SMW and the city attorney have informed us that they are automatically serving us due to their status as listed court lawyers. Despite this assurance, we have not received any documents from either court, despite our repeated requests for proper service. We have clearly stated our preference not to receive documents via electronic mail, yet we are being unfairly blamed for their failure to serve us, which has had severe consequences for us, Then, after successfully obtaining the default judgment, they maliciously labeled us, depriving us of further rights. We offered a third-party neutral, and we requested that you either provide one or utilize ours at the earliest opportunity. Kimco’s Cupertino Village Boutique Hotel and John Vidovich’s De Anza Hotel. I AM HERE to Thank Kimco and Mr. Vidovich fordoing the right thing by complying with the city’sefforts to improve the safety of creatures and theimpacts to the quality of life in our community In both cases, the developers agreed to respectand include the city’s newer requirements relatedto the protection of birds and the importance ofminimizing obtrusive and unnecessary lighting. In both of these hotel project ordinances there isthis language : 2. DEVELOPMENT OF THE PROPERTY. TheDevelopment Agreement shall be amended toinclude a new Section 3.4.2.1, which shall read asfollows:: “Developer agrees to comply with the bird safeand dark sky ordinance, Cupertino MunicipalCode Chapter 19.102: Glass and LightingStandards.”
