CC 05-14-2024 (Open Session) APPROVED MINUTES CUPERTINO CITY COUNCIL Tuesday, May 14, 2024 SPECIAL MEETING At 6:45 p.m., Mayor Sheila Mohan called the Special City Council Meeting to order to order in the Cupertino Community Hall Council Chamber, 10350 Torre Avenue and via teleconference. ROLL CALL Present: Mayor Sheila Mohan, Vice Mayor J.R. Fruen, and Councilmembers Liang Chao, Kitty Moore, and Hung Wei. Absent: none. PUBLIC HEARINGS 1. Subject: 6th Cycle Housing Element and Associated General Plan Amendments Recommended Action: That the City Council adopt Resolution No. 24-039 (Attachment 1) adopting proposed General Plan Amendments, including but not limited to, the Chapter 3 (Land Use and Community Character Element), Chapter 4 (Housing Element), Chapter 5 (Mobility Element), Appendix A (Land Use Definitions, Appendix B (Housing Element Technical Appendix), and Appendix G (Community Vision 2040 General Plan and Zoning Amendments Environmental Assessment). Written communications for this item included a staff presentation, a supplemental report with an update on Valley Church Properties and staff responses to councilmember questions, desk items for Amended Attachment 1 - Draft Resolution and Amended Exhibit GPA-7 – Draft General Plan Land Use Map, a statement from Councilmember Chao, and emails to Council. Assistant Community Development Director Luke Connolly and Housing Manager Piu Ghosh gave a presentation. Councilmembers asked questions and made comments. Mayor Mohan opened the public hearing and the following people spoke. At 8:27 p.m., Mayor Mohan recessed the meeting. The meeting reconvened at 8:35 p.m. with all Councilmembers present. MOTION: Wei moved and Fruen seconded the staff recommended action as amended to adopt Resolution No. 24-039 (Amended Attachment 1 - Draft Resolution) adopting proposed General Plan Amendments, including but not limited to, the Chapter 3 (Land Use and Community Character Element), Chapter 4 (Housing Element), Chapter 5 (Mobility Element), Appendix A (Land Use Definitions, Appendix B (Housing Element Technical Appendix), and Appendix G (Community Vision 2040 General Plan and Zoning Amendments Environmental Assessment); which includes removal of the Dish n Dash (APN: 359 08 029) and all references to it from Draft Appendix B 4 since the site is not counted toward the RHNA and the four Valley Church parcels (APNs: 326 07 022, 326 07 0303, 326 07 031 and 326 07 036) and all references to them from Draft Appendix B 4. The motion passed with the following vote: Ayes: Mohan, Fruen, and Wei. Noes: Moore. Abstain: Chao. Absent: None. 2. Subject: Fiscal Year 2024-25 Fee Schedule (continued from May 7, 2024) Recommended Action: 1. Adopt Resolution No. 24-040 approving FY 2024-25 Fee Schedules A, B, C, and D. If adopted, new fees will be effective by July 14, 2024. City Council Minutes May 14, 2024 Page 3 2. Adopt Resolution No. 24-041 adopting User Fee Cost Recovery Policy Written communications for this item included a staff presentation and emails to Council. Finance Manager Jonathan Orozco gave a presentation. Councilmembers asked questions and made comments. Mayor Mohan opened the public hearing and the following people spoke. Adopt Resolution No. 24-040 approving FY 2024-25 Fee Schedules A, B, C, and D; with an amendment to remove the proposed fees in Schedule B – Engineering for Crane Lift $1,415 and Permit Parking Bi-annual Fee $40. New fees will be effective by July 14, 2024; and 2. Adopt Resolution No. 24-041 adopting User Fee Cost Recovery Policy. The motion passed with the following vote: Ayes: Mohan, Fruen, Chao, Moore, and Wei. Noes: None. Abstain: None. Absent: None. At 10:00 p.m., Mayor Mohan recessed the meeting. The meeting reconvened at 10:05 p.m. with all Councilmembers present. CONSENT CALENDAR Item 3 was pulled from the Consent Calendar by Councilmember Chao. 3. Subject: Consider accepting the City's Investment Policy Recommended Action: Adopt Resolution No. 24-042 accepting the City's Investment Policy Written communications for this item included a supplemental report with staff responses to councilmember questions and emails to Council. MOTION: Chao moved and Wei seconded to adopt Resolution No. 24-042 accepting the City's Investment Policy. The motion passed with the following vote: Ayes: Mohan, Fruen, Chao, Moore, and Wei.
