002(y) AN ORDINANCE OF THE CITY OF CUPERTINO, AMENDING
ORDINANCE NO. 002 BY ADDING REGULATIONS FOR AD-
MINISTRATIVE AND PROFESSIONAL OFFICES (OA) ZONES
Section THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN
AS FOLLOWS:
1 AMENDMENT
1.1 Ordinance No. 002 of the City of Cupertino is hereby amended
by adding regulations for Administrative and Professional
Office (OA) Zones, as set forth in this Ordinance 002(y).
These regulations replace those in Ordinance 002(w) of the
City of Cupertino, which ordinance was enacted on March
10, 1964, as an urgency measure, and has now expired.
2 INTERIM NATURE OF AMENDMENT
2.1 The entire Zoning Ordinance is being studied and subjected
to public hearings. It is understood that the regulations
contained in this Ordinance 002(y) may be changed when later
made a part of the entire revised Zoning Ordinance for the
City of Cupertino.
3. PURPOSE
3.1 An Administative and Professional Office (OA) Zone is created
to accommodate a demonstrated need for the development of
office space together with necessary landscaping and off-
street parking facilities in locations served by primary
access, yet inappropriate for commercial development because
of close proximity to purely residential uses. It is in-
tended that the professional office uses established in
this zone shall be designed and landscaped so as to be in
harmony with such adjacent residential uses.
4 USES PERMITTED
4.1 No building structure or land shall be used and no building
or structure shall be hereafter erected, structurally altered
or enlarged except for the following uses:
a. Administrative or Executive Offices: Similar to and in-
cluding those pertaining to the management of office
operations or the direction of enterprises but not in-
cluding merchandising or sale services.

Section b. Professional Offices: Such as those pertaining to the
practice of the professions and arts including but not
limited to architecture, dentistry, engineering, law
and medicine, but not including the sale of drugs or
prescriptions except as incidental to the principal
use and where there is no external evidence of such
incidental use.
c. Research Laboratories: Such as those pertaining to
investigation, analysis, or experimentation, to esta-
blish new or revised findings and standards, subject
in addition, in each case, to the securing of a use
permit, as provided by Oridnance No. 002(a) of the
City of Cupertino.
5. DEVELOPMENT STANDARDS
5.1 Height: As regulated by the Height Ordinance No. 220(g)
of the City of Cupertino.*
5.2 Lot Coverage: Buildings within foundation lines not to
exceed forty percent (40%) of lot area.
5.3 Yards: Front yard at least twenty (20) feet, no portion
of which may be used for required off-street parking; side
and rear yards equal to those required in nearest adjacent
residence zone.
5.4 Off-Street Parking: As regulated by the Parking Ordinance
No. 002(q) of the City of Cupertino.**
5.5 Landscaping and Site Layout: As provided in Ordinance 306
of the City of Cupertino.
5.6 Signs: Subject to the provisions in the Sign Ordinance
of the City of Cupertino.
* Provisions in effect February 6, 1967 : Main buildings not
to exceed two (2) stories and thirty (30) feet. Accessory
buildings not to exceed one(1) story and fifteen (15) feet.
** Provisions in effect February 6, 1967: One parking space
measuring 10' x 20' for every 150 sq. ft. of gross floor
area, or one space for every 1.3 employees, whichever is
greater.

Section
6 SEVERABILITY CLAUSE
6.1 If any section, subsection, sentence, clause or phrase of
this ordinance is for any reason held to be unconstitutional,
such decision shall not affect the validity of the remaining
portions of this ordinance. The legislative body hereby
declares that it would have enacted this ordinance and
each section, subsection, sentence, clause or phrase thereof,
irrespective of the fact that any phrases be declared un-
constitutional.
7 PUBLISHING CLAUSE
7.1 The City Clerk is hereby authorized and instructed to cause
a certified copy of this ordinance to be published at least
once within fifteen (15) days after its enactment in the
Cupertino Courier, the official newspaper of the City,
published and circulated within the City.
8 INTRODUCED AND ENACTED
8,1 INTRODUCED at a regular meeting of the City Council of the
City of Cupertino, on the 6th day of February, 1967, and
ENACTED at a regular meeting of the City Council of the
City of Cupertino, this 20th day of February, 1967, by
the following Vote:
AYES: Councilmen Dempster, Fitzgerald, Johnson, Noel,
and Stokes
