This letter confirms the decision of the Planning Commission, given at the meeting of
September 28, 1998, approving an architectural review of six single family residences in
Neighborhoods 1 and 2 of the Valley Oak Development (former Diocese property),
according to the enclosed copy of the Planning Commission Resolution Nos. 4959, 4960,
4961, 4962, 4963, 4965.
Please be awaze that an appeal of this decision can be made within I4 calendar days of
the decision. If this occurs, you will be notified of the public hearing which will be
scheduled before the City Council.

APPROVING AN ARCHITECTURAL REVIEW OF A NEW 4,256 SQ. FT. RESIDENCE IId UNIT
4 (NEIGHBORHOOD I)
SECTION I: PROJECT DESCRIPTION
Application No.: 18-ASA-98
Applicant: Kelly Gordon Development Corporation
Location: Lot 16, Neighborhood 1, Oak Valley Subdivision (former Diocese property)
SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for an
Architectural and Site Approval, as described in this Resolution; and
WE[EREAS, the Planning Commission finds that the changes are beneficial and compatible with the
surrounding area.
NON, THEREFORE, BE IT RESOLVED:
"That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application no. 18-ASA-98, is here by approved and
"Chat the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the public hearing record concerning Application 18-ASA-98, as set forth in the
Minutes of Planning Commission Meeting of September 28, 1998, and are incorporated by reference
herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COM UNITY DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on site and grading plan sheet 1 dated August, 1998; floor plans A2.1 R and
A2.2R; elevation sheets A4.1 R and A4.2R; and Color Selections Lot 16 chart.
2. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS
7'he Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees,
and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-Jay approval period in which you may protest these fees, dedications,

reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fait to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
