ACC 3-24-2025 PresentationsACC 3-24-2025 Item No.2 Study Session Presentations City Council Work Program Study Session March 24, 2025 Arts and Culture Commission Subject Study Session to revisit the Municipal Code standards for art in public and private development, including the standards in the Municipal Code and developing an Art‐in‐lieu fee policy What we do The Arts and Culture Commission is a group of citizens appointed by the City Council to foster, encourage and assist in the realization, preservation and advancement of arts and culture for the benefit of the citizens of Cupertino (see Municipal Code 2.80.080 Powers and Functions). •Foster the development of public art in the community •Annual Artist Awards •Review and approve art in private developments, as well as public projects •Enhance the interaction between arts and business •Provide screening and/or review for arts and culture activities wishing to obtain city funds or utilize public facilities •Provide a means for coordination for arts and culture groups or facilities which may exist within the community What we have done •Reviewed and approved required art pieces in private development projects: •The Forum •Alan Row •Westport •Reviewed and approved public art project utilizing in-lieu funding: •Jollyman Park •Reviewed submissions for the City’s 2024 Artist Awards program •Over 250 submissions in 2024 What we have done Mock-up of Kaleidoscope Dreams, approved and to be installed at Westport Artist Awards Ceremony / Art Exhibition to celebrate 2023 winners What we plan to do •Engagement of the Commission in the development process in evaluating uses to revitalize new and existing local public facing commercial uses •Revisit Municipal Code standards for the art in public and private development and developing an Art-in- lieu fee policy •Continue to engage with the community through the Distinguished, Emerging, and Young Artist Award Programs •Explore opportunities for new or expanded art programs in Cupertino City Council Work Program – Quality of Life Revisit Municipal Code standards for art in public and private development, including the standards in the Municipal Code and developing an Art‐in‐lieu fee policy. Discussion ●FY 2024-2025 City Work Program ●Chapter 19.148: Required Artwork in Public and Private Developments ●CC Resolution No. 05-040: Guidelines for Selection of Public Art ●Researched other Jurisdictions ●Art Requirements of Private Development ●Separate Art Fund ●Fund Distribution ●Decision Making Bodies Discussion ●Evaluating the City’s standard in discouraging in-lieu payments for developers. ●Should the City have a separate art fund to receive in-lieu payments, or from any other allocation source (ie General Fund). ●When funds are received, what types of programs or projects should subsidized. ●Which decision-making body should make the ultimate decision on projects, programming, and other use of funds. ●Any other suggestions that can be of interest from the Commission. Prior Meeting (9/23/24) ●In-lieu payment and valuation of art pieces on private development shall be maintained at a consistent valuation of 1%. ●City Council be the decision-making body for in-lieu payment options for developers (maintains status quo). ●The City shall create and maintain a separate art fund. ●A potential use of art funding should be used to develop an arts Master Plan, and other Commission recommendations. Reference Chair Wang’s presentation from August 12, 2024. ●City Council to be the decision-making body, upon recommendation by the Arts and Culture Commission, for the allocation of funds. ●ACC to approve in-lieu payment option. ●Brainstorm during may meeting ideas about how to spend in-lieu fees.
