Cupertino City Council Meetine: (Oral Communications) Thoughts and Questions concerning the operations of the Blue Pheasant relating to potential extension of the hours of the operations (Thursday, Friday and Saturday nights): The neighboring community continues to be in support of the Blue Pheasant restaurant business - It is the late hour bar operations/nightclub that is not in harmony with the surrounding community. 1. How can a previous decision (only a few months old) be reconsidered again without any material change in the conditions under which the decision was originally made? a. A lot of time and effort went into finding a 'compromising resolution' and throwing all that away and starting all over again seems like such a waste! Note: The restaurant may technically be closing at Ilpm, however there are still guests around inside and outside with continuous traffic until around lam (Thursday, Friday & Saturday). 2. What are the procedures to be followed by the City with regards to considering a potential extension of the hours of operations in the event the current owner comes forth with such a request? a. Residents will need time to organize and prepare again! b. Summer time is almost here and a lot of residents will be away on vacation. c. Do we need to get new petitions signed or the ones from a few months ago will still be valid to use and do they still have any value for the Council? Format attached. 3. What would be the best approach for the residents to express their concerns and share their views with the Council? 4. What is the definition of the "closing time" for restaurant businesses in Cupertino? a. If services were to stop (such as food and drinks), then where would continuing to have the music played and dancing to continue fall for a bar? Aren't these also considered a part of the services provided? 5. Requesting clarification as to the "Assignment of Lease" document: a. Is the property 'purchased' or 'leased'? - by who? b. What is the connection between the Hungry Jack's Restaurant Corporation and Mike Tsachres? c. If leased, for how long and under what tenus? d. Execution date of 4.7.05, but the public hearings were scheduled for 5/10 & 5/17, 2005? We realize that some of the Council members may be strong supporters of 'maximizing service' and we are hoping that in this particular situation, the dominating concern of tþe Council be more on the side of the quality of life for the neighboring communities who IMve here in Cupertino than those non-neighbors visiting our city few nights a week!
