Staff member Pettis explained that the applicant is requesting a Sign Exception to the Sign Ordinance due to the poor visibility the bank has on Stevens Creek Boulevard. There is a gas station next door and with its signs and landscaping and the traffic on Stevens Creek Boulevard, the bank is easily overlooked. They just received approval for one sign over the main entrance facing De Anza Boulevard. This sign will be 24" high. For conformity, the applicant is requesting that the sign over their secondary entrance on Stevens Creek Boulevard also be 24". The Sign Ordinance allows for only an 18" sign. Staff member Pettis noted that the previous tenant at two signs at this location, however, it appears that the second sign did not have proper I 2 Design Review Committee August 21, 2008 approval. Staff is recommending approval of the application with the condition that the applicant take this time to also install some landscaping improvements along the De Anza side of the building since what exists there is in poor condition. All of the plants around the perimeter of the building are not in good shape. Commissioner Rose asked what was currently planted there and what Staff recommended would be a good replanting choice. Chairperson Giefer asked how many other signs were already at the site. Staff member Pettis explained that the planting strip is very narrow so trees would not be a good option but tall shrubbery or bamboo would work. She said that there are no other signs at the site. Chairperson Giefer asked the applicant how they felt about the additional landscaping requirement. Mr. Kyi Chow-Shar stated that they would need to work out something with the landlord. A resident spoke in favor of the project. Commissioner Rose stated that she is familiar with the shopping center and knows that signage is a problem for the tenants. She supports the project and would like the bank to work with their landlord to come up with a solution to the planting issue. Chairperson Giefer also supports the project. She understands that working with the landlord could be a problem, so does not want to make the replanting of the strip along De Anza conditional as part of the approval. She suggested that if the landlord did not want to participate in replanting, the bank could put in potted plants or topiaries themselves. Sign Exception (EXC-2008-15) request to allow a sign to exceed the number and maximum height limitation at an existing commercial building (Evertrust Bank). RECOMMENDATION: Staff recommends approval of EXC-2008-15, based on the model resolution. BACKGROUND The project site is located at the southwest corner of Stevens Creek Boulevard and De Anza Boulevard east of the Chevron gas station on the corner, (see diagram to the right, project site in blue). Staff has already approved one wall sign facing De Anza Boulevard (east side) that is consistent with the City sign ordinance. The applicant Eva Liu, representing Evertrust Bank, is requesting approval to install a second wall sign, exceeding the Sign Ordinance requirements in sign number and height. DISCUSSION: Sign Exceptions Number of Signs According to the Sign Ordinance Section 17.24.050, each business with exterior frontage shall be permitted one wall sign. A second wall sign may only be permitted under either one of the following circumstances: 1. Business adjacent to more than one street and with no ground sign; or 2. The second sign is directed to the interior of the project and not visible from a public right-of-way. August 21, 2008 EXC-2008-15 2 Wall Signs The additional wall sign would be facing Stevens Creek Boulevard. Staff supports the sign exception request for an additional wall sign based on the following reasons: The intent of the Sign Ordinance is to provide effective and visible signs. The approved existing sign is located on the east side of the building, (see diagram to the right). Due to the existing gas station and trees located on the corner, this sign will not be very visible to vehicles traveling northbound on De Anza Blvd. Therefore, an additional sign facing Stevens Creek Blvd. is warranted. The applicant is proposing a 24 -inch tall wall sign. Staff supports the sign height exception to allow a maximum height of 24 inches because precedence has already been set where the previous tenants, United Commercial Bank, had a wall sign facing Stevens Creek Boulevard that was approximately 24 inches tall. In addition, the proposed height will also be more harmonious with the adjacent sign facing De Anza Blvd., which is 24 inches in height. August 21, 2008 EXC-2008-15 3 Findings for Exception Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant an exception based upon the following findings: A. Literal Enforcement of the Sign Regulations will result in restrictions inconsistent with the spirit and intent of this title. The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of signs as they relate to building design" and to "provide [sign regulations] that will allow for good visibility for the public and the needs of the business ....". The proposed exceptions are necessary to provide effective and visible signs given the project's location and existing structures and trees east of the building. B. The granting of the exception will not result in a condition, which is materially detrimental to the public health, safety, or welfare. The proposed sign does not create any health or safety problems. C. Least modification of the prescribed regulations and the minimum variance that will accomplish the purpose. With the exception of the number and sign height, the proposed sign is consistent with all aspects of the sign ordinance. Other recommendations Staff recommends that the following measures be considered by the Design Review Committee to further enhance the banks surroundings: 1. The applicant shall plant additional shrubs around the perimeter of the structure to enhance the exterior of the existing building. If the Design Review Committee finds merit in the above suggestion, then it should require the revised plans reflect the additional landscaping to be reviewed and approved by the Planning Department prior to issuance of building permits.
