Ordinance 1674ORDINANC E NO. 1674 AN ORDINANCE OF THE CITY COUr1CIL OF THE CITY OF CUPERTINO AMENDING THE PARK DEDICATIOPI ORDINANCE, SECTION 18-1.602.10 THE CITY COUNCIL OF THE CITY OF Ci1PERTINO DOES HEREBY ORDAIN that the following chapter is amended as follows: CHAPTER 18-1.602.10: Credit for Private Recreation or Open Space Where private open space for pazk and recreational purposes is provided in a proposed subdivision, a fifty percent credit shall b~~ given against the requirement of land dedication or payment of fees in lieu thereof, if the City Council finds that all the following standards aze met... (F) 2. The open space must contain the follovng mandatory elements and at least four of the six optional elements: Elements Mandatory Element Minimum Acreage Turfed playfield .50 the playfield shall be a single unit of land which is generally level and free of physical barriers which would inhibit group play activities Optional Elements Children's play apparatus azea .15 Recreational community gazdens .25 Family picnic area .25 Game court azea .25 Swim pool (42'x75' with adjacent deck and :land azeas) .25 Recreation center building and grounds .15 The combined minimum acreage for a facility with a recreation center and children's play appazatus azea is 1.3 acres. The minimum combined acreage for a facility not including a recreation center or children's play azea is 1.5 acres. Ordinance No. 1674 Page Two The City Council may grant park credit for a combination of the above elements or a combination of the above elements and other recreation improvements that will meet the specific recreation needs of a specialized housing development, such as a senior housing development with occupancy controlled via a covenant with the City named as a third party beneficiary. Before credit is given, the City Council shall adopt written findings that the above standards are met, and shall require the recordation of covenants running with the land to ensure that credited elements are maintained.
