Application No.: U-2008-02, ASA-2008-07 (EA-2008-08), TR-2008-09 Applicant: Rajeev Chopra (Ebrahim Kaabipour) Location: 10165 N. De Anza Blvd. Use Permit and Architectural and Site approval to demolish an existing gasoline station/car wash and construct a 5-story, 138 room hotel of approximately 82,000 square feet, which will include a restaurant, baz, lounge and conference rooms built over a two-level underground parking podium that contains tandem parkuig; and a Tree Removal request to remove 6 trees and replace with a comprehensive landscape plan o Geologic o Soil and ground water contaminated by leaking gasoline storage tanks to 180 feet o Clean up/treatment efforts will continue for 6 moths, testing of ground water to continue for at least 2 years o Only 1 % of the lot needs treatment o Trees 0 6 protected trees will be removed replaced with 7 36"-box and 6 24"-box trees o The new landscaping plan includes courtyards, water features and screening o Traffic o The main driveway will be off Al~~es Drives o The traffic study indicates that the hotel will generate 8 fewer am trips and 25 fewer pm peak hour trips than the current gas station o The parking study showed that the proposed development would require 156 parking spaces for daytime usage and 178 spaces for nighttime usage. The applicant is proposing 179 parking spaces o "Tandem parking' will be provided by valet service which is anticipated to increase the number of parking spaces by 20% a Additional Discussion o The construction will be Silver LEED certified o Recycling of construction materials o Green Building practices ACTION: Recommendation for a Mitigated Negative Declaration MOTION: Ralph Qualls SECOND: Steve Piasecki NOES: none VOTE: 5-O Application No.: U-2008-01, ASA-2008-06 (EA-2008-07), TM-2008-O1, TR-2008-08 Applicant: Kevin Dare (500 Forbes, LL.C) Location: North Side of Stevens Creek Blvd between Finch Ave 8z Tantau Ave Use Permit and Architectural and Site approval for a master plan of a mixed use development consisting of approximately 150,000 square feet of retail commercial, 100,000 square feet of office, a 150 room hotel, a 160 unit senior (age restricted) housing facility, 145,000 square foot athletic club, a four level parking garage and a 1.6 acre park/town square. (A project alternative consists of approximately 205,000 square feet of office and a 250 room hotel in place of the athletic club); and a Tree Removal request to remove approximately 94 trees in conjunction with a proposed master plan for amixed-use development; and a Tentative Map to subdivide 3 parcels (approximately 18.7 acres) into 5 parcels for a proposed master plan for amixed-use development o Noise o Standard construction practices will be used to mitigate outside street noise (insulation, special windows, store entrances facing away from the street, etc) o Geologic/ Water o No geologic/ soils issues present o No surface or ground water contaminates o Zone B flood plane (100-500 year ;>hallow flood area) o The Sanitary District will require :improvements to the existing storm drain o Trees o Both construction options will have 94 trees removed to be replaced in conformance with the Tree Ordinance guidelines o The dead specimen Oak tree will be replaced by 2 specimen Oak trees o A further review will be done regarding the large Aleppo pine tree in the middle of the proposed development site to see if it is feasible to relocate it or have construction around it o The proposed development will 1-iave all new landscaping, including open spaces, shrubs and native plantings o Air Quality o The air quality study predicts sigiuficant impacts o Mitigation efforts will be in place to improve air quality, but are not expected to reduce the emissions to within tolerable limits o The design of the proposed development will encourage alternate transportation o Traffic o Option A will have 1642 shared perking spaces, Option B will have 1947 shared parking spaces. This exceeds the requirement of the shared parking demand needs per the traffic and parking study o The proposed Sports/Fitness Center will cap its membership, reducing the number parking spaces needed o Finch Road will be updated to include around-about 0 1 VTA bus stop will be relocated o "Walkability" is encouraged by design to help reduce traffic o Option A will generate 13,750 daily trips, Option B will generate 10,700 daily trips o The only intersection impacted in the City is Vallco Parkway Q Wolfe Road. Mitigation efforts will reduce the :impact to less than significant; the significantly impacted intersections are outside the City's jurisdiction. The developer is working with the other agencies to mitigate their concerns o Additional Discussion o No archeological concerns o No wildlife concerns o No hazardous materials found o LEED certified ACTION: As this was a preliminary discussion of the proposed project, no action was taken. A recommendation will be made on this item at the December 4, 2008 meeting OLD BUSINESS None NEW BUSINESS It was decided that the Committee would change it's meeting dates to the 1st and 3rd Thursdays of each month and to change the start time of the meetings to 9:30 am, effective immediately.
