SUBJECT: RESIDENTIAL DESIGN REVIEW ACTION LETTER - Application R-2008-20:
This letter confirms the decision of the Director of Community Development, given on
August 15, 2008; approving a first floor and a new second story addition totaling 1,133
square feet on an existing single story family residence, located at 21837 Terrace Drive,
with the following conditions:
1. APPROVED PROTECT
This approval is based on a plan set entitled, "Ju Residence, 21837 Terrace Drive,
Cupertino, California" consisting of eleven sheets dated "June 4, 2008", except as
may be amended by conditions in this resolution.
2. PRIV ACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future
property owners of the privacy protection measures and tree protection
requirements, consistent with the R-l Ordinance, for all windows with views
into neighboring yards and a sill height that is 5 feet or less from the second story
finished floor. The precise language will be subject to approval by the Director
of Community Development. Proof of recordation must be submitted to the
Community Development Department prior to final occupancy of the residence.
3. CONSULT A TION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/ or agencies
with regard to the proposed project for additional conditions and requirements.
Any misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.

4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (I), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
Please be aware that if this permit is not used within one year, it shall expire on August
15,2009.
Staff received a letter from an adjacent neighbor with questions regarding the approval
process for this project and other concerns. The questions were answered and concerns
were noted.
Staff has made all the findings that are required for approval of a Two-story Residential
Permit as required by the of Cupertino's Municipal Code, Chapter 19.28.100 (D). Also,
please note that an appeal of this decision can be made within 14 calendar days from
the date of this letter. If this happens, you will be notified of a public hearing, which
will be scheduled before the Planning Commission.

At your request, we have completed a geotechnical review of the building permit
application for the proposed residential addition using the following documents:
• Geotechnical Investigation (report), prepared by Acre Soil Engineering, dated
September 20,2007; and
• Architectural Plans (9 sheets, various scales), prepared by IRS Associates, dated
June 4, 2008.
In addition to evaluating the above referenced documents, we have reviewed
pertinent technical documents from our office files and performed a recent site inspection.
DISCUSSION
It is our understanding that the applicant proposes change the design of their
remodel to include a second -story. It appears they will demolish part of the existing
remodeled portion of the house, and construct a second story that spans the new addition
and the original house. Grading quantities have not yet been established, but it appears
unlikely that any significant grading will be necessary for the proposed changes.
SITE CONDITIONS
The project site is characterized, in general, by relatively level valley floor
topography. The parcel is roughly pie shaped, and is bordered to the north and east by
residential property, and by Terrace Drive to the south and west. At the time of our site
inspection the (original) addition appeared to have been in-place, including the portion to
be demolished. The walls were still in the plywood phase of construction. No bedrock was

residence into gutters and discharged onto the ground adjacent to the house. In the area of
remodel, no gutters or drains have yet been installed.
The City Geologic Hazards Map indicates that the site is underlain, at depth, by
bedrock materials of the Santa Clara Formation (i.e., poorly consolidated sandstone,
conglomerate, and potentially expansive claystone). These materials are locally overlain by
alluvial fan and fluvial deposits, residual soil, and possibly artificial fill. The City Geologic
Hazards Map indicates that the building site is located within an "F" zone, which is defined
as "Area of potential fault rupture hazard within 300 feet east and 600 feet west of the Monta Vista
and Berrocal faults". The active San Andreas fault is located approximately 3.6 miles
southwest of the project site and the potentially active Monta Vista fault is mapped
approximately 85 feet southwest of the site.
CONCLUSIONS AND RECOMMENDED ACTION
The proposed development is potentially constrained by expansive surficial soil
materials and the susceptibility of the site to very strong seismic ground shaking. Based
upon our review of the referenced documents, it appears that the Project Geotechnical
Consultant has performed a geotechnical investigation of the project site and provided
design criteria that, in general, appear appropriate for the identified site constraints.
However, we note that the submitted foundation design criteria was for a single -story
addition, whereas, the current application appears to include a two-story addition.
Therefore, we recommend that updated geotechnical design criteria be provided that
reflects the current proposed development. In addition, seismic design criteria should be
updated to reflect the 2007 CBC. Consequently, the following items should be performed
prior to approval of the permit application from a geotechnical standpoint:
1. Updated Geotechnical Design Criteria — The Project Geotechnical Consultant
should submit updated foundation design criteria that are applicable to the
currently proposed two-story addition. Also, seismic design criteria should be
updated to reflect 2007 CBC parameters.
2. Geotechnical Plan Review - The applicant's geotechnical consultant should
review and approve all geotechnical aspects of the development plans (i.e., site
preparation and grading, site drainage improvements and design parameters for
foundations and retaining walls) to ensure that their recommendations have
been properly incorporated.
The results of the Updated Geotechnical Design Criteria and Geotechnical Plan
Review should be summarized and submitted to the City for review by the City

Engineer. The following item should be performed prior to final project
approval:
3. Geotechnical Field Inspection - The geotechnical consultant should inspect, test
(as needed), and approve all geotechnical aspects of the project construction.
The inspections should include, but not necessarily be limited to: site
preparation and grading, site surface and subsurface drainage improvements
and excavations for foundations and retaining walls prior to the placement of
steel and concrete.
The results of these inspections and the as -built conditions of the project should
be described by the geotechnical consultant in a letter and submitted to the
Town Engineer for review prior to final project approval.
LIMITATIONS
This peer review has been performed to provide technical advice to assist the City
with discretionary permit decisions. Our services have been limited to review of the
documents previously identified, and a visual review of the property. Our opinions and
conclusions are made in accordance with generally accepted principles and practices of the
geotechnical profession. This warranty is in lieu of all other warranties, either expressed or
implied.

1. Site plan shows the 30' P.U.E. on the north side. Keep in mind that no structure or
overhang may encroach into this area. There is also a P.U.E. and 5' W.C.E. (wire
clearance) easement on the east side. Please illustrate all easements. The P.U.E. on
the east side is either a 5' or 10' easement. Please submit a copy of the title report with
plan submittals.
2. Please show all existing trees including trunk and canopy diameter and species.
Indicate if being preserved or removed.
3. Second -story additions require a privacy -planting plan, which identifies the location,
species and canopy diameter of existing and proposed trees and shrubs. All windows
on the second floor with sills less than or equal to five feet will require screening. The
area where planting is required is bounded by a thirty -degree angle on each side window
jamb.
4. In addition, applicants for second -story additions must plant a new 24" box tree in the
front setback area as well.
5. Provide at least one building cross section indicating plate heights.
6. Please clarify the footprint/outline of the proposed first and second stories and
especially the roofline (unclear on submitted site plan).
7. The project site is located in the Fault Rupture Geological Hazard Zone. A
Geologic Consultant Deposit fee of $2,500 is required. The applicant may also
hire his or her own geologist to work with the consultant contracted for the City.
The Fault Investigation needs to be conducted by a certified Engineering
Geologist, and a Geotechnical Engineering Investigation needs to be conducted
by a Registered Geotechnical/Civil Engineer, or a combined equivalent of the
above. The Scope of the Geotechnical engineering investigation will be the same
as in "Zone V"; however, the fault investigation should address the seismic
hazards related to the nearby trace of the potentially active fault. Particular
emphasis of the fault investigation should be placed on the evaluation of possible
ground rupture. Investigative techniques within this area will generally require the
use of subsurface trenching and possibly geophysical traverses unless clear
evidence is established to show that no active or potentially active fault crosses
the property in question.

The purpose of the notice board and the story poles is to provide neighbors with a visual tool to
evaluate the proposed construction.
Before your application is ready for a decision, you must provide evidence that the notice board
has been posted and the story poles have been constructed to show the generalized mass and bulk
of the proposed second story. Please note that story poles are only required to show the proposed
second story.

The deadline for the submission of public comments, which shall be at least two weeks
after the date, the notice is posted. PLEASE CALL PLANNER TO CONFIRM THIS
DATE.
Rendering of the front of the house at least 11" x 17" in size.
o Level I (F.A.R. 5 35%) application should post a black and white orthographic.
o Level II (F.A.R. > 35%) application should post a color perspective.
Install Height poles to outline all of the building's second story corners and roof -peak points. The
more complicated the second -story design, the more corners and roof -peak points will be needed.
Install 2' high plastic snow fencing where the roof meets the wall and along roof ridges to meet
peak points. You are trying to show a to -scale, wire -frame model of the second story as it will
look like when constructed.
The story poles must be in place when the noticing period begins. The poles must remain in place
until the end of the appeal deadline or appeal hearing. Poles that are knocked down for any
reason must be re -constructed immediately. Story poles should be removed at the end of the
appeal deadline or appeal hearing.
A licensed contractor must install the story poles. A licensed architect, engineer or contractor must
certify the design and accuracy of the story pole construction. Please refer to Page 3 of this packet
for the certification form.
