Please include the attached and this email for public comment on item 7 for 7/16/2024
I read the supplemental report and the question was to include an email that was sent AFTER
the public had an opportunity to speak.
Councilmember Moore requested for this information to be posted and staff declined to do so.
That is wrong.
Attached you will find a screen shot. It would have been nice to get a clean copy.
The PUBLIC DID NOT AND HAS NOT HAD THE OPPORTUNITY TO CONSIDER
THESE SWEEPING CHANGES.
Additionally, further direction is being given to staff that was outside of the purview of the
agenda item.
I see a lot of problems here.
I sincerely hope that the City Attorney, for the good of the City, walks these items back.
Please – only make only those changes necessary for the HE and make this a FIRST
READING for tonight.

Please pull Item Number 7 on the Consent Calendar for discussion. There were some items
That were tacked onto the end of the item from last time that I did not understand. They had
Never been discussed before. Also, I am not sure who introduced them in the first place?
It seemed like the Council was in a hurry to vote on them.
Also, I am really scared we won't have enough parking in the city if all the parking in the corner
Lots in the suburban neighborhoods are eliminated.

Dear City Attorney Jensen and Council,
I find that the agenda item for this item to be misleading and have a number of issues with it.
The stated objective is to ensure conformance with the Housing Element (HE).Seeing that, a reasonable person would assume that only the necessary changes for the HE would be made.However, the ordinances are going far further than that and this is misleading.
And I think that there is a potential for this to create a problem for the City.
REQUEST - In order to conform with the stated objective, please revise all ordinance text to reflect only what is required for the HE.
Furthermore, the supporting documents are misleading and having had a discussion with councilmember Wei this afternoon, I have confirmed that we are being misled.
For example, in going from 55% FAR to 65% FAR is NOT a 10% increase. Councilmember Wei believes it is. And it is understandable having looked at the supporting material.In fact it is over 18% increase! In this scenario, a housing project will be allowed to have an over 18% higher Floor Area Ratio (FAR) than in the past.THIS IS NOT OKAY. And the greater the FAR, the lower quality of life for outdoor living and fewer opportunities for trees to help with climate change and air quality and reduced aesthetics. And I am
concerned about the PUBLIC SAFETY aspects of these modifications for ingress and egress for fire safety. REQUEST – Please only make those modifications that are necessary for the HE and stop there.
Beyond this, another concern is that this “second” reading agenda item looks materially different from the first. Here is that one:
The first and second reading notices should be identical and they are not.
Also, I find it very troublesome that a letter from “Cupertino for All” was included in the agenda packet. It makes it look like there were back-door dealings with this organization and staff. It is a bad look. It
should have been placed with written comments and I could like to understand how that happened.
The HE is causing significant change. Let’s please not add to it.

Dear City Council,
I am troubled by an egregious math error in the supplemental #7 report stating,
Maximum lot coverage in the R-1 zoning districts is 45%. Therefore, the 50% lot coverage
proposed through the amendment would allow R-1 zoned lots eligible to develop duplexes under
Strategy HE-1.3.6 to exceed the R-1 coverage standard by five percent.
Please note that the 5% increase represents an exceedance of 11.1%, not 5%.
45% x 11.1% = ~50%
An over 10 percent increase is significant.
Seeing this error makes me worried about the accuracy of other information provided to the public
and our city council regarding significant zoning changes.

I wanted to send a huge thank you for your receptivity to the community's input regarding the
amendments to Cupertino's Municipal Code to implement the 6th RHNA Cycle Housing
Element!
The rezonings you passed on July 2 will enable our Housing Element to be eligible for full
certification by HCD.
I look forward to an ambitious implementation of our Housing Element. Our public
implementation process using the compliant Housing Element is vital in helping Cupertino
reach its full potential in becoming a strong and resilient community – both in welcoming
new residents, accommodating older residents, and getting young families and teachers closer
to their work and schools.
Once again, thank you so much for enacting improved zoning policies, ensuring the Housing
Element’s full compliance, and laying the foundation for a more vibrant Cupertino.
