PREFACE
The Cupertino Municipal Code, originally published by Book Publishing
Company in 1973, has been kept current by regular supplementation.
During original codification, the ordinances were compiled, edited and
indexed by the editorial staff of Book Publishing Company under the direction
of Mr. David H. Adams, city attorney.
The code is organized by subject matterunder anexpandablethree-factor
decimal numbering system which is designed to facilitate supplementation
without disturbing the numbering of existing provisions. Each section number
designates, in sequence, the numbers of the title, chapter, and section. Thus,
Section 18.12.050 is Section .050, locsated in Chapter .12 of Title 18. In most
instances, sections are numbered by tens (.010, .020, .030, etc.), leaving nine
vacant positions between original sections to accommodate future provisions.
Similarly, chapters and titles are numsbered to provide for internal expansion.
In parentheses following each :section is a legislative history identifying
the specific sources for the provisions of that section. This legislative history is
complemented by an ordinance disposition table, following the text of the code,
listing by number all ordinances, their subjects, and where they appear in the
codification.
Footnotes referring to applicable statutory provisions are located
throughout the text. Asubject-matte:r index, with complete cross-referencing,
locates specific code provisions by individual section numbers.

Appendix A
Rules of Procedure for Conducting Hearing
1. PARTIES. The parties to the proceeding
may consist of any person or persons making a
complaint to the City regarding an alleged public
nuisance being conducted upon or with respect to
any real property or structure thereon within the
City, the owner, occupant or person in charge and
control, mortgagee or beneficiary under any deed
of trust, lessee or any other person having any
estate or interest in said real property or structure,
and the City Manager or his designee.
2. CHIEF PRESIDING OFFICER. The
Mayor of the City is the Chief Presiding Officer
for the hearing. It shall be his or her duty, subject
to being ovemiled by a majority vote of the City
Council, to conduct the hearing and the manner
of the proceedings, to rule on questions of evi-
dence and the relevancy thereof; to maintain
order at the hearing, to interpret and apply these
rules of procedure, and to do all other acts neces-
sary to provide a fair and orderly hearing. In the
absence of the Mayor, the Vice Mayor of the City
Council shall be the Presiding Officer.
3. NEARING CLERK The City Clerk shall
be charged with the taking and keeping of the
records, and shall keep in his or her possession any
exhibits or documents offered as evidence for the
consideration of the City Council. The City Clerk
shall make the necessary arrangement for the tak-
ing of a stenographic record of the testimony
whenever such record is requested by one or more
parties. The requesting party or parties shall pay
the cost of such record.
4. ATTENDANCE AT HEARING. The
Chief Presiding Officer shall have the power to
require the exclusion of any witness or witnesses
during the testimony of other witnesses.
5. OATHS. Before proceeding with the testi-
mony of any witness, the Chief Presiding Officer
shall require witnesses to testify under oath or
affirm to the truth. The oath or affirmation shall
be administered by any duly qualified person.
6. ORDER OF PROCEEDING. A hearing
shall be opened by the Chief Presiding Officer.
The Hearing Clerk shall record in the minutes the
place, time and date of the convening of the hear-
ing; the presence of the members of the City
Council, and the presence of parties and their
respective counsel, if any.
Prior to the presentation of any opening state-
ments or the offering of any evidence, there shall
be entered into the record for said hearing all
exhibits, proofs of service and posting, notices of
public nuisance, orders to repair, demolish or va-
cate, affidavits or other evidence presented to or
filed with the posting, mailing or personal service
of notice of the time and place set for the hearing.
At the beginning of the hearing, the Chief Pre-
siding Officer may ask for statements clarifying
the issues involved.
The City Manager, or his designee, may then
present his claims, proofs and witnesses, and shall
thereafter submit to questions or other examina-
tion bycounsel for the City, by other parties to the
hearing, and by any member of the City Council.
The other parties may then present their claims,
proofs and witnesses, who shall thereafter submit
to questions or other examination by counsel for
the City, by other parties to the hearing, and by
any member of the City Council. Any party shall
be allowed to rebut such defenses and proofs
offered by said other parties. The Chief Presiding
Officer may, in his or her discretion, vary this
procedure, but shall afford both the City Manager
and other parties a full and fair opportunity to
present all material or relevant proofs.
Exhibits, when offered, may be received in evi-
dence and when so received shall be numbered
and made a part of the record of the hearing by
the Hearing Clerk. The Clerk shall also keep as
part of the record a list of names and addresses of
all witnesses.
7. HEARING IN THE ABSENCE OF A
PARTY. The hearing may proceed in the absence

of any party who, after due notice, fails to be
present or fails to obtain any adjournment from
the Chief Presiding Officer.
8. EVIDENCE.
a. Oral evidence shall be taken only on oath or
affirmation.
b. Each party shall have these rights: to call and
examine witnesses; to introduce exhibits; tocross-
examine opposing witnesses on any matter rele-
vant tothe issues, even though that matter was not
covered in the direct examination; to impeach any
witness, regazdless of which party fast called him
to testify; and to rebut the evidence against him.
ff a party does not testify in his own behalf, he may
be called and examined as ifundercross-examina-
tion.
c. The hearing need not be conducted accord-
ing to technical rules relating to evidence and
witnesses. Any relevant evidence shall be admit-
ted if it isthe sort of evidence on which responsible
persons aze accustomed to rely in the conduct of
serious affairs, regardless of the existence of any
common law or statutory rule which might make
improper the admission of such evidence over
other evidence, but shall not be sufficient in itself
to support a finding unless it would be admissible
over objection in civil actions. The rules of privi-
lege shall be effective to the extent that they are
otherwise required by statute to be recognized at
the hearing, and irrelevant and unduly repetitious
evidence shall be excluded.
9. CLOSING OF HEARING. The Chief Pre-
siding Officer shall inquire of all parties whether
they have any further proofs to offer or witnesses
to be heazd. Upon receiving negative replies, the
Chief Presiding Officer may allow argument by
counsel or a party to the proceeding regazding the
evidence.
After the conclusion of such azgument, the
hearing shall be closed and a minute thereof shall
be recorded. The matter shall then be taken under
submission, and the City Council shall thereafter
announce its decision.

If the passenger is a minor weighing forty pounds
or less, the seat shall have adequate provision for
retaining the minor in place and for protecting the
minor from the moving parts of the bicycle. (Ord.

11.08.220 Carrying articles.
No person operating a bicycle shall carry any
package, bundle or article which prevents the op-
erator from keeping at least one hand upon the
handlebars. (Ord. 1420 (part), 1987)
any street in the city indicating the existence of a
bicycle lane, and otherwise regulating the location
and use of vehicles and bicycles with respect to
them, so long as the same are consistent with this
chapter. Before such a sign is erected, the subject
bicycle lane shall be designated on such streets by
an approved painting or sign, or in such other
manner as the City Manager shall determine will
provide sufficient notice of the existence of such
bicycle lane. When such a painting or sign is in
place, no person shall disobey it.
11.08.230 Motor vehicles and motorized
bicycles in bicycle lanes.
A. Whenever a bicycle lane has been estab-
lished on a roadway pursuant to Section 21207 of
the California Vehicle Code, any person operat-
ing amotor vehicle on such roadway shall not drive
in the bicycle lane except to park where parking is
permitted, to enter or leave the highway, or to
prepare for a turn.
B. This section does not prohibit the use of a
motorized bicycle in a bicycle lane pursuant to
Section 21207.5 of the California Vehicle Code;
provided, that no person shall operate amotor-
izedbicycle upon a bicycle lane at a speed greater
than is reasonable or prudent having due regard
for visibility and the traffic on, and the surface of,
the bicycle lane, and in no event in a mannerwhich
endangers the safety of bicyclists utilizing the bi-

11.08.240 Impoundment.
The City may impound and retain possession of
any bicycle in violation of the provisions of this
chapter, and may retain possession of such bicycle
until the provisions of this chapter are complied
with. In addition, a fine may be imposed for any
violation of this chapter pursuant to Section

11.08.260 Bicycle route-Designated.
The City Manager, upon approval of the City

any street in the City indicating the existence of a
bicycle route, and otherwise regulating the loca-
tion and use of vehicles and bicycles with respect
to them, so long as the same aze consistent with
this chapter. Before such a sign is erected, the

ner as the City Manager determines will provide
sufficient notice of the existence of such bicycle

Any person who violates any of the provisions
of this chapter is guilty of an infraction, and, upon
conviction thereof, shall be punished as provided
in Chapter 1.12 of this code, except that no fine
imposed for violation of any licensing and regis-

Any person whose application for a permit is
denied may appeal such decision to the City Coun-
cil by filing a written notice of appeal within ten
days after notification by the Chief of Police that

of fifty dollars for the first offense and one hun-

11.12.010 Purpose.
It is the express purpose of the ordinance cod-
ified in this chapter to consolidate in one ordi-
nance all speed limits established pursuant to au-
thority contained in the California Vehicle Code
Sections 22357 and 22358, upon streets or high-
wayspresently orhereafterwithin the City Limits,
and to provide a means for incorporating therein
all the speed limits that may hereafter be so estab-
lished. (Ord. 490 § 1,1971)
11.12.020 Definition.
Pursuant to authority contained in the Califor-
nia Vehicle Code, it is determined upon the basis
of an engineering and traffic survey that a speed
greater or lesser than that permitted by state law
as applicable upon the following streets would
facilitate the orderly movement of vehicular traf-
fic and would be reasonable and safe under the
conditions found to exist upon such streets, and it
is declared that the prima facie speed limit shall
be as hereinafter set forth on those streets or parts
of streets herein designated when signs are
erected giving notice thereof. (Ord. 490 § 2,1971)

The prima facie speed limits on certain streets
or highways, situated within the City of Cupertino,
State of California shall be as set forth in Table

11.24.120 Prohibited in parkways.
No person shall stop, stand, or park a vehicle
within any pazkway. (Ord. 843 § 5,1977)
11.24.130 Prohibited for more than
seventy-two hours.
No person who owns or has in his possession,
custody, or control any vehicle or trailer shall park
such vehicle or trailer upon any public street or
alley for more than a consecutive period of sev-
enty-two hours. (Ord. 843 § 6,1977)
11.24.140 Parking for purposes of display,
servicing, or repairing.
A. No person shall park a vehicle upon any
roadway or on any private property or private
roadway without the express written permission of
the owner of such property, for the principal pur-
pose of:
1. Displaying such vehicle for sale; or
2. Servicing or repairing such vehicle, except
when necessitated by an emergency.
B. Violation of this provision shall constitute
an infraction, and shall subject the registered
owner of such vehicle to the penalties as pre-
scribed by Chapter 1.12 of the Cupertino Munici-
pa1Code. Each day the violation continues consti-
tutes anew offense. This section shall not
constitute the exclusive means of enforcement of
vehicles or parts thereof which have been stored,
pazked,placed, or abandoned on public or private
roadways and private property within the City

streets.
No person shall stop, stand, or pazk any vehicle
as defined in the Vehicle Code of California on
