I also appreciated meeting with you, Mario Pinheiro and John Bisely on April 14, 2008 to
discuss the Districts proposal to install a new ~~layground stricture in the play field at Eaton
Elementary School. As you stated the District has requested that a 60'x 40' section in the
corner of the field, adjacent to the blacktop arf;a, as the site for the new playground
structure. The District will assume the total cost for the installation of the equipment, any
future maintenance cost, fu111iability for the play area and the play structure. The District
as stated, will extended to the City the "indemnify and hold harmless clause" as contained
in the original agreement between the District and the City.
The City does not foresee any problem with tl;~e District's request to install the new play
structure at Eaton Elementary School. Your letter and enclosed school field diagram dated
May 8, 2008 will be included in the City / Dis~rict Agreement dated April 15, 1991.
The new site diagram (attached) will replace the original "Agreement Exhibit" for Eaton
Elementary School.

Dear Bob,
I appreciate you meeting with Mario Pinheiro an3 me, at Eaton Elementary School on April 14,
2008, to discuss the proposed new playground equipment and to determine if it is feasible from
the cities perspective. Eaton Elementary has been undergoing explosive student growth within
the last few years and the one existing playground structure is not enough to accommodate all the
children during recess.
It was my understanding from our discussion at the meeting that the location and size of the
equipment play-box (60' x 40') would not be a major concern for the City, and in fact could be
approved without too much difficulty. I was ask~:d to send you this letter requesting this project
be approved and the letter would be attached to t11ie current field use contract the district has with
the City to serve as an amendment etc.
In addition the district desires to make it clear th~:t the total cost for installation of the equipment
and all future maintenance costs of this "reclaime:d" area are to be borne by the district. The
district will also assume the liability for this area and shall extend the, "indemnify and hold
harmless clause" contained the original agreement to the city.
