A RESOIIJTION OF THE CITY' CXJUNCIL OF THE CITY' OF CUPERI'INO
ORDERING VACATION OF A PORI'ION OF THE SOU'IH SIDE OF STEVENS
CREEK ~ WEST OF SI'EVENS CREEK AS PROVIDED IN SECI'ION 8320
EI'SEQ. OF THE S'I'R=1':> AND HIGHWAYS CODE OF '!HE
STATE OF CALIFORNIA
REI'AINING rr AS A FUBLIC UTILITY EASEMENT
WHEREAS, hearing on Resolution of Intention No. 6638 was held on
September 15, 1986 at a regular meeting of the City Council at 10300 Torre
Avenue, CUpertino, California;
WHEREAS, it appears that notice thereof was duly given as required by
law; and
WHEREAS from the evidence presented, both oral and documentary, it
appears to be to the best interest of the City to vacate the hereinafter
described portion of the City street; and that said portion of said City
street is. unnecessary for present or prospective public street purposes
but it necessary to be retained as a public utility easement; and
WHEREAS, existing streets are adequate to handle present and future
projected traffic; and
WHEREAS, vacation is in confonnance with the city's General Plan; and
WHEREAS, abandoned street right-of-way nonnally reverts to the
adjacent property owners.
NCM, 'mEREFORE, BE: rr RESOLVED:
1. That all or any protests against the vacation of said portion of
City street be and hereby are overruled and denied;
2. That said portion of Stevens Creek Boulevard described and shcMn
in Exhibits "A" and "B" attached hereto and made part hereof, be and
hereby is vacated, but is retained as a public utility easement.
3. That the Mayor and the City Clerk are authorized to execute a
quitclaim deed to Gladys Boyer Stocklmeir, Dean Stocklmeir and Alan L.
Stocklmeir, Trustees; subsequent to recordation of the abandonment, with
the provision that said portion shall be retained as a public utility
easement. -

RESOIIJTION NO. 6973
That the city Clerk be hereby is instructed and directed to cause a
certified copy of this resolution, attested to and sealed with the
official seal of the City, to be recorded with the County Recorder of the
County of santa Clara, California, forthwith.

Proposed Abandonment of a Portion
of Stevens Creek Boulevard and
Scenic Boulevard
All that certain real property situate in the City of Cupertino, County of
Santa Clara, State of California, described as follows:
Beginning at a point in the southeasterly right'of way line of Stevens Creek
Boulevard, said point being the most northerly boundary corner of "Lot 30" as
shown upon the map entitled, "Tract No. 5915" as recorded in Book 384 of Maps
at Pages 18 and 19, Records of Santa Clara County;
Thence along the southeasterly right of way line of Stevens Creek Boulevard, as
shown upon said map, S 71° 03' 22" W, 61.51 feet to a point in the south-
easterly right of way line of Scenic Boulevard, as shown upon said map, said
point being the northwesterly boundary corner of said "Lot 30";,
Thence leaving said southeasterly right of way line of Stevens Creek Boulevard,
N 2° 44' 22" E, 28.82 feet to a point in a line delineated upon the Record of
Survey recorded in Book 469 of Maps at Pages 51 through 59, Records of Santa
Clara County, de~ignated as "O.P.L.", said "O.P.L." line being the arc of a
non-tangent curve concentric with and radially distant 41.00 feet southerly
from the "New Centerline" of Stevens Creek Boulevard, as shown upon said Record
of Su rvey;
Thence easterly on said "O.P.L." line, on the arc of a curve to the right, the
radius point of which bears S 18° 51' 38" E, said curve having a radius of
1309.00 feet, through a central angle of 2° 21' 49", for an arc length of 54.00
feet to the northeasterly boundary line of the aforementioned "Tract No. 5915",
a radial at said point bears N 16° 29' 49" W;
Thence leaving said "O.P.L." line, along said northeasterly boundary line,
S 11° 58' 43" E, 25.78 feet to the point of beginning.
Containing 0.035+ Acres.
