Subject
Modification to a previously approved Development Permit and Architectural & Site
Approval for the Westport Development including, but not limited to, dwelling count
and ground floor retail, Park Land Dedication Fees and minor changes to Building 1.

Recommended Action
That the City Council adopt the proposed draft resolutions (Attachment A & B) to: 1.
Adopt the First Addendum to an EIR and approve the Development Permit Amendment
(M-2024-003); and 2. Approve the Architectural and Site Approval Permit (ASA-2024-
003).
Background:
Staff’s responses to questions received from Councilmembers
On May 5, staff received the following questions via email from Vice Mayor Moore
regarding Item #13:
Q1: May we please have the expected revenue estimate for the retail portion if there is no
reduction vs. with reduction proposed.
Staff Response: While the exact type(s) of proposed retail for Westport has not been communicated
to the City, the applicant has indicated a coffee shop/bistro type of business for the 1,000 square-
foot space is anticipated. For comparison, the aggregated annual sales tax for all reporting coffee
establishments in Cupertino was between $85 and $15,799 over the last five fiscal years (2020-
2025).
