1. Provide the building envelope. Includes a ten -foot high vertical line from natural grade
measured at both side property lines - with a twenty-five degree roof -line angle projected
inward at the ten -foot high line. See section 19.28.060-G2 for details. Also note
subsection 19.28.060-G2a2b (a gable end of a roof enclosing an attic space may have a
maximum wall height of 17 feet to the peak of the roof as measured from natural grade -
or 20' with a Minor Residential Permit.
2. A majority of your plate heights are 8' and 9' with the exception of the living room with
10' and 11' heights. Staff prefers to keep plate heights at or below 9' (10' okay for

RECOMMENDATION:
Staff recommends the Design Review Committee approve EXC-2008-13, based on the
model resolution.
BACKGROUND:
The project parcel is located along the south side of Greenleaf Drive across the street from
Garden Gate Elementary School (see diagrams below). The applicant is proposing to add
approximately 910 square feet to the existing single story home (approximately 36% floor
area ratio). As part of the project, the applicant is requesting an exception to allow
portions of the addition to encroach into the required front yard setback area due to the
irregular shape of the project parcel (see Sheet A-1 of the site plan).
DISCUSSION:
According to the R1 Ordinance, the front yard setback for a single-family home shall be 20
feet. The intent of this rule is to ensure uniformity of building placement along the street
and that sufficient visual/ landscaping clearance are provided. The project is located on a
triangular lot with only three sides, which makes it difficult to design a home with a
conventional floor plan that is predominant (on rectangular lots) in this neighborhood. In
addition, it is virtually impossible to build a 45% floor area ratio single -story home at the
same time meet the setback requirements prescribed in the Ordinance.

The Design Review Committee has granted previous setback exceptions for lots with
irregular shapes. The existing house is currently setback approximately 13 feet from the
front property line. The applicant is requesting an exception to reduce the front yard
setback to 11 feet. Staff supports the exception for the following reasons:
=> The irregular shape of the parcel precludes the applicant from reasonable use of the
land compared to other similar R1 parcels in the immediate neighborhood.
=> Given the orientation of the project parcel, the proposed setback reduction will not
create any visual impacts or building alignment issues to the neighborhood.
Findings for Exception
Per Section 19.28.110 of the R1 Ordinance, the Design Review Committee may grant an
exception based upon the following findings:
A. Literal Enforcement of the provisions of this chapter will result in restrictions inconsistent with
the spirit and intent of this chapter
The intent of the ordinance is addressed. The lot is not typical in shape, resulting in
unreasonable restrictions that limit the use of the lot.
B. The proposed development will not be injurious to property or improvements in the area, nor
detrimental to the public health, safety, or welfare
The proposed addition is not encroaching further into the side yard setbacks, thereby
eliminating massing impacts onto the adjacent properties.
C. The exception to be granted is one that will require the least modification of the prescribed
design regulation and the minimum variance that will accomplish the purpose
Historically, the majority of the setback exceptions are proposed along portions of a
parcel that is non -conforming in width or shape. The subject lot is triangular in shape,
and the addition displays reasonable measures to decrease the amount of
encroachment into the front yard.
D. The proposed exception will not result in significant visual impact as viewed from abutting
properties
There are no homes directly across the street from the subject site; therefore, the
addition will not result in significant visual impacts from the front.

Staff member Pettis explained that the applicant is requesting the exception due to the
triangular shape of the lot. A portion of the proposed addition would encroach into the front
yard setback. The setback is currently 13 feet. The addition would reduce a portion of the
setback to 11 feet. The overall FAR of the site would be 36%, which is well under the allowed
45% FAR. Staff supports the application. Commissioner Rose asked for clarification on what the
proposed setbacks would be for the addition. Staff member Pettis stated that is would be 11-12
feet from the property line. The applicant clarified that the property line is setback from the
curb already by 13 feet. He further added that all of the neighboring homes are much larger
than what he is proposing. He brought several pictures to demonstrate this visually for the
Committee members. He also had statements from four of his neighbors in support of the
project. Chairperson Giefer asked if a sidewalk dedication would be required with this new
construction. Staff member Pettis said she hadn't checked with Public Works on that
requirement. Staff member Chao said that the Public Works department will require a sidewalk
and a new driveway entrance. It does not need to be added to the Design Review Committee
resolution, as this is a public works requirement, they will ensure that this condition is met or
mitigated. Commissioner Rose agreed that the lot was a challenging one and could understand
why that applicant needed more floor space.
