2.80.040 Chairperson.
The Commission shall elect its chairperson and vice-
chairperson from among its members and shall appoint a
secretary. Terms of the chair and vice-chair shall be for
one year and shall be complete on January 15th. Upon
approval of the City Council, the City Manager may appoint
a secretary who need not be a member of the Commission.

2.80.010 Established.
The Fine Arts Commission of the City is established.
The Fine Arts Commission shall consist of seven members,
none of whom shall be officials or employees of the City,
nor cohabit with as defined by law, nor be related by blood
or marriage to any member of the Commission, the City
Manager or the staff person(s) assigned to this Commission.
At least five members shall be City of Cupertino residents.
Members of the Fine Arts Commission shall be appointed
by the City Council. Membership will be drawn to represent
the arts, citizens and business community on an
approximately equal basis. (Ord. 1466, (part), 1988; Ord.

2.80.020 Members-Terms.
A. Commissioners serve at the pleasure of the City
Council. The term of office of the members of the Fine
Arts Commission shall be for four years and shall end on
January 15th of the yeaz their term is due to expire. No
commissioner shall serve more than two consecutive terms,
except that a commissioner may serve more than two
consecutive terms if he or she has been appointed to the
Commission to fill an unexpired term of less than two years.
B. The appointment, reappointment and rules
governing incumbent members of the Commission aze
governed by Resolution No. 7571 of the Cupertino City

2.80.030 Members-Vacancy or Removal.
Any appointee member may be removed by a majority
vote of the City Council. If a vacancy occurs other than by

regular place of meeting and rules of conduct thereof and
shall hold at least one regulaz meeting each month.
B. A majority of the Fine Arts Commission shall
constitute a quorum for the purpose of transacting the

2.80.060 Majority Vote Required.
A majority vote is required to approve a
recommendation on any matter that is presented to the
Commission which requires a vote. (Ord. 1401, (part),

2.80.070 Records Required.
The Commission shall keep an accurate record of its
proceedings and transactions and shall render such reports
to the City Council as may be required. (Ord. 1401, (part),

2.80.080 Powers and unctions.
A. The powers and functions of the Fine Arts
Commission shall be to foster, encourage and assist the
realization, preservation and advancement of fine arts for
the benefit of the citizens of Cupertino.
B. To fulfill their mission, the Commission may
involve itself in the following activities:
1. Act as a catalyst for the promotion of fine arts
activities;
2. Keep current on potential fine arts activities
which would be available to the community;

3. Provide liaison between various fine arts
activities;
4. Provide a means for coordination for fine arts
groups or facilities which may exist within the community;
5. Maintain an inventory of facilities available for
related fine arts activities within the community;
6. Provide screening and/or review for fine arts
activities wishing to obtain city funds or utilize public
facilities;
7. Provide information to the community relating to
the arts;
8. Foster the development of public art within the
community;
9. Be vigilant in exploring and advancing the range
of fine arts activities available to the community;
10. Enhance the interaction between arts and
business;
11. Any other activity which may be deemed

2.80.090 Compensation-Expenses.
Members of the Fine Arts Commission shall serve
withouCcompensation,buc all necessary expenses reasonably
incurred by them while acting in their official capacity shall

2.80.100 Effect.
Nothing in this chapter shall be construed as restricting
or curtailing any powers of the City Council or City

11.28.010 Definitions.
The following words and phrases when used in this
chapter shall have the meanings set forth in this section:
A. "Camp car" means a vehicle with or without
motive power which is designed for human habitation and
which contains plumbing, heating or electrical equipment.
B. "Commercial vehicle" means any vehicle or part
thereof required to be registered under the State of
California Vehicle Code, which is used or maintained for
the transportation of persons for hire, compensation, or
profit, or designed, used or maintained primarily for the
transportation of property, except passenger vehicles and.
house cars.
C. "Mobile home" means a vehicle, other than a
motor vehicle, designed or used as semipermanent housing,
designed for human habitation, for carrying persons ands
property on its own structure and for being drawn by a
motor vehicle, and shall include a trailer coach.
D. "Pazk" means to stand or leave standing any
vehicle, whether occupied or not, otherwise than
temporarily for the purpose of and while actually engaged
in the loading or unloading of passengers or materials.
E. "Public streets" means all streets, lanes, places,
avenues and portions thereof, including extensions in length
and width, which have been dedicated by the owners thereof
to public use, acquired for public use, or in which a public
easement exists.
F. "Truck trailer" means a commercial vehicle
without motive power designed to be drawn by a truck.
G. "Vehicle" means any boat, bus, trailer, motor
home, van, camper (whether or not attached to a pickup or
other vehicle), camp trailer, mobile home, motorcycle,
automobile, truck, pickup, airplane, haul trailer, truck
tractor, truck trailer, utility trailer, or parts thereof, or any
device by which any person or property may be propelled,
moved or drawn upon a public street, excepting a device
moved exclusively by human power. (Ord. 1346, (part),

11.28.020 Vehicle Parking Regulations.
A. Living or Sleeping Quarters. No vehick shall be
used for living or sleeping quarters on any public street.
B. Mobile Homes. Mobile homes, excluding travel
trailers, aze not permitted to be pazked on public streets
within the residential zones of the City.
C. Unmounted Campers. It shall be unlawful for
any person to place, keep or maintain, or permit to be
placed, kept or maintained, any unmounted camper on any
public street.
D. Loading aad Unloading and Utility Vehicles. The
provisions of this chapter shall not apply to active loading or
unloading of any vehicle, or to any public service or utility
company vehicle while in the performance of service or
maintenance work.
E. Construction Trailers. Trailers may be used for
temporary offices on construction projects. A permit must
be obtained from the City Building Department after
satisfactory information has been given that the use is in
compliance with the conditions of this chapter. (Ord. 1346,

11.28.030 Commercial Vehicles.
A. Commercial vehicles having a maaufactiuer's
gross vehicle weight rating often thousand pounds or more
shall not park or stand on any street located within a
residential zoning district.
B. Truck trailers shall not pazk or stand upon any

11.28.040 Constructing, Repairing, or Greasing
Vehicles on Public Streets.
No person shall construct or cause to be constructed,
repair or cause to be repaired, grease or cause to be
greased, any vehicle or any part thereof upon any public
street in the city. Temporary emergency repairs may be
made upon a public street. (Ord. 276, § 4, 1964)
11.28.050 Sale of Merchandise.

It is unlawful for any person or persons to sell
merchandise, fruits, or vegetables from any stationary
mobile equipment on any public street within the city or on
any private land abutting a public street wherein the traffic

11.28.060 Violation-Penalty.
Any person who violates the provisions of this chapter
shall be guilty of an infraction and upon conviction thereof
shall be punished as provided in Chapter 1.12. (Ord. 1179,

11.29.010 Purpose.
The purpose of this chapter is to regulate the pazking
of vehicles which are unsightly or oversized, or which aze
detrimental to the property values or the peace and
enjoyment of neighboring property owners or residents.

11.29.020 Application.
No vehicle may be pazked, stored or kept on any
parcel of land within the city otherwise than in conformance
with this chapter. (Ord. 1345, $ 3, 1986)
11.29.030 Definitions.
As used in this chapter, the following terms shall have
the meanings set forth in this section:
A. "Commercial vehicle" means any vehicle or part
thereof required to be registered under the State of
California Vehicle Code, which is used or maintained for
the transportation of persons for hire, compensation or
profit, or designed, used or maintained primarily for the
transportation of property, except passenger vehicles.
B. "Mobilehome" means a vehicle, other than a
motor vehicle, designed or used as semipermanent housing
for human habitation, for carrying persons and property on
its own structure and for being drawn by a motor vehicle,
including a trailer coach.
C. "Mobilehome pazk" means any azea or tract of
land where lots are sold, rented or held out for rent to one
or more owners orusers ofmobile- homes, excluding travel
trailers, for the purpose of permanent or semipermanent
housing.
D. To "pazk" means to stand or leave standing any
vehicle. whether occupied or not, otherwise than
tempoi~.i~y for the purpose of and while actually engaged
in the loading or unloading of passengers or materials.
E. "Public streets" means all streets, highways,
lanes, places, avenues and portions thereof, including
extensions in length and width, which have been dedicated
by the owners thereof to public use, acquired for public use,
or in which a public easement exists.
F. "Vehicles" means any boat, bus, trailer, motor
home, van, camper (whether or not attached to a pickup or
other vehicle), camp trailer, mobilehome, motorcycle,
automobile, truck, pickup, airplane, haul trailer, truck
tractor, truck trailer or utility trailer, or parts thereof, or
any device by which any person or property may be
propelled, moved or drawn upon apublic street, excepting
a device moved exclusively by human power. (Ord. 1585,

11.29.040 Regulations.
A. Vehicles Permitted in Residential Zones.
1. Front or Street Side Setback Area. Vehicles are
permitted to be placed, kept or pazked in a front or street
side yazd setback area or within twelve feet of a public
right-of--way in a reaz yard azea, subject to the following
restrictions:
a. A maximum of four vehicles is permitted on a lot
in a Rl, RHS, or A1-43 single-family detached residential
zone; a greater number of vehicles may be permitted if they
aze completely enclosed within legal structures, except four
vehicles may be pazked outside a legal structure. In all
other residential zones, the number of vehicles allowed is
approved by the City in conjunction with a development
plan. For purposes of counting vehicles, a camper mounted
on a pickup truck is considered one vehicle, and other
similazly vertically stacked components which belong
together shall be counted as a single vehicle. Horizontal
groupings shall be counted as two vehicles.
b. Any open vehicle containing trash or debris is not
permitted.
c. Any commercial vehicle with a manufacturer's
gross vehicle weight rating of ten thousand pounds or more,
or a total combination of motor truck, truck tractor and/or
trailers that exceeds sixty feet in length is not permitted.
d. No portion of any vehicle may overhang any
public right-of-way.
e. All vehicles must be pazked on an impervious
surface consisting of concrete, asphalt or other like
materials. Such impervious surface may not exceed fifty
percent of the front yazd setback azea, unless a greater area

is approved by the City is conjunction with a development
plan. The impervious surface must be contiguous and, at a
minimum, encompass the outline of the vehicle.
f. All vehicles must be currently registered, where
registration is required for legal operation, and in good
operating condition.
g. Except on lots with circular driveways which
conform to the provisions of this code, all vehicles parked
in the front or street side yazd setback azea must be pazked
perpendicular to the street. On lots with circulaz driveways
which conform to the provisions of this code, all vehicles
parked in the front or street side yard setback area are
limited to less than twenty feet in length. unless pazked
perpendicular to the street. Owners of vehicles made
nonconforming by the adoption of this section shall comply
with this provision within two years of its enactment.
2. Area Outside of Front of Street Side Setback
Area. Vehicles are permitted to be placed, kept or pazked
in any yard azea, excluding those yazd areas regulated by
paragraph (1) of subsection (A) of this section, provided a
three-foot minimum cleazance is maintained to any
structures.
3. Pazking Within Structures. Vehicles are
permitted to be placed, kept or pazked in any legal
structure, provided that no more than one required enclosed
pazking space is occupied by a vehicle not capable of being
propelled under its own power.
4. Non-Self-Propelled Vehicles. A maximum of
two vehicles not capable of being propelled under their own
power is permitted to be placed, kept or pazked outside a
legal structure.
5. Living or Sleeping Quarters. No vehicle shall be
used for living or sleeping quarters, except as permitted
below:
a. Vehicles located in a mobilehome pazk and used
consistent with any City regulations applicable to
mobilehome pazks;
b. Trailers, campers or recreational vehicles maybe
used by a bona fide guest of a City resident for a period not
to exceed seventy-two hours where the trailer, camper or
recreational vehicle is located on such resident's property.
6. Mobilehomes. Mobilehomes, excluding travel
trailers, are not permitted within the residential zones of the
City, except in a mobilehome pazk or as provided by State
law.
7. Construction Trailers. Trailers used for
temporary offices or storage on construction projects may
be allowed only on the prior issuance of a permit by the
City Building Department based upon the receipt of
satisfactory information that the use is in compliance with
the conditions of this chapter.
B. Vehicles Permitted in Nonresidential Zones.
1. Pazking Must be Consistent with Allowed Uses
in Zone. It shall be unlawful for any person to place, keep
or maintain or permit to be placed, kept or maintained any
vehicle upon any lot, piece or parcel of land within the
nonresidential zones of the City, except for storage, sale or
business use as permitted in such zones.
2. Construction Trailers. Trailers used for
temporary offices on construction projects may be allowed
only on the prior issuance of a permit by the City Building
Department based upon the receipt of satisfactory
information that the use is incompliance with the conditions
of this chapter.
C. Loading and Unloading and Utility Vehicles. The
provisions of this chapter shall not apply to active loading or
unloading of any vehicle, or to any public service or utility
company vehicle while in the performance of service or
maintenance work.
D. Pazking on Vacant Lots. No vehicle may be
pazked, kept or stored upon any vacant or unimproved

Any person, firm or corporation violating any
provision of this chapter shall be deemed guilty of an
infraction and upon conviction thereof shall be punished as

19.100.010 Purpose.
The purpose of this chapter is to regulate the pazking
of vehicles which are unsightly, oversized, or which are
detrimental to property values or the peace and enjoyment
of neighboring property owners or residents and establish
regulations pertaining to the design and number ofoff-street
pazking spaces for land use activities located in various
zoning districts. (Ord. 1737, (part), 1996; Ord. 1601, Exh.

19.100.020 Application of Regulations.
A. No vehicle may be pazked, stored or kept on any
parcel of land within the City of Cupertino otherwise than
in conformance with the provisions of this chapter.
B. Buildings, structures and land uses are required
to provide off-street pazking in conformance with this
chapter. The standards and regulations contained in this
chapter regulate off-strcet pazking for conventional zoning
districts and are intended also as guidelines for development
projects located in planned development (P) zones and at
congregate residences and residential Gaze facilities. (Ord.

19.100.030 Regulations for Parking and Keeping
_ Vehicles in Various Zones.
. A. Vehicles Permitted in Residential Zones.
1. Front or Strcet Side Setback Area. Vehicles aze
permitted to be placed, kept or pazked in a front or street
side yazd setback azea (as defined in Chapter 19.08.030 of
this title) or within twelve fcet of a public right-of--way in a
reaz yazd azea in all residential zones subject to the
following restrictions:
a. A maximum of four vehicles are permitted on a
lot in residential zone requiring a lot size of ten thousand
squaze fcet or less, a maximum of six vehicles are permitted
in all other residential zones, unless a greater number is
approved by the City in conjunction with a development
plan. For purposes of counting vehicles, a camper mounted
on a pickup truck is considered one vehicle and other
similazly vertically stacked components which belong
together shall be counted as a single vehicle. Horizontal
groupings shall be counted as two vehicles;
b. Any open vehicle containing trash or debris is
prohibited;
c. No portion of any vehicle may overhang any

d. All vehicles must be pazked on an impervious

or unloading of any vehicle or to any public service or
utility company vehicles while in the performance of service
or maintenance work.
D. Pazking on Vacant Lots. No vehicle may be
pazked, kept, or scared upon say vacant or unimproved
parcel within the City.
E. Other pazking regulations shall be as outlined in
Title 11 of the Municipal Code. (Ord. 1737, (part), 1996;
Ord. 1650, (part), 1994; Ord. 1601, Exh. A (part), 1992)
19.100.040 Regulations for Off-Street Parking.
A. Parking Ratio and Dimension. Table
19.100.040-A defines the required number of pazking
spaces by size and type for specific zoning districts and use
within zoning districts.
B. Aisle Dimensions. Aisle dimension shall be as
required by standazd details adopted by the City Engineer
and shown in Table 19.100.040-B.
C. Loading Areas. Loading azeas, track pazking
spaces, and pazking spaces for vehicles other than
automobiles shall have ample dimensions for the pazticulaz
use and type of operation, and be designed or required by
the City Engincer.
D. Planned Development Districts. The pazking
requirement contained in Table 19.100.040-A functions as
guidelines for projects is planned development zoning
districts. Within such districts, the Planning Commission,
or City Council may appmve a development plan which
deviates from Table 19.100.040-A requirements if an
applicant provides a pazking study which supports said
deviation.
E. Mixed-Use Projects. Where more than one of
the activities specified in Table 19.100.040-A is initiated is
a building or on a site not requiring review by any
committee, commission, or the City Council, the Director
of Community Development shall determine the total
pazking requirement based upon the application of pazking
requirements for individual uses as described in Table
19.100.040-A.
F. Shared Pazking.
1. For proposed land uses which are less than or
equal to five thousand square feet of commercial; ten
thousand square feet of office and eight or less units of
residential, a special pazking study will not be required if all
of the following may be demonstrated:
a. The land use consists of a shopping center, office
or industrial development which is owned or managed by a
single entity;
b. The land uses aze under single management and
in close proximity W each other and are served by a
common pazking facility;
c. The proposed shared parking plan may be
approved in conjunction with a conditional use permit
application in a planned development zone or via an
exception for a project which is not located in a planned
development zone.
d. The pazking provided either mcets or exceeds the
standards for shazed pazking as described in Table
19.100.040-C.
e. The shared pazkiag plan is valid only as long as
the mix of uses and their corresponding square footage (or
seats/employees for restaurants) is the same as originally
approved.
2. For all land uses not meeting the criteria set forth
in subsection Fl of this section, the Planning Commission
or City Council may approve a shared parking plan for a
particular project whereby a pazking space is utilized to
serve two or more individual land uses under the following
conditions:
a. The land use consists of a shopping center, office
or industrial development which is owned or managed by a
single entity;
b. The land use under single management aze in
close proximity to each other and are served by a common
pazking facility;

c. The applicant has submitted a detailed parking
study which demonstrates that the proposed use is
compatible with the proposed pazking supply.
d. The proposed shaze;d parking plan may be
approved in conjunction with a conditional use permit
application in a planned development zone or via an
exception for a project which is not located in a planned
development zone.
G. Tandem, Valet and Other Special Pazking
Arrangements. Tandem, valet, and other special forms of
pazking may be approved is conjunction with a conditional
use permit in a planned development zone or via an
exception for a project not in a planned development zone.
H. Minimum Stall Dimension in Pazking Structure.
The minimum stall dimension for a standazd space locate
in a pazking gazage or other enclosed pazking structure and
intended for nonresidential uses is nine feet by eighteen feet.
The minimum dimensions for a similazly situated compact
space aze eight feet by fifteen feet svt inches.
I. Handicapped Pazking. The handicaPPe Paz~B
requirement embodied in Section 1129 B of the California
Building Code, as amended, is hereby incorporated into this
chapter by reference.
J. Other regulations shall be as outlined in Title 11
of the Municipal Code.
K. Residential Lots Fronting on Public or Private
Streets. If no on-street pazking is available, four
functionally independent off-street spaces in addition to
required covered spaces aze required.
L. Farm Equipment. For tractors or fazm
equipment which aze regulazly parked on-site within two
hundred feet of a public street or road, such pazking places
shall be screened from sight of the street.
M. Lazge-Family Day Caze Home. A minimum of
one pazking space per nonresident employee is required.
This pazking requirement shall be in addition to the:
minimum requirements of the zoning district. The pazking
space may be on-street, in front of the provider's residence.
A minimum of one pazking space shall be available for child
drop-off. The space shall provide direct access to the unit„
not crossing a street.
If the provider is relying on on-street parking and they
roadway prohibits on-street pazking, a semi-circular
driveway may be provided, subject to other provisions o;f
the Municipal Code.
N. Landscape Requirements. All new centers and.
centers with atwenty-five percent or greater increase in
floor area or a twenty-five percent or greater change iri
floor azea resulting from use permit or azchitectural and site
approval within twelve months shall be required to meet the
following minimum landscape requirements; however, the:
Planning Commission and/or City Council may recommend
additional landscaping.
1. Each unenclosed pazking facility shall provide a
minimum of interior landscaping in accordance with the
following table:

2. Pazking lot trees shall be planted or exist at a
ratio of one tree for every five to ten pazking stalls. Only
fifty percent of the trees located along the perimeter of the
pazking azea may count towazels the required number of
trees.
3. When considering the number of trees per
pazking stall, the factors such as size of tree and canopy size
shall be considered. A pazking facility incorporating lazge
trees with high canopies may provide one tree for every ten
spaces whereas a pazking facility with small trees would
provide one tree for every five spaces.
4. All trees shall be protected by curbing or bollazds
as appropriate.
5. All landscape shall be continuously maintained.
O. Bicycle Pazking. Bicycle pazking shall be
provided in multi-family residential developments and in
commercial districts. In commercial districts, bicycle
pazking shall be conveniently located and adjacent to on-site
bicycle circulation pedestrian routes. The bicycle pazking
facilities shall be one of the following three classification
types:
1. Class I Facilities. These facilities aze intended
for long-term pazking and aze intended to protect the entire
bicycle or its individual components and accessories from
theft. The facility also protects the cycle from inclement
weather, including wind driven rain. The three design
alternatives for Class I facilities aze as follows:
a. Bicycle Locker. A fully enclosed space
accessible only by the owner or operator of the bicycle.
Bicycle lockers must be fitted with key locking mechanisms.
b. Restricted Access. Class III bicycle pazking
facilities located within a locked room or locked enclosure
accessible only to the owners and operators of the bicycle.
The maximum capacity of each restricted room shall be ten
bicycles. In multiple family residential developments, a
common locked gazage azea with Class II pazking facilities
shall be deemed restricted access provided the gazage is
accessible only to the residents of the units for whom the
garage is provided.
c. Enclosed Cages. A fully enclosed chain link
enclosure for individual bicycles, where contents aze visible
from the outside, which can be locked by a user provided

lock. This facility may only be used for multiple family
residential uses.
2. Class II Facilities. Intended for short term
pazking. A stationary object which the user can lock the
frame and both wheels with a user provided lock. The
facility shall be designed so that the lock is protected from
physical assault. A Class II facility must accept U-shaped
locks and padlocks. Class II facilities must be within
constant visual range of persons within the adjacent building
or located at street floor level.

19.100.050 Exceptions.
After a public hearing, the Planning Commission
may grant a pazking exception for a project not located in
a planned development zoning district upon making the
following findings:
A. There aze extraordinary conditions not
generally applicable to similaz uses which justify the
exception (i.e., unusually high percentage of the lot azea
is landscaped);
B. The exception departs from the requirements of
this chapter to the minimum degree necessary to allow the
project to proceed;
C. The exception will not adversely affect
neighboring properties by causing unreasonable numbers
of vehicles to park on the neighboring properties or upon
public streets. The decision of the Planning Commission
to grant or deny such an exception may be appealed to the
City Council pursuant to the procedures described in
