Insert after fourth WHEREAS clause on page 4 of the Ordinance:
“WHEREAS, at its May 5, 2025 Board of Trustees meeting, the District’s Board of Trustees
voted to approve the due diligence review of the acquisition of McClellan Terrace, approve the
purchase price of $65.5 million for the property, which sale is expected close in July 2025, and
approve the hiring of expert relocation services to prepare a Relocation Plan for the displacement
of the current McClellan Terrace residents, all creating the urgent need for the City to act to
allow it time to study possible actions to prevent the conversion of multiple-family use housing
to student housing in the area surrounding Foothill-De Anza Community College.”

“I. The City has an immediate and urgent need to act as the District’s Board of Trustees, at its
Board of Trustees meeting on May 5, 2025, voted to approve 1) t he due diligence review of the
acquisition of McClellan Terrace; 2) the purchase price of $65.5 million for the property, which
sale is expected close in July 2025; and 3) t he hiring of expert relocation services to prepare a
Relocation Plan for the displacement of the current McClellan Terrace residents, all creating the
urgent need for the City to act to provide it time to study possible land use or zoning ordinances
and to act to prevent the conversion of multiple-family use housing to student housing in an area
