This letter is to request withdrawal of my appeal of Evershine's request to locate their
office in the former Franze[la Produce site of the Marketplace Shopping Center subject to
their complying with the requirements of the letter sent to them by Director of
Community Development Steve Piasecki dated February 8, 2000. I remain very
concerned about the failure to replace the extensive tree plantings that have been
removed and wilt appeal any further requests from Evershine until this is corrected.

Per your recent meetings and telephone conversations with my staff men)bcr, Colin Jung, we
mutually understand that future new tenancies at the Marketplace Shopping Center located al
19744 Stevens Creek Boulevard, Cupertino require adequate parking supply and vehicular
circulation. We also recognized that portions of the existing parkin, areas have been dcnu,lishcd
and fenced such that parking supply and circulation have been reduced to a Icvcl shat dues nut
meet City zoning standards and that this parking and circulation must be restored bcli)rc new
tenancies are allowed at the shopping center.
It is my understanding that Evershine agrees to restore the parkin` lot to its pre-dcnu,litiun
condition which will include curbing, striping and new landscaping as soon as possible. I hav,:
received your landscape/parking restoration plan ancf Colin lung of my stall' will he rcvicwin~ it
to make sure it is acceptable from the City's standpoint.
The Community Development Department will continue to process any planning and huildin
permits connected to your tenant improvements of the office space, but will nut issue any
occupancy permits until your restoration work has been completed on the parking lot.

I wish to appeal the approval of modification of an existing vacant storefront at 19760
Stevens Creek Boulevazd as requested by'the Evanshine Group. This developer recently
requested City approval of major landscaping changes to their property. Extensive tree
removal occurred many months ago, but there has been no replacements. In one area
where trees were removed there is an unkempt area of destroyed planting surrounded by a
temporary chain link fence. This once beautifully landscaped area now is a blight on the
community. There should be no changes to this property until concrete action is taken to
restore the landscaping.

At the regular meeting of June 1, 1998, the Cupertino City Council granted appeal pursuant to
Planning Commision Res. 4911, with the following modifications noted:

Background: "1'he Planning Commission approved the proposed modification of landscaping
and parking on April 27. "1'he landscaping changes include the removal of 29 trees. The site
will be replanted with 41- 24" box trees. 'Che applicant's objectives include; increasing the
visibility to the exterior of the center, reorganizing the circulation and increasing the parking
supply to accommodate additional expansion.
Discussion: "fhe application was appealed (letter attached) because Councilmember Burnett is
not sure that the removal of several large canopy trees for the purposes of increasing parking is
warranted. Please refer to the attached appeal letter.
Applicant: The applicant revised the plans to address Councilmember Burnett's concerns (plans
enclosed). The revised plans keep the existing Chinese Elm trees in front of Le Boulanger and
replaces the columnar type trees (European Hornbeam) closest to the buildings with open
branching Chinese Pistache trees. 'I'hcrcfore, 26 trees arc proposed to be removed, and they will
have replacements.
Plannine Commission: 'fhe Planning Commission approved the request by a 3-2 vote, with
Commissioner Doyle dissenting because he wanted to maintain the buffer along Stevens Creek
Boulevard and against the buildings. Commissioner Stevens dissented because he preferred
increasing parking in front of McHari's pizza.
Staff: Staff recaumended approval of the need to have the heavy tree canopy coverage removed
in order to significantly increase visibility to the center.

1. Deny the appeal. Sustain the Planning Commission's recommendation.
2. Approve the appeal. If the modified plan addresses Councilmember Burnett's concern,
modify condition #l (Approved Exhibits) by approving plans LI, L2, L3 and L4 dated
revised May 15, 1998. (The revision dates arc located in the upper right corner of each
drawing)
Primary Changes:
• Replace European Hornbeam on "end caps" of parking isles with Chinese
Pistache.
• Retain 3 trees in front of Le Boulanger (Remove 6 proposed parking spaces).
3. Approve the appeal. Deny the application.
4, Determine that the plans require further review by the Planning Commission. Ponvard plan

I wish to appeal the Planning Commission approval of Application 4-ASA-98.
• I oppose the removal of several large canopy trees in a plan that claims a goal of
increasing the tree canopy of the center
Some of the trees arc being removed in order to provide increased parking. I have never,
in years of patronage, seen the parking lot full in that area of the center. The plan was
approved by a 3-2 vote, not the 5-0 vote reported to Council I believe that the destruction
o!f-these b,~e/a~utiful m1atur~e trees would be a tragic mistake.

BACKGROUNll: This property was rezoned in 1961 from residential to commercial. "fhe
conunercial center was constructed just prior to 1978.
llISCUSSION:
Tree Removal: In recent years the center has struggled with dense tree coverage and the lack of
retail business visibility. As a result, the property owner submitted this application Ibr removal of
dense tree canopies blocking the front of businesses and grouped in the parking lot. "There arc 29
trees proposed for removal and 41-24" box trees proposed for replanting. [iightcen of the 29 trees
proposed for removal arc greater than 10" in diameter (sec plan sheet L2).
'1'hc landscape architect describes in his letter (enclosed) that the new tree types arc higher
branching and not as dense as the existing trees. Fle explained to staff that the existing trees grow
as high as 25' with a canopy width of I S. Approximately half of the proposed trees grow
between 10-IS' high with a 10' canopy. 'fhc llcart of the City landscape trcaUnent rceonuncnds
that properties have trees with open branching structures. Approximately half of the trees arc a
furopcan hornbeam, a column shaped, not open branching trcc.'I'hese treys will be located at
• the ends of each parking aisle and help to achieve the goal of increasing visibility to the

increase visibility through the trees. Staff agrees that the existing tree coverage is too dense and
supports a change in the canopy type

"1'he owners of the project site located on the comer of Stevens' Creek Blvd. and Portal
Ave. are looking to update it's parking layout and landscaping as to create a successful and
attractive location. The steps invoh~ed with this proposal are: Removal of specific trees,
add new landscaping areas and to add parking spaces.
"I'he new layout proposed will have minimal etlcct on the area of landscaping. The total
parking count will increase to 510 from 426 stalls. A mixture of compact to standard
dimensions will be used in accordance with the City of Cupertino standards and guidelines.
The removal of specific trees are recommended to increases visibility form the street and

• TREE REPLANTING
The Cupertino City Council granted approval of a landscaping and parking plan at the
existing shopping center at 19744 Steven's Creek Boulevard, Cupertino.
The conditions of that approval required that 90 days following the tree removal that tree
replanting occur. The tree removal has occurred and the 90 days has since past. Please
contact this department next week advising us of the date of replanting. We would expect
that the trees would be planted within thirty days.

• Dear Albert,
Your letter mentions removal of "other" trees due to hazardous conditions, not approved
in application 4-ASA-98 (modification to landscaping and the parking plan). I includr an
application Tor tree removal and the I leritage and Specimen Tree ordinance. Rclcrring to
Section 14.18.170 & 180, the standards for removal indicate that an application must hr
submitted for removal along with information from a Internationally ccrtilicd arhurist
deeming the trees unsafe or diseased. If they arc not unsalc or diseased U~c Planning
Commission must review the removal request.
Regarding your request to extend the replanting date, the Planning Commission allowc~l
90 days following removal for their replacement. It is unclear in your letter how much
additional time is needed. Once this is clarified, we can provide a response. A signilicunt
• amount of additional time, greater than 30 days, may require approval by the Planning
Commission.

Dear Michele,
. The stone pines (in the parking areas) pose hazardous conditions that need to be addressed
immediately. We have scheduled in September the removal of these hazardous trees along with
those approved by the City Council (identified on plan L2-drawings by Reed Associates,
Landscape Architect).
Since the locations of the replanting will be determined only after the completion of the new
parking and new landscaping layouts, we request that the City extend the replanting requirements.
Due to the extensive work (demolition, removal landscaping, curbs, flatwork, asphalt saw cutting
demolition of curbs, sealer, striping, irrigation lines) and the forthcoming rainy weather the new
parking and new landscaping work are scheduled to occur during better weather conditions.

Michael Scott, architect, representing the property owner regarding our letter sent April
15, on the above referenced matter, contacted the city of Cupertino. He indicated that a
conditional use permit application would be filed by Wednesday, April 28, for a
reconfiguration to the center. He indicated that the trees had not been replanted due to
this reconfiguration. The application was not filed. 1 spoke with Mr. Scott during the
week of May 3, and he indicated that the application would be filed by May 26. 1 asked if
the same configuration would be submitted as had been presented and discussed
previously with staff. He said a new configuration was to be presented and that he would
forward to me the new configuration.
The new configuration (dated 5/4/99) has been received and staff has serious concerns
about the proposal. Staff would like a meeting at your earliest convenience to discuss this
matter. Meanwhile, this configuration and other configurations that we have seen do not
affect replanting on the highly visible center portions of the center. Therefore, we expect
that new landscaping will be immediately planted, not including the area directly around
Baxter's and the new pad building. The remaining portions of the center can be planted
following public review on the final configuration. Please call me at your earliest
convenience to set-up an appointment to discuss the recent proposal. We expect the new
planting will be completed within thirty days from this letter.

The existing pines u shown on the attached partial site plan with very low branches are
creating a hazardous condition. We had complaints and even claims from the shoppers
whose cars were damaged from low and falling branches.
