04-101 Hexagon Transportation Consultants~ a~ V-"/ AGREEMENT CITY OF CUPERTINO 10300 Torrc; Avenue Cupertino, C:A 95014 (408) 77'-3200 NO.1/~! °~.~~~ FY 04-05 / BY THIS AGREEMENT made and entered into on the 27th day of September, 2004, by and between the CITY OF CUPERTINO (Hereinafter referred to as CITE') and Hexagon Transportation Consultants, Inc., 40 South Market Street, Suite 600, San Jose, C:A 95113 (hereinafter referred to as CONTRACTOR), in consideration of their mutual covenants, the parties hereto agree as follows: CONTRACTOR shall provide or furnish the following specified services and/or materials: Traffic study for the Stevens Creek Corridor Master Plan per att~~ched Scope of Work. EXHIBITS: The following attached exhibits hereby are made part of this Agreement: Exhibit A: Recommended Scope of Work for the Stevens Cr~aek Corridor Master Plan Traffic Study. Exhibit B: Cost Estimate TERMS: The services and/or materials furnished under this Agreement shall commence on e ~ 27, 2004 and shall be completed before September 2'7, 2006. COMPENSATION: For the full performance of this Agreement, CITY shall pay CON RAC , amount not to exceed $22,428.00 as detailed in Exhibit B, Cost Estimate. ibl.:~;,~' GENERAL TERMS AND CONDITIONS: t Hold Harmless. CONTRACTOR agrees to save anll hold harmless the CITY, its officers, gents, and employees from any and all damage and liability of every nature, including all costs of defe claim, caused by or arising out of the performance of ~:his Agreement. CITY shall not be liable for acts of CONTRACTOR in performing services described herein. Insurance. Should the CITY require evidence of insurability, CONTRACTOR shall file with CITY a Certificate of Insurance before commencing any services under this Agreement. Said Certificate shall be subject to the approval of CITY'S Director of Administr;Btive Services. Non-Discrimination. It is understood and agreed that this Agreement is not a contract of employment in the sense that the relation of master and servant exists between CITY and undersigned. At all times, CONTRACTOR shall be deemed to be an independent contractor and CONTRACTOR is not authorized to bind the CITY to any contracts or other obligations in executing this Agreement. CONTRACTOR certifies that no one who has or will have any financial interest under this Agreement is an officer or employee of CITY. Changes. This Agreement shall not be assigned or transferred without the written consent of the CITY. No changes or variations of any kind are authorized without the written consent of the CITY. MEMORANDUM To: Jana Sokale From: Mike Waller Subject: Recommended Scope of Work for Stevens Creek Corridor Master Plan Traffic Study Date: December 1, 2003 Project Understanding Hexagon understands that the City of Cupertino is in the process of developing a master plan for the parklands that comprise the Stevens Creek Corridor. These parklands include Blackberry Farm Picnic Grounds and Golf Course, McClellan Ranch Park, the Stocklmeir and Simms properties, and a 2.55-acre parcel leased from the Santa Clara Valley Water District. One of the project goals is to ensure that park operations, including visitor traffic, do not significantly affect surrounding residents. 'Che recommended scope of work for this traffic study is designed to evaluate the traffic demand attributable to various elements of the master plan, and to develop mitigating measures to ensure less than significant impacts to the surrounding residents. Task 7: Describe Existing Conditions Hexagon will obtain information concerning visitor dem<<nd to the parklands within the Stevens Creek Corridor, and recent traffic count information for the roadways serving the area. The information will be used to describe in quantitative terms the magnitude of visitor traffic and the background traffic volumes on the streets within the study area. Hexagon will work with the City staff to select a set of roadway segments that will be evaluated in order to represent the existing level of service. Hexagon will also compile information that profiles the demand for parking for each of the current parking areas. Task 2: Trip Generation Study Hexagon will use the visitor demand information to develop trip rates suitable for use in evaluating the projected traffic demand associated with the various elements of the master plan. Trips will be associated with specific uses and parking areas. Traffic related project elements that will be studied include: Blue Pheasant Operations Additional parking on the north end of the park a:.ong Stevens Creek Boulevard and within the existing right-of--way. 40 South Market Street, Suite 600 San Jose, Califixnia 95113 phone 408.971.6100 fax 408.971.6102 • www.hextrans.com Ms. Jana Sokale December 1, 2003 Page 2 of 3 • Bus loading area for school groups at Stevens Creek Boulevard. • Pedestrian Bridge connecting parking lots and tht; school bus loading area to the Stocklmeir property. • The Stocklmeir house will be used as an interpretive center. • A second pedestrian bridge at the south end of th~~ Stocklmeir property to bring the trail across the creek into Blackberry Farm, and to provide pedestrian ~iccess to the snack bar, pools and picnic areas. • The picnic-for-profit operation will cease and all other picnicking will be moved away from the banks of the creek. This picnic facility will be sized to acc~~mmodate groups of no more than 200 people. • The parking lot at the picnic area will be reduced in size. • A second picnic facility will include apole-barn ;structure that will accommodate up to 300 picnickers. • The swimming pools and snack bar will remain. • The Simms property will be used for parking for McClellan Ranch programs. • An environmental classroom will be built at McClellan Ranch. • The 4-H and the community gardens will remain at McClellan Ranch. Task 3: Trip Distribution and Traffic Assignment Hexagon will develop a reasonable distribution of trips to and from the study area, and an assignment of project related trips to the roadways and study intersections within the study area. Task 4: Evaluafe With Project Conditions and the Recommended Mitigation Measures Project related trips will be added to background traffic volumes and the roadway segment traffic volumes and levels of service will be re-evaluated. The results will be compared to the existing roadway segment traffic volumes and levels of service to determine whether there are traffic impacts attributable to the proposed master plan elements. Mitigating measures will be developed that reduced the traffic impacts to less than significant levels for any locations that are determined to be significantly affected ley the proposed project. Task 5: Prepare Draft and Final Traffic Study Reports Hexagon will prepare and submit a draft traffic study report to the City and the consultant team for review and comment. Hexagon will prepare a Final Traffic Study Report that is responsive to all review comments. The traffic report will include comparisons of before and after: Vehicular demand, Parking demand, and Traffic volumes within the Monta Vista neighborhood. The traffic report will also include evaluations and recommendations for: • Bus loading and unloading from Stevens Creek Road, and • Access (auto, bus and trail) to McClellan Ranch and the Simms property from McClellan Road.
