FINDINGS AND SUBCONCLUSIONS:
Approval is subject to the findings as set forth on Page 1 and
subconclusions as set forth in the Minutes of the Planning Commission
meeting of January 27, 1986.

1-15. STANDARD CONDITIONS
Standard conditions to the extent that they do not conflict with
special conditions enumerated herein. In the event that a conflict
does exist, the special conditions as enumerated herein shall apply.
16. APPROVED EXHIBITS
• The recommendation of approval is based on Exhibits A-lst Revision,
B-lst Revision and B-i of Application 44-U-85 except as may be
amended by special conditions enumerated herein. Said Exhibits
shall constitute the Definitive Development Plan for the subject
Planned Development as required by Section 4B of Ordinance 618.
17. USES PERMITTED
The approval permits construction of a maximum of six (6) dwellings
and related site improvements to be constructed in a single phase.
Said construction may proceed only upon enactment following final
approval by the City Council of a change of zoning classification
for the subject site to a P (Planned Development ) zone.
18. TREE PROTECTION
The applicant shall provide a plan for preservation of the existing
specimen trees on the subject property which are depicted on Exhibit
A-lst Revision of Application 25-'Ili-85. The plan shall include an
evaluation from a Landscape Architect outlining the effect of
construction activity upon the trees and detailing measures to
ensure their survival in accordance with Ordinance 778.

• 19. FENCING RESTRICTIONS
Opaque fencing materials shall not be permitted on any portion of
any lot which is forward of the front wall plane, in order to
maintain the open ambience of the project's internal courtyard.
Fencing shall not be placed between the garage wall line and the
Stelling Road frontage of Lots 1 and 6.
Prior to issuance of building permits, the City Engineer may require
an evaluation of the existing perimeter fencing and retaining walls,
and may require appropriate repairs thereto to be funded by the
project developer.
20. ARCHITECTURAL MATERIALS
Prior to issuance of building permits, the developer shall obtain
formal ASAC approval of a Precise Development Plan as required by
Section 8.2 of Ordinance 618, which shall include a definitive
exterior material and color palette. The developer shall record a
deed restriction and covenant running with the land informing future
purchasers of the individual lots of the provisions of the Precise
Development Plan.
21. DRIVEWAY PARKING RESTRICTION
The approved site plan shall be modified at the building permit
stage to include appropriate striping and signing to prohibit
• parking within the shared access driveway, except where guest
parking spaces adjacent to said driveway are provided.
22 PRIVATE DRIVEWAY COVENANT
The applicant shall record an appropriate deed restriction and
covenant running with the land subject to the review and approval of
the City Attorney, for all parcels which share a common private
drive or private roadway with one or more other parcels as depicted
on Exhibit A-lst Revision. Said deed restriction shall provide for
the necessary reciprocal ingress/egress easements to and from the
affected parcels. Said easements shall be recorded at such time as
interest in each affected parcel is initially sold or transferred to
another party.
A recorded reciprocal maintenance agreement to be reviewed and
approved by the City Attorney shall also be required for all parcels
which share a common private drive within the project.

23. LANDSCAPE PLAN
111 A definitive landscape planting diagram shall be presented to ASAC
in context with the Precise Development ent Plan referenced in Condition
20 of this Resolution. The landscape plan should address especially
the following issues in particular:
i) Treatment of the Stelling Road frontage area to ensure visual
harmony with the adjoining streetscape, and at the same time
accentuate the project's principal entry point.
ii) Landscape character of the front yards of Lots 1,2,5 and 6
which form the most prominently visible open space within the
project.
iii) Tree cover for privacy screening purposes on the project's
southerly perimeter. Said trees shall be minimum 24" box size
specimens at least eight (8) to ten (10) feet in height above
ground at the time of initial installation. The tree specie
selected to provide said privacy screen shall be of hardy
evergreen variety, and shall be selected in consultation with
adjoining property owners. Canopy shape of said tree selection
shall be such as to allow solar exposure of the rear yards of
Lots 1 and 2.
24. SOLAR
• The applicant shall install plumbing chases in each unit to facilitate
future solar water heating system installation. Installation of said
solar system is optional.
25. SETBACK INCREASE
The setback between any portion of any structure on Lots 1 and 2 and
the southerly property line of said lots shall be increased to twenty
(20) feet.
