A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ADOPTING AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL
PLAN RELATED TO AN INTERCHANGE OF SQUARE FOOTAGE BETWEEN
COMMERCIAL AND OFFICE/INDUSTRIAL USES (5-GPA-97) AND TO GOALS AND
POLICIES FOR URBAN DESIGN AND BUILDING FORM AND SCALE, INCLUDING
HEIGHTS AND SETBACKS (7-GPA-97); ADOPTION OF AN AMENDMENT TO THE
TRANSPORTATION ELEMENT OF THE GENERAL PLAN RELATED TO GOALS AND
POLICIES FOR TRAFFIC LEVEL OF SERVICE, INCLUDING A.M. AND P.M. PEAK
TRAFFIC HOUR (8-GPA-97); ADOPTION OF AN AMENDMENT TO THE
TRANSPORTATION AND LAND USE ELEMENTS OF THE GENERAL PLAN
RELATED TO POLICY 4-3: TIERED TRAFFIC MITIGATION FOR ADDITIONAL
MITIGATED DEVELOPMENT (9~GPA-97)
WHEREAS, the City of Cupertino initiated applications for a General Plan
Amendment as described in this resolution; and
WHEREAS, the necessary public notices were given in accordance with the procedure
ordinance of the City of Cupertino and the City Council has held at least one public hearing
on the matter; and
WHEREAS, the Application No.(s): 5-GPA-97, 7-GPA-97, 8-GPA~97 and 9-GPA~97,
request to amend the general plan land use and transportation elements.
A. 7-GPA-97 (Heights and Setbacks)
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Cupertino that after careful consideration of maps, facts, exhibits, testimony and other
evidence submitted in this matter, the application for General Plan Amendment, Application
No. 7-GPA-97 (Exhibit A, A-I, A-2 and A-3), revising the General Plan, is hereby adopted;
and that the subconclusions upon which the findings and conditions specified in this
resolution are based on and contained in the public hearing record concerning Application
No.: 7-GPA-97, as set forth in the minutes of the City Council Meeting of October 6, 1997,
and are incorporated by reference as though fully set forth herein.

To establish a consistent design relationship between high-intensity nodes and along major corridors, the
following Basic Design Principles shall be applied in the design and review of development proposals in
the Vallco Park and Town Center Activity nodes, and along Major Corridors as identified in Figure 2-D:
1. Vallco Park Focal Point and Activity Center:
To better define the Vallco park area west of Wolfe Road as a High Activity Center, as described in Figure
2- A Urban Design Overlay, a Master Plan shall be developed for each property prior to approval of a
development agreement for the area and/or any building exceeding 45' in height. This Master Plan will
include description of building heights, parking provisions and general landscaping treatments for the area.
Basic Design Principles
a) For buildings up to 60 feet in height, maintain the primary building bulk below a 1.5:1 slope line drawn
from the Stevens Creek Blvd., Homestead Road and Tantau Avenue curb lines and below 1:1 slope line
drawn from Wolfe Road curb line.
b) For buildings over 60 feet in height, maintain the primary building bulk below a 2:1 slope line (i.e., 2
feet of setback for every 1 foot of building height) drawn from the Stevens Creek Blvd., Homestead
Road and Tantau Avenue curb lines and below 1.5:1 slope line drawn from Wolfe Road curb line.
c) Plant tall trees along the 1-280 frontage which will reach a minimum height of 50 ft. at maturity.
d) Avoid parking structures along the Stevens Creek Blvd. frontage.
e) Minimize the height and bulk of parking structures visible from public streets.

a) Maintain the primary building bulk below a 1:1 slope line drawn from the Stevens Creek Blvd. and De
Anza Blvd. curb lines as well as from the Four Seasons Park.
b) Establish building entries and restauranL retail and similar activity-oriented uses along ground floor
frontages facing Stevens Creek Blvd.~ De Anza Blvd. and the Town Center.
c) Construct a Town Center Landmark Design Element at Stevens Creek Blvd. / De Anza Blvd,
intersection. A Landmark may include open space~ landscaping and other design elements at the
comers. The city ma?/reserve a permanent landscape easement as a condition of development at ali
four comers of the intersection to allow the construction ora future landmark and flexibility in design.

GENERAL PLAN AMENDMENT - INTERCHANGE OF SQUARE FOOTAGE BETWEEN
COMMERCIAL AND OFFICE/INDUSTRIAL USES
At the northeast comer of De Anza and Stevens Creek Boulevards, allow the conversion of retail to
office/commercial space, provided there is a substantial retail presence. The maximum height of a
landmark building shall be 75 feet, with a substantial easement for dedication of the comer as a public
gathering .place, provided other elements of the General Plan, including traffic, are satisfied.
