Reso 2955 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, CA. 95014 RESOLUTION NO. 2955 (Minute Order) A RESOLUTION OF THE PLANNING COMMIISSION OF THE CITY OF CUPERTINO INTERPRETING SECTION 5.27 OF ORDINANCE 1374 TO DESIGNATE CERTAIN FRONTAGE OF AN EXISTING SINGLE FAMILY ZONED LOT AS A FRONT YARD FOR SETBACK PURPOSES FINDINGS 1) The Planning Commission finds that the southerly boundary of Assessor's Parcel Number 326-17-040, adjacent to Stevens Creek Boulevard, is interpreted to be a corner lot sideyard with a 12 foot setback depth as required under Section 8.3.3 of Ordinance 1374. 2) In accordance with Section 5.27 of Ordinance 1374, the Planning Cammisssion finds that designation of the said lot frontage on Cupertino Road as a front lot line improves the design relationship of the site and improvements thereon to adjoining parcels west and north of the site. Said interpretation will result in full compliance with rear yard setback standards thus minimizing off site privacy impacts. Disturbance to the slope for the Stevens Creek Boulevard frontage will be avoided under the subject interpretation. 3) Designation of front, side and rear yard setback areas Shall be maintained as depicted on Ehibit A of the subject front yard interpretion file.
