A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
INITIAT NG PROCEEDINGS AND SEPPING THE TIME AND PLACE FOR
PUBLIC HEARING FOR CONSIDERATION OF ANNEXAMON OF 1.105
ACRES ON UPLAND WAY SOUTH OF RAINBOW DRIVE;
DESIGNATED "UPLAND WAY 86-02 (REVISED"
WHEREAS, the City Council of the City of Cupertino proposes to annex
the area designated "Upland Way 86-02 (Revised;" and
WHEREAS, the property is contiguous to the City of Cupertino and is
within its urban service area; and
WHEREAS, annexation would provide for orderly and efficient delivery
of services to the adjacent property; and
WHEREAS, this 1.105 acres on Upland Way south of Rainbow Drive is a
public road, is uninhabited, and was prezoned on September 21, 1981; and
WHEREAS, the City of Cupertino, as Lead Agency for environmental
review completed an initial study and granted a Negative Declaration for
the annexation; and
WHEREAS, the development proposed for this territory is street
improvements during 1986; and
WHEREAS, the County Surveyor of Santa Clara County has found the
revised map and description (Exhibits "A" and "B") to be in accordance
with Government Code Section 56826, the boundaries to be definite and
certain, and the proposal to be in compliance with IAFOO's road annexation
policies; and
WHEREAS, the fee set by the County of Santa Clara to cover staff costs
for above certification has been paid; and
WHEREAS, as provided in Government Code Section 56826 the City Council
of the City of Cupertino shall be conducting authority for a
reorganization including an annexation to the City; and
WHEREAS, any owner within the territory proposed to be annexed may
file a written protest against the annexation with the City Clerk at any
time prior to the hearing on the proposed annexation;

NOW, THEP=RE, BE IT RESOLVED, that the City Council of the City of
Cupertino hereby sets 6:45 p.m. , November 17, 1986, City Hall Council
Chamber, 10300 Torre Avenue, Cupertino, California as time and place to
conduct a public hearing to consider annexation of territory designated
"Upland Way 86-02 (Revised) ."

NOTICE IS HERESY GIVEN THAT at their regular meeting of Monday, November
17, 1986 at 6:45 p.m. , City Hall Council Chamber, 10300 Torre Avenue,
Cupertino, California is the time and place to conduct a public hearing
to consider annexation of territory designated "Upland Way 86-02 (Revised)".

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CJPERTINO
ORDERING ANNEXATION OF AREA DESIGNATED AS "UPLAND WAY
86-02 (REVISED) " TO THE CITY OF CUPERTINO, APPROXIMATELY 1.105
ACRES LOCATED ON UPLAND WAY SOUTH OF RAINBOW DRIVE
WHEREAS, on October 27, 1986 the City Council adopted Resolution No.
6998 initiating pings and setting the time and place for public
hearing for consideration of annexation of the area designated "Upland Way
86-02 (Revised) ;" and
WHEREAS, said territory is uninhabited and is a public roadway; and
WHEREAS, Section 56826 of the California Government Code states that
the Local Agency Formation Commission shall not have any authority to
review an annexation to any City in Santa Clara County of unincorporated
territory which is within the urban service area of the city of the
annexation if initiated by resolution of the legislative body and
therefore the City Council of the City of Cupertino is now the conducting
authority for said annexation; and
WHEREAS, the property owners of the said territory were notified of
the hearing and no written protest against the annexation was filed with
the City Clerk at any time prior to the City Council's hearing on the
proposed annexation; and
WHEREAS, a duly noticed public hearing was held before the City
Council of the City of Cupertino on Monday, November 17, 1986 at 6:45 p.m.
in the Council Chamber, City Hall, 10300 Torre Avenue, Cupertino,
California; and
WHEREAS, evidence was presented to the City Council;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Cupertino as follows:
1. That it is the conducting authority pursuant to Section 56826 of the
Government Code for the annexation of property designated "Upland Way
86-02 (Revised) ," more particularly described in Exhibit "A";

2. That the following findings are made by the City Council of the City
of Cupertino:
a. That said territory is uninhabited and compr--es 1.105 acres.
b. That the annexation is consistent with the orderly annexation of
territory with the City's urban service area and is consistent
with the City policy annexing when providing City services.
C. The City Council has completed an initial study and has found
that the annexation of said territory has no significant impact
on the environment, and previously approved the granting of a
Negative Declaration.
d. The City Council on September 21, 1981 enacted an ordinance
prezoning the subject territory.
e. Annexation to the City of Cupertino will affect no changes in
special districts.
f. That the territory is within the City urban service area as
adopted by the Local Agency Formation Commission.
g. That the annexation is made subject to no terms and conditions.
h. That the County Surveyor has determined the boundaries of the
proposed annexation to be definite and certain, and in compliance
with the Commission's road annexation policies. The City has
reimbursed the County for actual costs incurred by the County
Surveyor in making this determination.
i. That the proposed annexation does not create islands or areas in
which it would be difficult to provide municipal services.
j . That the proposed annexation does not split lines of assessment
or ownership.
k. That the proposed annexation is consistent with the City's
General Plan.
1. That the City has complied with all conditions imposed by the
commission for inclusion of the territory in the City's urban
service area.

limits under provisions of the Government Code.
3. That said annexation is hereby ordered without election pursuant to
Section 56837 et seq. of the Government Code.

Discussion of Environmental Evaluation
5(d) Approximately 2 28 acres of Area "B" is under agricultural production

The proposed R1-6 zoning for Area "B" properties and the RHS zoning for
Area "A" properties is consistent with the General Plan. The development
impact associated with future development of vacant properties in Area B
were addressed in the General Plan and will be addressed in greater detail
if and when a specific development proposal is submitted for review.

Determination:
On the basis of this initial evaluation, the Environmental Review Committee finds:
FI That the proposed project COULD NOT have a significant effect on the environ-

All that real property situate in the County of Santa Clara, State of
California, being described as follows:
Being a portion of Upland Way, as shown upon that certain Map entitled 'Tract
No. 492 Marquette Heights Subdivision' recorded March 22, 1948 in Book 18 of
Maps, pages 4 and 5, also being a portion of Rainbow Drive and Bubb Road, as
shown upon that certain Map of Tract 3281, recorded in Book 155 of Maps, pages
28 and 29, Santa Clara County Records and being more particularly described as
follows:
BEGINNING at the Southeasterly corner of Upland Way, hereinabove described,
said point of beginning also being in the Westerly line of the existing City
limits line of Cupertino as established by Ordinance entitled "Seven Springs
80-170; thence from said point of beginning. leaving said City limits line,
West 60.00 feet; thence North 665.53 feet; thence Northeasterly along a
tangent curve to the right, having a radius of 230.00 feet, through a central
angle of 220 20 ' 000, an arc length of 89. 65 fee'_ to a point of reverse

Dear Mike:
The City Attorney has determined that Upland Way can be annexed through
routine annexation procedures. The annexation would be subject to the
same fees as other annexations listed as follows:
$230 Check Payable to City of Cupertino Processing Fee
$ 50 Check Payable to L.A.F.C.O.
$660 Check Payable to County of Santa Clara
for certification of plat and description
The complete annexation process would take approximately 2 to 2} months.
This includes time for the County Surveyor to certify the boundaries
and time for the City Clerk to schedule a public hearing.
If you are interested in initiating annexation proceedings contact
Lavenia Millar in Public Works for assistance. Since there are no
signatures required we can begin the application process in our office.
