SUBJECT AND ISSUE
Consider amending the 2006-07 fee schedule to set permit parking fees for the 2006-07 fee
schedule, Resolution No. 06- Q8,L( continued ITom April 4).
BACKGROUND
All user fees are reviewed each year in conjunction with the preparation of the budget. Our goal
is to ensure that, to the extent possible, fees cover the cost of providing services. The majority of
the fees proposed for your consideration are calculated based on actual cost to perform the
service. Some fees, however, are predicated on what the market will bear in relation to what
other competitive entities charge for the same service, for example Sports Center memberships.
City fees were discussed at a public hearing during the April 4th City Council meeting. Staff was
asked to review and bring back the following fees in conjunction with the upcoming building fee
study this September:
~ Tree Removal fee (for removal without a permit for heritage and protected trees),
~ Housing Mitigation fees, and
~ Parking Citation Fees.
In addition, on April 12'h the city received two Petitions for Reconsideration of our new $500
reconsideration fee. We have 60 days to respond to this petition, which is scheduled for the June
6th City Council meeting.
Finally, staff was asked to bring back the permit parking fees for the May 2nd meeting. These
fees represent the staff time involved in processing residential parking permits including billing
the resident, providing stickers for the vehicles and monitoring the permit process. This does not
cover enforcement costs. The fee is $22.50 per year per household and is billed every two years.
This equates to $.06 per day. All 539 households with parking permits have been notified of this
meeting. The total annual revenue ITom this service is about $12,000. For the FY 05106, 319
residents have paid the fee and 220 residents have not.

The Council has several options for this fee:
1. Enforce the current fee under our cost-recovery policy and re-bill the residents who have
not paid;
2. Rescind the fee and refund the residents who have paid. Lost revenue to the city would
be $12,000 per year plus the one-time cost of check processing of $12,760. (Normal cost
to produce a check is estimated at $50, however staff believes that some savings could be
realized through amount and description streamlining.)
3. Impose and enforce the fee for the two-year billing period only (7-1-05 to 6-30-07) and
review the permit parking process for continued merits of the program.
RECOMMENDATION
Staff recommends keeping the permit parking fee for the current two-year period and reviewing
the continued merits of the program before the next billing cycle.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AMENDING RESOLUTION NO. 06-065 TO REFERENCE THE COST FEE
FOR PARKING PERMITS
WHEREAS, the State of California requires fees charged for service rendered not to exceed
the cost of delivering said services; and
WHEREAS, a public hearing has been held to review user fees; and
WHEREAS, the City Council of the City of Cupertino has established guidelines for setting
user fees; and
WHEREAS, on April 4, 2006, City Council adopted Resolution No. 06-065 establishing user
fees; and
WHEREAS, Council requested that the parking permit fee be continued to the May 2
meeting; and
WHEREAS, the City Council members wish to amend the fee schedule resolution to
continue charging for parking permits.
NOW, THEREFORE, BE IT RESOLVED that:
I. Resolution No. 06-065, Schedule A, is hereby amended to include the fee for parking
permits.
2. User fees are effective July 1, 2006.

Maior
Five thousand or more square feet commercial; 10,000 or more square feet office/industrial; eight or more
residential units.
Minor
Less than 5,000 square feet commercial; less than 10,000 square feet office/industrial; less than eight
residential units.
Appeal
A request ITom the project applicant or interested party to reverse or amend a decision made by staff or an
advisory body. An appointed public official serving on the board that made the decision subject to the
appeal, an appointed public official serving on a board that is directly affected by the decision and the City
Council members are exempted from the fee requirement.
Directors Application
An application that receives final approval by staff either via an advertised public hearing or non-hearing
format. The application may involve a pre-application meeting and/or Environmental Review committee
review.
Temporary Silm Permit
A staff review of a temporary sign application that includes an evaluation of the sign request, the entry into
the temporary log and site review by Code Enforcement Officers. The permit fee is in addition to the
submittal of a deposit to guarantee removal of the sign upon expiration of the temporary permit.
Tentative Map
Five or more parcels.
Parcel Map
Four or less parcels.
Housing Mitigation Fee
Fee collected is used to construct new affordable residential units for Cupertino residents and employees.
The fees mitigate the need for affordable units caused by expanding offices creating new jobs and new
residential development, office, R&D, industrial and residential development.
NOTES:
Mixed use applications will be classified based upon the highest intensity and review process.
The Director of Community Development will have discretion to classify projects based upon the above
criteria.

Recreation classes and excursion fees shall be determined as follows:
Classes
I. Determine the maximum hourly rate paid to instructor.
2. Multiply the instructor's hourly rate by the number of class meetings.
3. Determine the minimum number of participants and divide into the instructor's cost.
4. Add indirect overhead percent - 32%.
5. Add 20% to establish non-resident fee.
6. Add cost for specialized equipment or supplies.
Special conditions: For classes taught by contract instructors, the indirect overhead is only
added to the City's percentage.
Excursions
1. Transportation cost divided by the number of participants plus overhead transfer.

Additional factors that mav be used to determine the class or excursion user fee:

Overtime Fee
Functions exceeding the permitted reservation time shall be charged $150.00 for any time up to the first half
hour, and $150.00 for every half hour thereafter. This charge will be deducted from the security deposit.
This applies to all City facilities.

I have lived in my house for 37 years. When I moved in
there was no De Anza College and no Morman Church.
Stelling was a two lane road with no dividers. We had no
parking problems and life was peaceful. Then the Morman
Church came and De Anza College. Life was still pretty
peaceful and present. When the college started to charge
for parking things (peace and quiet) began to change; the
students did not want to pay for parking so they entered
the Mormon church property and parked their cars there.
The church leaders were very amiable and allowed it.
Before long De Anza had so many students they began parking
all up and down Pepper Tree Lane, inconveniencing the
residents. Thus began t.he necessity for ~Permit Parking".
At this time. The Grammar school down the street, Faria
School, was still a neighborhood school. But then the
Lottery system was begun and that caused all the residents
for blocks around to be inconvenienced every time it was
~pick up and drop off" time. These children that attend
Faria are not ~local" children but come from as far as Los
Gatos, Santa Clara and Sunnyvale. Etc; I don't know where
else. This has caused a great deal of stress and
inconvenience to those taxpaying residents who have lived
he~e for many years. My children attended Faria School and
could walk back and forth instead of being driven to and
from school.
I do not think it is fair to ~punish" the people who live
on Pepper Tree Lane particularly and on the surrounding
streets, who did not create the need for restricted parking
nor should we have to pay to park in front of our house on
the street. I am a retiree on a fixed income and I cannot
afford to pay $45 to park my car on the street and I have
the smallest driveway on the street.
I called the proper office when the first notice came out
and could not get in touch with the person named on the
notice; I left my name and telephone number. I called two
times after that leaving my name and telephone number with
the Administrative Assistant and never received a response.
The cars come flying around the corner of Pepper Tree Lane
at 35 miles an hr and are halfway down the street before
they slow down. That is a big safety hazard but ~the law
is never there" when it is happening.
Please reconsider charging to park on the street.

All homes in Cupertino should have equivalent parkine riehts
· It should be recognized that permit parking streets, Muni code 11-27, were
implemented to protect the taxpayer and homeowners from nuisance
parkers.
· Homeowners should not be taxed twice to park in front of their homes.
· City Councll should recognize that we would prefer to eliminate the need to
have Muni Code 11-27 and that those streets do not have "Privilege
Pal'king". The code needs to be rewritten to reflect that the streets under it
were designated to preclude nuisance parking.
· These homes should have the right to have 88 many regular visitors 88 any
other street in the community with out the need to caU the city for
permission. The number of bumper stickers and hangtags should be as
needed by the topayer.
· Any tickets issued should be for violators only Le. there should be a simple
process to cancel tickets issued to vehieles that have a bona fide purpose to
park. (Hold aU tickets for a week and tear those up that a homeowner states
88 having a purpose to park.
· AU ticket fines should go direetIy to the city. We should not offshore the SSS.
· The streets needing this proteetion should be contacted to see if they stiU
need proteetion or need a more stringent enforcement.
· There should be a no cost to homeowner process to replace stolen or
damaged bumper stickers and hangers.
· A heavy fine should be levied for stealing a bumper sticker or hanger.

Due to off-campus parking of De Anza College students, the City of Cupertino
is contemplating, with resident approval, a parking permit program on City
streets as follows:

Parking will be by permit only, Monday through Friday from 8:00 A. M. to
7:30 P. M.
Permits will be issued on a biennial basis at no cost to the residents.
A resident will be allowed a permit for as many registered vehicles as he or
she owns or controls normally parked at that residence.
In addition, a household may obtain up to two residence guest permits, said
permits may be interchangeable among residents.
If signatures are received prior to Seotember IS, 1982, this item will be
placed on the agenda for the City Council meeting on September 20, 1982. If
not, it will be scheduled for the October 4, 1982 City Council meeting.

PERMIT PARKING REGISTRATION
(2006-07)
Enclosed is a Residential Permit Parking Registration form that must be filled out and returned
to the City in order to receive 2006-2007 parking stickers and guest hangers. A permit-parking
sticker will be issued for each vehicle registered to your address. In addition, two guest
hangers will be issued to each household.
Registration forms may be returned by mail or in person. On April 19, 2004, the City Council
adopted Resolution No. 04-291, which approved a $45.00 per household fee for parking
permits. Accepted forms of payment include cash, check, and major credit cards.
