Chapter 19.128 of the Cupertino Municipal Code allows for administrative approval of temporary use permits. The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar days. Application Temporary Use Permit for tours by the public beginning in June, 1999. Temporary use permits are valid for six (6) months. Description The open house tours are conducted Thursdays and Fridays through June and July, between the hours of 10:00 a.m. and 4:00 p.m. and on weekends between June and October between the hours of 10:00 a.m. and 5 :00 p.m. Admission will be charged and net proceeds will be donated to a charitable organization. Parking lots will be located on adjacent lots 10 and 11. Lot 11 is a city-owned lot. Sheet 1 provides a parking layout plan for these lots. As the letter accompanying this application explains, Sunset estimates that the 59 parking stalls provided will be more than sufficient to accommodate the traffic. Staff agrees with their conclusions. Based on the information provided by Sunset, traffic is estimated to be 480 trips per weekend day. This is roughly equivalent to trips generated by 50 residential units, based on 10 trips/day/unit. Since most of the residential units in this development will not be occupied at the time of the tours, the tour trips will not be in excess of anticipated traffic levels. Action The Temporary Use Permit is issued based on the following conditions: 1. Liability for the city-owned lot shall be provided to the satisfaction of the city attorney. 2. Purchasers of any properties on Hammond Way shall be notified of the future open house tours. 3. The parking lots on lots 10 and 11 shall be restored to their natural state, or as needed to accommodate a potential building site. 4. Should the parking lots and street parking not be adequate to serve visitors to the open house tours, additional parking shall be provided across the street in unit 2 and appropriate traffic control shall be provided. 5. The six-month use permit is valid from the onset of construction of the parking lots.
