.02 Planning Commission Work ProgramCity of Cupertino 10300 Torre Avenue Cupertino, CA 95014 (408) 777-3308 Fax: (408) 777-3333 C O P E RT I N O Community Development Department Summary Agenda Item No. _ Agenda Date: Tune 23, 2009 APPLICATION: Planning Commission Work Program Summary for 2009-2010 BACKGROUND The Planning Commission recommended additions to their FY 2009-10 work program on May 12, 2009, which is going to be reviewed by the City Council on July 7, 2009. On June 9, 2009, the Planning Commission requested that staff provide an update and address staff resources and schedule for the newly recommended projects. DISCUSSION A matrix describing the proposed Work Program is enclosed (Attachment 1). The list includes projects in the City Council Work Program for 2009-10, projects carried over from 2008-09, and new projects recommended by the Planning Commission. High Priority 1. Green Building Police The Commission assigned the development of a Green Building Policy as a high priority. The Commission recommended that the City should be aggressive in implementing a green program and pursue currently available grants. The Planning Commission also requested that they be included in future public discussions, workshops and hearings on this subject. The Council work program for FY 2009-10 includes reviewing the Phase II Santa Clara County Cities Collaborative and making recommendations to the City Council on a Green Building Program. 2-1 Planning Commission Work Program 2009 June 23, 2009 Page 2 Under the guiding principles of the General Plan (Section 5), the City is committed to reducing its carbon footprint and improving citywide energy and resource efficiency. To that end, a Environmental Affairs Coordinator was hired in December 2008 to assist the City's green initiative efforts. The City is currently focusing on evaluating and auditing existing City infrastructure and facilities. In addition, the Environmental Affairs Coordinator is pursuing several grant and funding opportunities. The following is a summary list of noteworthy projects that have been initiated and/ or will be initiated in the near future: • Collecting and evaluating pre-existing data on residential "Build It Greeri' checklists and solar permit applications • Establishing a City Green Team -Interdepartmental team to help assess, develop and assist green practices/programs throughout various City departments • In the process of putting together the Environmental Stewardship Council (stakeholder group -open to all members of the community) • Pursuing the Energy Efficiency and Conservation Block Grant (EECBG -Department of Energy) -Due June 25, 2009 • Pursing the Alternative Fueled Vehicles Pilot Grant Program (Department of Energy - Clean Cities Program) • Working with SIEMENS (an energy service company) to perform a detailed energy audit for city facilities and grounds (including street light and solar audit) • Working with the International Council for Local Environmental Initiatives (ICLEI - Local Governments for Sustainability USA, Inc.) to create a green house gas inventory soon to be required by the California Air Resources Board- expected completion date of the municipal green house emission inventory is July 2009 • Participating in the Cities Association -Green Buildings Collaborative -Phase II moderate level green building policy framework Medium Priority The Planning Commission has recommended the following programs as medium priority: 2. Lon~q-ferm assessment of the City's lob/Housin~ Balance The City Council is in the process of evaluating the Draft Housing Element of the General Plan which will be forwarded to the Department of Housing and Community Development in June 2009. The final Housing Element is expected to be adopted in the September 2009 time frame. With the adoption of the Housing Element, the City will be 2-2 Planning Commission Work Program 2009 June 23, 2009 Page 3 meeting its Regional Housing Needs Assessment (RHNA) allocation for the current Housing Element period of 2007-2014. The Association of Bay Area Governments (ABAG) which prepares a forecast of growth in the region every two years (called "Projections")has prepared its draft for "Projections 2009" (Attachment 3). Projections forecasts are used when allocating the RHNA for cities and counties. Projections 2009 modeling relies on local general plans in the short term. However for the long-term, it assumes regional goals of achieving targets for reducing greenhouse gas emissions consistent with goals of AB 32 and SB 375. The assumptions include locating growth around transit nodes to a greater extent than previous forecasts. Due to the lack of transit in Cupertino, the City's share of regional growth was reduced in the current RHNA allocation and is not expected to increase significantly in the future. ABAG expects to continue to enhance this long-term outlook for its future Projections modeling and RHNA allocations for the next Housing Element. Due to continuing changes and refinements expected in ABAG's forecasting assumptions, staff recommends monitoring the bi-annual Projections forecasts and the draft RHNA allocations for the next Housing Element period prior to moving forward with General Plan amendments related to housing. 3. Process Improvement Evaluation The City has retained Matrix Consulting Group to conduct an evaluation on Planning, Building and Public Works development application process from initial contact through completion of construction. The final results and recommendations of the evaluation are anticipated to be completed in Summer 2009 and will be provided to the Planning Commission and City Council. 4. Create a Strategic Plan and Incentives for Start-Ups Cupertino is committed to abusiness-friendly environment for commercial tenants. To this end, a new Economic Development Manager position was created two years ago to better facilitate new tenant relationships, market existing space, create brand identity around Cupertino as a place to do business, grow and retain existing tenants, and to serve as a liaison for tenants within Planning and Building. Creating astart-up incentive program hasn't been a focus to date for the following reasons: (1) significant cost; (2) low commercial vacancy and high lease rates; (3) private partnership is required; (4) priorities for funding compete with recruitment efforts targeted for sales tax generating businesses; (5) competition from larger cities such as San Jose. Attachment 3 provides a more detailed explanation. 2-3 Planning Commission Work Program 2009 June 23, 2009 Page 4 Staff therefore recommends the following preliminary steps that could be incorporated within the current work program: • Get more involved in regional efforts such as Bay Area Bio, etc. • Aggressively pursue opportunities to invite businesses that can contribute significantly to City employment and revenues -currently in effect • Track current vacancies and identify opportunities for leasing -currently in effect. A more aggressive alternative would be to conduct research on the best emphasis for Cupertino (i.e. Bio, Clean-tech, Green-tech, Nanotech, etc.). This includes conducting an existing cluster analysis, focus groups, etc. and would require significantly more time and resources. This process is would take at least six months and the cost would depend on the final scope. If the Commission is interested in this project, staff recommends adding it to the work program for next year. Low Priority The Planning Commission has recommended the following programs as low priority. Due to limited staff resources and other projects currently in process, staff will recommend that the Council consider these items for next year's work program: 5. Crossroads Plan/Other Speci c Plans The Commission was interested in looking at other areas of the City that could benefit from along-term approach and a specific plan. One of those included reviewing the Crossroads Plan. Staff recommends scheduling this item after current work program items have been completed. The Crossroads Plan, for instance, could be taken up after completion of the Housing Element and the Heart of the City Specific Plan. Due to the community interest expected on the Crossroads plan, staff expects this project to take approximately 300-400 hours of staff time, about $150,000 in consultant costs and ancillary expenses. Staff expects this process to take about 6-9 months. 6. A{fordable Housing Metliodolo~ The Commission interest in alternative affordable housing measures to better incentivize affordable housing besides the current below market rate program (BMR). Programs to incentivize affordable housing can range from revising the City's BMR program, reviewing fees to creating higher density and funding incentives for 2-4 Plaruling Commission Work Program 2009 Page 5 June 23, 2009 affordable housing. Since this is a low priority, staff recommends that the Council consider this in next year's work program. 7. Review Parking Standards The Commission recommended evaluating the City's parking ordinance to address restaurant versus general retail parking requirements. One of the Commissioners noted that some restaurants have parking problems while some retail centers have many empty parking spaces and recommended a parking study to analyze if the City's parking requirements should be increased for some restaurants and reduced for other commercial uses. Parking requirements are generally derived from extensive studies conducted by the ITE (Institute of Traffic Engineers) and are generally good indicators of average parking requirements for various uses. Some restaurants and retail centers are more successful than others and a parking survey will likely provide an average close to the current zoning ordinance requirements. Additionally, since uses change from time to time it would be difficult to monitor parking on an ongoing basis. The City's process allows for parking studies for projects. Staff recommends using this approach for specific projects if parking impacts are anticipated. Staff Response: Cupertino is committed to abusiness-friendly environment for commercial tenants. To this end, a new Economic Development Manager position was created two years ago to better facilitate new tenant relationships, market existing space, create brand identity around Cupertino as a place to do business, grow and retain existing tenants, and to serve as a liaison for tenants within Planning and Building. While Cupertino has never offered financial incentives, they have always been aggressive in processing permits to ensure timely tenant improvements. The City has in a couple of cases created sales tax sharing agreements with select tenants (which makes sense for tenants generating significant sales tax.) Creating astart-up incentive program hasn't been a focus to date for the following reasons: • Cost is Significant. Communities with successful start-up incentive programs dedicate significant funds. For example; San Jose spent close to $5 million dollars creating a bio-science incubator in the Edenvale Redevelopment Area, and spends over $1 million annually for its incubators in this and its Downtown areas. Most of the operations support goes toward rent. • Commercial Vacancy is Low; Prices High. Cupertino has not had enough vacant office space to justify a full-blown attraction program and it would be difficult to find space to accommodate significant new demand. Furthermore, the delta between market rents and typical start-up rents is vast (double, in most cases.) • Need for Private Partners. Many programs germinate from an aggressive landlord who wants to be a partner with the city, i.e. Carl Berg's deal with SJ for Bio Science Incubator. Cupertino should be ready if this kind of opportunity emerges. • Competing Priorities. Recent emphasis has been on attracting retail and/or sales tax generating tenants. Retail comprises a small and declining percentage of our overall sales tax earnings. Most start-up office tenants will not have products for sale in the near term future. • Competition. It will be hard for a city of our size and finances to compete with other cities. • Precedent. There is some concern about establishing precedents, especially for approaches that involve incentives such as, fee deferrals, etc. • We're already Business-Friendly. Some programs are in response to broken systems (i.e. San Jose's 1- stop permitting/permit in a day) Reasons to Keep in Consideration: • Diversification -grow future tenants, and invest in "gazelles"/new technologies. • Don't just settle for who walks in the door (i.e. health care, etc.) • Track current vacancies -Cupertino Crossings on Tantau is likely leased. Torre Plaza has been renovated and has strong prospects. Bids due today on Symantec's 2 buildings. Preliminar,~ps: • Get more involved in regional efforts such as Bay Area Bio etc. • Research the best emphasis for Cupertino (i.e. Bio, Clean-tech, Green-tech, Nano...) -involve Erin Cooke, do existing cluster analysis, conduct focus groups etc. 2-40
