil Grand Jury identifies Ethics

●February 2023: Council adopts City Council
Procedures Manual
●May 2023: City Attorney’s Office releases Fact-Finding

●July 2023: Internal Auditor releases Enterprise
Leadership Assessment
●September 2023: Council considers Ethics Policy
updates and provides direction for City Attorney to
return with revised policy based on 2018 Ethics Code
Ethics Code Revisions
●Covered Officials: Coverage of the proposed Ethics
Code would be extended to department heads as
well as elected officials, Council appointees, and the
City Manager, City Attorney, the City Clerk, and the
Treasurer.
●FPPC Reporting: Expressly states that all Members have
an obligation to comply with California Fair Political
Practices Commission (FPPC) regulations
●Conflicts of Interest: Expanded conflict of interest
protections
Ethics Code Revisions
●Enforcement: Detail regarding the procedures for and
form of discipline added to 2018 Code.
●Other Revisions: Revisions to—
●Ensure consistency with the recently adopted
City Council Procedures Manual.
●Ensure that the First Amendment rights of City

Recommended Action
●Adopt Resolution No. 23______ adopting the City of
Cupertino Code of Ethics and Conduct for Elected
and Appointed Official and rescinding the current
Ethics Policy.
