Elizabeth, thank you for sending me the package for the proposed new residence at 21885
McClellan Road. I live two address east of this address at 21851 McClellan. My residence is a
flag lot with a partial view of the proposed home from the front of my home and from upstairs
bedrooms.
There are a couple of concerns that I have regarding the review package that I was sent. The
proposed home seems to actually be comprised of two dwelling units on the same parcel and
the F.A.R. seems to be within .0234% of the maximum allowed.
Maybe I am misinformed as to the definition of "Single Family Residence" but how is it that a
single family residence is allowed to have a separate living area (living, dining, full kitchen,
washer/dryer, full bath, bedroom, closet and separate entrance with car port)? It would seem
to turn it into a duplex. Are there any practical means to insure that a current or subsequent
owner does not use the second unit for a non-member of the immediate family and/or as a
rental unit? If I have misread the R1 zoning ordinance, then I assume that I will not have a
problem getting a permit to add another kitchen and separate entry to one of the five
bedroom suites at my residence for an additional family member or guest. Am I correct that if
I or subsequent owners of my property were to use the "guest unit" as income property, say
for some student(s) who might want to go to Monta Vista or Kennedy, that this would be
permitted? Or, if I am correct that this is not allowed, that it would only become a problem it
the city (or school) were to learn that this was happening.
From the drawings you provided it seems that the proposed structure is within 1.45 sq ft of
maximum allowed F.A.R. (assuming there shouldn't be further limits due to tree set backs or
drainage easements). That means there is less than 0.02324% room for error. Is it really
possible for a contractor to build to that tolerance? I guess since the F.A.R. is measured from
outside wall to outside wall, it should be simple to calculate the actual area after the home is
built but might not it be a very expensive problem to resolve if the two units exceed the
maximum F.A.R.?

Today I visited the Site on McClellan Road to inspect the protection fencing for the two trees listed on page A.
1 of the approved piano dated 4/20/09 for this Site at the requeot of Mr. Jeng. I reviewed a detail Sheet
provided to him by the City of Cupertino, the mentioned plan, and the fencing System used.
It io my professional arboricultural opinion that the fencing to protect the "Cedar & 5pruce" as depicted on
page A-1 of the approved plans for 21885 McClellan Road, Cupertino, CA 95014 meet the installation
requirements of on forth in the detail Sheet provided by the City of Cupertino, including the use of mesh wire
installed on the inside of the fence.
Thio letter has been developed according to commonly accepted arboricultural practices and my analysis,
opinions, and conclusions are the result of this process. i further attest that I am 1.5.A. Certified Arborist
#WC -0958 and California Licensed Tree Care Contractor #770742 with current membership in this
International Society of Arboriculture, the Tree Care Industry Association, and the California Arborioto
ASSociation. I have been practicing the art and Science of arboriculture for over Sixteen years.

The purpose of the notice board and the story poles is to provide neighbors with a visual tool to
evaluate the proposed construction.
Before your application is ready for a decision, you must provide evidence that the notice board has
been posted and the story poles have been constructed to show the generalized mass and bulk of the
proposed second story. Please note that story poles are only required to show the proposed second
std.

Story Poles
Install height poles to outline all of the building's second story corners and roof -peak points. The more
complicated the second -story design, the more corners and roof -peak points will be needed. Install 2'
high plastic snow fencing where the roof meets the wall and along roof ridges to meet peak points. You
are trying to show a to -scale, wire -frame model of the second story as it will look like when constructed.
The story poles must be in place when the noticing period begins. The poles must remain in place until
the end of the appeal deadline or appeal hearing. Poles that are knocked down for any reason must be
re -constructed immediately. Story poles should be removed at the end of the appeal deadline or appeal
hearing.
A licensed contractor must install the story poles. A licensed contractor must install the story poles. A
licensed architect, engineer or contractor must certify the design and accuracy of the story pole
construction. Please refer to Page 3 of this packet for the certification form.
