AN ORDINANCE PROVIDING THAT ALL FRAMING LUMBER SOLD,
USED OR INSTALLED IN ANY BUILDING IN THE CITY OF
CUPERTINO SHALL BE IDENTIFIED BY A GRADE MARK OF,
OR CERTIFICATE OF INSPECTION INSUED BY AN APPROVED
LUMBER GRADING OR INSPECTION BUREAU OR AGENCY.
BE IT ORDAINED BY THE CITY OF CUPERTINO AS FOLLOWS:
Section l: It shall be unlawful for any person, firm or corpora-
tion to sell, deliver, use or install any framing
lumber in any building or structure in the City of
Cupertino which has not been identified by a grade
mark of or certificate of inspection issued by an
approved lumber grading or inspection bureau or agency.
The provisions of this Section shall apply to all
species of lumber set forth in Table No. 25-A of the
Uniform Building Code heretofore adopted by the City
Council of the City of Cupertino or to any similar
table contained in any building code hereafter adopted
by the City of Cupertino.
An approved lumber gr,~,ding or inspection bureau or
agency as used in this Ordinance shall be such a bur-
eau or agency as may ~be recommended for approval by
the City Building Inspector, after investigation made
by him as to the quaT:ifications of such agency, and
approved by the City Council.
Section 2: Any person, firm, corporation, partnership, or
copartnership who wilfully violates any of the pro-
visions, or fails to comply with any of the mandatory
requirements of this ~~rdinance, is guilty of a mis-
demeanor, and upon co:zviction thereof, shall be
punishable by a fine ~~f not to exceed $500.00 or by
imprisonment not to exceed six (6) months, or by both
fine and imprisonment, except that nothing herein
contained shall be deemed to bar any legal, equitable,
or summary remedy to ~rhich the City of Cupertino or
other political subdivision, or any person, firm
corporation, partnership, or copartnership may other-
wise be entitled, and the City of Cupertino or any
other political subdivision, or person, firm, co rpor-
ation, partnership, or copartnership, may file a suit
in the Superior Court of the County of Santa Clara, to
restrain or enjoin an;y attempted or proposed
subdivisions, or acts, in violation of this ordinance.
Section 3: This ordinance shall take effect and be in force
thirty (30) days after its passage, and before the
expiration of fifteen (15) days from and after its
passage, this Ordinance shall be published once with
the names of the members voting for or against the
same in the Cupertino Courier, a newspaper published
in said County of Santa Clara.

Cupertino on the 16th day of February, 1959, by the following
vote:
