Reso 2753 RESOLUTION NO. 2753 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A REVISED USE PERMIT TO (MANGE THE USE OF A PREVIOUSLY APPROVED BUILDING WHICH IS PART OF A THREE-BUILDING PIECED-USE COMPLEX TO INCLUDE ill A RESTAURANT OF APPROXIMATELY 1,900 SQUARE MEET WITH OUTDOOR DINING SPACE AND A TWO-BEDROOM APARTMENT. CONDITIONS: 1-15 STANDARD CONDITIONS Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerat 1. herein shall apply. 411 16. APPROVED EXHIBITS That the recommendation of approval is based on Exhibits A 1st Revision, B and B-1 of Application 13-U-85 Revised except as may be amended by special conditions enumerated herein. 17. MODIFICATION OF THE APPROVED DEVELOPMENT PLAN In the event that the applicant or subsequent property owner shall desire to make minor e alteration or any Chang amendment in the approved development plan or building permit, a written request and revised development plan or building permit shall be submitt- d to the Director of Planning and Development. If the Director makes a finding that the changes are minor and do not affect the general appearance of the area or the interests of owners of property within or adjoining the development area, the Director may certify the change on the revised plan. If such approval is witheld, the applicant may appeal to the Planning Commission. If the dhanges are material, the Director shall submit said changes to the Planning Commission for approval. If the change is denied by the Planning Commission, the applicant may appeal to the City Council as provided in Ordinance 652 of the City of Cupertino. If the change is approved, an appeal my be made by an interested party. PROPERTY USE CONSTRAINTS The approval is granted to redevelop the existing site to a three - building complex totaling 6,670 square feet, more or less, consisting of 1,180 sq. ft. of Office space, 1,427 sq. ft. of Commercial space in use as a Real Estate center, 1,873 sq. ft. of Commercial space (including approx. 630 sq. ft. of existing basement space) in use as a full-service restaurant with an additional 475 sq. ft. of exterior dining deck area, and three (3) apartment units encompassing 2,190 sq. ft. All new uses or changes in use from those enumerated in this Condition shall require use permit review as determined by the Director of Planning and Development. 26. RESTAURANT USE CONSTRAINTS The restaurant approved under Condition 25 above shall be subject to operation under the following constraints: a) Hours of operation: 6:30 AM to 11:00 PM daily b) Maximum employees per shift: Four (4) c) Total mmaximmn seating capacity: 38 inside; 14 outside d) Liquor sales: Beer and Wine with meal service only; no take-out liquor service or separate bar shall be offered. (Subject to obtaining all appropriate licenses) • 27. Silh PLAN MODIFICATIONS FOR PROPOSED RESTAURANT USE If an exterior service yard is provided, said facility shall be subject to ASAC review at the building permit stage to ensure that the orientation and design thereof minimizes its visibility to adjoining sites and to outdoor living areas of on-site residential units. 28. PARKING The two parking spaces adjacent to Building I shall be covered and designed specifically for use by the studio apartment units.
