AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1 OF
ORDINANCE N0. 2 BY RECLASSIFYING A CERTAIN PORTION OF THE CITY
OF CUPERTINO FROM AN A-2: B-~- DISTRICT TO AN R-1 DISTRICT.
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS
FOLLOWS:
WHEREAS, on April 12, 1959, an application was filed by
Excell & Son, a corporation, for the rezoning of property from
an A-2:B-4 District to an R-1 District, aril
WHEREAS, upon due notice and after two public hearings the
Planning Commission recommended to the City Council that the
reclassification be granted, and
WHEREAS, the property to be rezoned is presently in an
A-2:B-~ District, and
WHEREAS, a map of the subject property is attached hereto
as Exhibit "A" as a proposed amendment to the Master Zoning Map
of the City of Cupertino;
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the following described property be and
hereby is zoned R-1 classification and that Exhibit "A" attached
hereto is made part of the Master Zoning Map of the City of
Cupertino
All that certain real property situate in the City of
Cupertino, County of Santa Clara, State of California, described
as follows:
Beginning at the point of intersection of the Southerly line
of the 7.265 acre tract of la nd conveyed by Willoam Bocksch to
Charles D. Bocksch by Deed dated January 16, 1892 and recorded
January 29, 1892 in Book 1~+3 o f Deeds at page x+92, with the
westerly line of the Saratoga and Sunnyvale Road, which point
is distant North 0° 08' West 387.83 feet and North 0° 08' East
370.8 feet from the intersection of the Westerly line of said
Road with the So~.erly line of the Southwest 1~4 of Section 12,
Township 7 South, Range 2 West; thence along the Southerly line
of said 7.265 acre tract South 890 ~5r West 129-.59 feet to the
Southwesterly corner of said 7.265 acre tract, said Southwesterly
corner of said 7.265 acre tract being in the Westerly line of
the 30.335 acre tract of land conveyed by Charles Bocksch et ux,
to William Bocksch by Deed dated February 20, 1885 and recorded
February 20, 1885 in Book 76 of Deeds at page 511; thence along
the Westerly line of said 30.335 acre tract so conveyed to
William Bocksch, South 0° 08' West 372.00 feet; thence north
8g° ~l' S5" East 855 feet; thence North 0° 08' East 331.23 feet
more or less to a point distant ~-0 feet Southerly from the
aforementioned Southerly line of the 7.265 acre parcel conveyed
to Charles 0. Bocksch; thence along a line p~.rallel with and
distant ~0 feet Southerly measured at right angles to the Southerly
line of that cer~ain 7.265 acre parcel conveyed to Charles 0.
Bocksch North 89 ~+5' East ~-39.5g feet to the Westerly line of
the Saratoga and Sunnyvale Road; thence along said Weste~,y line
of the Saratoga and Sunnyvale Road North 0° 08' East ~I.0.00 feet
to the point of beginning.
Section 2. This Ordinance shall take effect and be in force
thirty 30 days after its passage, and before the expiration of
fifteen (15) days from and after its passage, this Ordinance shall be
published once with the names of the members voting for or against
the same in the Cupertino Courier, a newspaper published in said
County of Santa Clara.
Introduced at a regular meet;ing of the City Council of the
City of Cupertino on the 15th da~~ of June, 1959. Passed and
adopted at a regular meeting of t;he City Council of the City of
Cupertino on the 6th day of July, 1959, by the following vote:
