OFFICE OF THE DIRECTOR FROM THE ACTING DIRECTOR U.S. CENSUS BUREAU The U.S. Census Bureau is conducting the 2002 Boundary and Annexation Survey (BAS) to update the information it has about the legal boundaries, names, governmental status, and types of municipalities in the United States. The Census Bureau will use the boundary information that you provide to us in various programs and surveys, such as the Population Estimates Program, the American Community Survey, and the 2002 Economic Census. We are enclosing the forms and map(s) you will need to complete this survey. Please review the forms and map(s) to see if the information and boundaries shown are correct. We also have enclosed a postage-paid postcard that we ask you to complete and return within 5 days after receipt of the materials to let us know if your municipality intends to provide boundary or map change information. If you have no changes to report, please just complete and return the postcard; there is no need to return the maps or the survey forms. If your municipality intends to provide boundary or map changes, please review and update the entire boundary of your municipality on the enclosed map(s) and complete the enclosed Form BAS-1A showing the reason(s) for the change(s). Information describing how to update the map(s) and fill out the BAS form(s) is shown in the "2002 BAS Guide." Please return at least one signed map and all completed form(s) if you report a change. We are enclosing a return envelope and postage-paid label for your convenience. To ensure that your latest boundary information is used in the Population Estimates Program, the American Community Survey, and the 2002 Economic Census, we ask that you complete your review and return the updated maps and completed forms within 15 days after you receive the materials. We estimate that the requested review will take most respondents from 1 to 4 hours, with an average time being about 3 hours. This includes the time needed to read the instructions, assemble materials, organize and review the information, and report any needed changes. We base our estimate on 80 percent of all areas having few or no changes. However, it is not uncommon for areas with many changes to take 20 hours or longer to complete the survey. Send comments regarding this burden estimate or any other aspect of this collection of information, including suggestions for reducing this burden to: Paperwork Project 0607-0151, Room 3110, Federal Building 3, U.S. Census Bureau, Washington, DC 20233-1500. You may e-mail comments to Paperwork@census.gov; use "Paperwork Project 0607-0151" as the subject. This voluntary survey is authorized by Title 13, United States Code. Under the Paperwork Reduction Act, we cannot ask you to respond to a collection of information unless it displays a currently valid OMB control number. As with any massive undertaking, some changes reported may not appear on the maps because of clerical or file errors. We ask that you review the maps carefully and add any updates the U.S. Census Bureau may have missed in processing the boundary updates. Report of Boundary Change Information The Census Bureau will provide the legal change action numbers and effective dates you report about individual legal boundary changes to a certification official designated by the governor of your state. In most states, incorporated municipalities must report all legal boundary changes to the state for those changes to be legally recognized. We request that you make sure you provide the same information you provide in the Boundary and Annexation Survey to the appropriate state official if your state requires notification or filing of change actions. The Census Bureau will need to contact your government again to verify information that differs from that obtained from the state. One of the goals is to improve the efficiency and accuracy of assigning housing units to the correct government. To do this, the Census Bureau needs address information at each point where the current legal boundary intersects a street or road that has house-number/ street-name addresses. As part of the 2002 Boundary and Annexation Survey (BAS), please review and annotate the map(s) with any needed address information after you complete the boundary review, and update the maps, if necessary, and sign the submittal box stating the accuracy of the boundary on the enclosed SAS map(s) and form(s). Please return the signed SAS map(s) and form(s) within the time period noted in the letter, regardless of whether you can help with the address information. Although the address information is important to the Census Bureau, a timely response regarding boundary changes is more important. If you need more time to provide the requested address information, please return quickly only those signed map sheets that show boundary changes along with the completed SAS form(s). When you do this, please request replacement map sheets to complete the address review on all returned map(s); you can do this by calling the appropriate toll-free telephone number noted on page 2. Special Note The Census Bureau attempted to limit its request for address information to those jurisdictions that have a house-number/street-name mailing address system. If your jurisdiction does not have house-number/street-name addresses used for mail delivery, or if none of these addresses exist in the vicinity of any boundary, you may ignore this request. However, if your governmental did not previously have address coverage and now does, or has partial coverage, please annotate the addresses at each point where your boundaries cross an addressed street. Instructions for Entering Changes on the SAS Map The Census Bureau enclosed a computer-generated map(s) and survey form(s) showing this information in its records for the legal boundaries of your government. The map(s) display street names throughout and address information along the streets in the vicinity where they intersect your legal boundaries. If this information is not complete or accurate, please follow these step-by-step instructions to make corrections. Use the enclosed return envelope or mailing label to mail the signed and updated map(s) and survey form(s) back to the Census Bureau. 1. Boundary Review and Update Step 1. COMPARE—the boundary on the SAS maps)to the current legal boundary of your jurisdiction. If there is a discrepancy, d a please correct the SAS maps) using the .c update procedures below. Step 2. UPDATE—the map(s) if the boundary shown does not correctly depict the current legal boundary of your jurisdiction. Use the enclosed pencil that has red colored lead to make boundary updates on the map(s). a. For 'regular' boundary changes, draw the new boundary and cross out the portion of j09 "tr9°•= the boundary that is incorrect using a string • of red 'Xs.' If the boundary and the feature sAs CrrY are contiguous, annotate when the feature also moves with the boundary by circling the red 'Xs.'Add the number of the legal action authorizing the change, along with a r the effective date of each annexation or r•. detachment you show on the map. See '"act°" Figure 1 for an example of the information that should be shown when you correct a Figure 1 boundary. b. If the boundary change represents a correction to our map where the boundary is not accurately displayed, please use the red lead and mark the correction with the letters "BC"to identify the change as a boundary correction. c. If the boundary is offset on both sides of the center line of a road feature creating a narrow strip of land that includes only road surface or road surface and right-of-way and does not contain structures,we call this portion of your government a corporate corridor. To show a corporate corridor on the BAS r lsl, use the pencil with red lead to draw the boundary close to both sides of the line representing the road but not touching the road. Mark the beginning and the end of the corporate corridor with red hatch Ul) marks. Annotate the corporate corridor with the letters 'CC" in red next to it. See Figure 2 below for an example of what qualifies as a corporate corridor on the ground. Audrey Ave (Bas City) CC Figure 2 d. If the boundary is offset from one side of the center line of a road feature and does not contain structures, we call it an offset boundary. To show an offset boundary on the BAS map(s), draw the boundary using the pencil with red lead close to but not touching the offset road. Mark the beginning and the end of the offset boundary with red hatch (//) marks. Annotate the offset with the word "OFF" in red next to it. See Figure 3 below for an example of what qualifies as an offset boundary on the ground. lea, ZS11 OFT arren Dr (Bas City) Figure 3 When finished annotating a new boundary, please ensure that the boundary "closes"; that is, that the boundary is continuous around your entire jurisdiction. If your boundary extends beyond the detail on the map or you need replacement maps for address update, please request additional map coverage from the appropriate toll-free telephone number listed below: 1-800-972-5653 (for counties and statistically equivalent entities, minor civil divisions, and American Indian areas) 1-800-972-5651 (for places) Step 3. COMPLETE—the form(s). If your area is a municipality, list all legal annexations or detachments requested on the forms BAS-1A and BAS-3A only. Enter on the survey form the authorization type, legal number, and the effective date of each annexation and detachment shown on the map. Be sure to note where one of these actions places your area within a new minor civil division (if any). Include the estimated area (square miles or acres), and the current estimated population and housing for each listed action. If your area is an American Indian reservation and/or off-reservation trust lands area, provide the legal documentation information requested on form BAS-5A. Step 4. SIGN—the map(s)to document that the map(s) now depict the correct legal boundary of your government to the best of your knowledge. Please sign and date the submission box of all maps with changes (boundary, feature, and/or addresses). If there are no changes and the extent of your government appears on more than one Census Bureau map sheet, please sign the index sheet. If there are no changes and your government is displayed on one Census Bureau map sheet, please sign the one sheet. Step 5. RETURN—only the signed map(s) with changes (if no changes, return either the index sheet or one map as described above) and the completed survey form(s)to the Census Bureau using the enclosed return envelope or mailing label provided in your mailing package. To delete a street or other base map feature, cross out what is being removed using a string of "Xs." Delete features only if nonexistent or if the street is impassable. Please do not delete an existing street because your jurisdiction is not responsible for maintaining it. (See item a below.) Mark the beginning and end of the base feature to be deleted with purple hatch (//) marks. Aurora St Jones Dr Sur Dr Street Deletion Correction Lincoln St e. For private roads such as mining, logging, farm roads, or private driveways, please do not delete an existing street or road; rather, label it in purple as "PR" for private. f. To move or correct a street or other base map feature, use a combination of the above add and delete instructions. (Please note: The Census Bureau is beginning a nationwide program to improve the location accuracy of all streets and other features that appear on its maps. Please do not spend time making small location corrections on the BAS maps; correct only those streets that are significantly mislocated.) M2 ens-GUIDE¢ooz Page 3 • i 3. Address Update Use the enclosed pencil with purple lead for annotating address number information on the BAS map(s)• We prefer potential versus actual address numbers. By "potential" we mean the lowest or highest (as appropriate) address that could be assigned to a location, even though an actual structure may not exist having that address. For example, if the last building on a street inside your jurisdiction has the number 768, but your records show numbers up to 798 would still be inside your jurisdiction, annotate 798. If potential addresses are not available, please provide the actual addresses. Please print the address numbers in purple as neatly and legibly as possible. a. Please verify the lowest or highest(as appropriate)address number assigned inside your government on both sides of every street or road intersected by the current legal boundary. That is, wherever the computer-plotted boundary intersects an addressed street or road. If you do not agree with an address that is preprinted on the map, line through the preprinted address in purple and print the correct address number in purple, parallel to and on the appropriate side of each street either above or below the plotted address. Add missing address information where none is shown on the maps in the same manner. For boundary changes, where the red pencil boundary you added intersects an addressed street, please print in purple the lowest or highest(as appropriate) potential address number assigned inside your government parallel to and on the appropriate side of each street. b. If your updated boundary (red pencil)frequently crosses a congested network of streets or roads in a way that makes entering all the addresses difficult to read, please draw, using the appropriate color pencil: (red for boundary; purple for features, feature names and addresses) an inset (enlargement) in the map margin or an uncongested area of the map showing the streets with the boundary superimposed over them and print the addresses in purple where the boundary intersects each addressed street. Either draw an arrow from the inset to the congested streets, or if you need many insets, label the congested area and the inset with a letter, starting with 'A.' Do not repeat letters on a map sheet. If there is not enough space on the map or margin to draw the insets, you may use a separate piece of paper. Please label the paper with the name of your government, the state name, the BAS map number, and the inset letter to which you are referring on the map. In very congested areas, you may send us a copy of your local source maps with the updates required in the congested area highlighted. We are currently updating the official Cupertino chamber of commerce map as contracted by Linda Ashbury at the chamber office. We had a brief phone conversation regarding the project a few weeks ago. At this point, I wanted to bring you up to date with our situation regarding the project. Last March you kindly sent us lots of new street info for the upcoming chamber project. I have itemized that data you sent us to let you know what we have at this point in time (see next page). Ultimately, we would like to fill the information gap from that data you sent us last March to this month. Toward that end, would it be possible to get from your office a base map of Cupertino showing the street layout for both public and private streets? Or, in the event your base map may not be current to this month, could you please let us know of the new subdivision maps approved by the City? Sending either copies of the maps or Recorder Book/Page numbers would be extremely helpful. I know you must be under an ever growing time crunch so if there is anything I can provide to help clarify our request, please call me at 800-441-6277 or email to john@compass-maps.com. In any case, I will give you a call the week of the 17th for your comments and concerns. Thanks very much for your time and consideration. We really appreciate the help. When we do finish our map project, I will be more than happy to send you some copies for your files. Sincerely, John a ele Rese rc. As you know the Monta Vista area is being annexed to the City on a parcel by parcel basis and that most of the streets have already been annexed. To be able to better serve the residents of Monta Vista the City desires to continue to annex in this manner. However, we would like to request that in an effort to annex the area sooner that we are given the chance to annex a property when they apply for a building permit with the County for addition of square footage or a new structure. The City would require the owner to annex to the City at that time and the City would process their building permit. If you have any questions please contact me at 408-777-3216. On November 20, 1979 the City Council of the City of Cupertino passed and adopted Resolution No. 5155. The resolution states in part: "Property within the City of Cupertino's Urban Service Area, with existing City water services, shall be annexed to the City at such time as an addition, alteration, repair or new construction on the property exceeds twenty-five percent (25%), within any consecutive two (2) year period of the replacement value of the existing structure or structures located on the property." Enclosed please find a copy of this resolution. The current County policy requires annexation for new single family residences only. If a property owner is remodeling a home in excess of twenty-five percent they are able to obtain a building permit from the County despite City policy. When conducting your review please consider the following points. All parcels in the Monta Vista area have existing City water service. In addition, the City maintains all streets in this area with the exception of portions of Lomita, Alcazar, Imperial, and Byme Avenues. These parcels are in essence islands surrounded completely by the City of Cupertino. There are many older smaller homes in this area that could remodel to upgrade. Stelling Road Cupertino, CA 95014 Dear Roberta: As requested we are furnishing the information for the unincorporated areas of Cupertino. Please see enclosed map for location of item numbers. 1. This item is referred to as the Creston area. In 1980 the City conducted municipal organization (MORGA)annexations. The City could annex chunks of land 100 acres or less as long as they met certain criteria; (a) it was in our sphere of influence (a plan for the probable ultimate physical boundaries and service area of a local governmental agency); (b)the majority of landowners must consent; (c)it wasn't deemed prime agricultural land. The landowners in this case did not consent to annexation. 2. This is the N. Stelling area. It was not annexed because it was over 100 acres. 3. This is the Monta Vista area. It should be noted that Blackberry Farm is incorporated as of 5/20/91. The reasons for unincorporation is the same, it was over 100 acres. However, due to the fact that this is within our Urban Service Area(Cupertino Water)and a vast amount of construction goes on here,Monta Vista has become a hotbed for annexations. It is hoped that all of Monta Vista will soon become incorporated. We hope to accomplish this goal by requiring all building proposals, (providing they meet certain criteria), to annex. We average 5-10 annexations per year in Monta Vista. 4,5,6. These land items were not annexed because they were deemed prime agricultural land. I hope this will help you with explaining Cupertino's unincorporated areas. It should be noted that although these areas remain untouched, the City of Cupertino would annex these areas if the majority of landowners consented. If you have any questions, please call Kevin Rieden at(408)777-3254. Very truly yours, CITY OF CUPERTINO Bert J. Section 2106 (2) reads as follows: "For each county, the percentage of the total assessed valuation of tangible property subject to local tax levies within the county which is represented by the assessed valuation of tangible property outside the incorporated cities of the county shall be applied to its base sum, and the resulting amount shall be apportioned to the county. The assessed valuation of taxable tangible property for purposes of this computation shall be that most recently used for countywide tax levies as reported to the State Controller by the State Board of Equalization.
