Subj: Report of Director's Decision Regarding a Minor Modification
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor
changes in a project. The Director reports his decision to the City Council and Planning
Commission in time to allow any Councilmember or Planning Commissioner to appeal the
decision within fourteen calendar days.

The O'Brien Group; Oak Valley Development; Unit 4, Lots 2 and 13 (formerly Neighborhood 1)
Description
Director's modification to add a room to the approved model home for the purpose of a sales office.
Discussion
Attached is a site plan for Neighborhood 1 showing the location of the proposed model home/sales
office for the Oak Valley Development. Parking for the model home/sales office is proposed to be
located across the street as shown by the asterisk (*). Currently this development is served by a
temporary sales office, which received a temporary use permit which will expire in six months. The
model home is intended to be a more permanent sales office for eighteen-months duration. Proposed
hours are 10:00 a.m. to 5 :00 p.m., seven days a week. The highlighted conference room on sheet A-2.1
indicates an additional room to the approved home originally granted for this area. It is at the rear of the
house. The intent is to demolish this room once the sales office is no longer needed at this location, at
which time the home will then conform to the approved plans. As shown on this same sheet, the
remaining rooms on the first floor ofthe home will be used to support the sales office.
Action
Director of Community Development approves the minor modification subject to the following
condition:
1. The hours of operation shall not exceed 10:00 a.m. to 5 :00 p.m., seven days a week,
and the modification is valid eighteen months subsequent to this approval.
2. The parking lot shall be paved.
3. The parking lot and bonus room area shall be either restored to a natural state or
reconstructed with new landscaping or approved structures.
4. The sales and support areas shall be converted to garage and living areas upon
expiration of this approval.
