During original codification, th~~ ordinances were compiled, edited and indexed by the editorial staff of Book Publishing Company under the direction of Mr. David H. Adams, city attorney. The code is organized by subject matter under an expandable three-factor decimal numbering system which is designed to facilitate supplementation without disturbing the numbering of existing provisions. Each section number designates, in sequence, the number:; of the title, chapter, and section. Thus, Section 18.12.050 is Section .050, located in Chapter .12 of Title 18. In most instances, sections are numbered by tens (.010, .020, .030, etc.), leaving nine vacant positions between original sections to accommodate future provisions. Similarly, chapters and titles are numbered to provide for internal expansion. In parentheses following each section is a legislative history identifying the specific sources for the provisions of that section. This legislative history is complemented by an ordinance dispo:iition table, following the text of the code, listing by number all ordinances, their subjects, and where they appear in the codification. Footnotes referring to applicable statutory provisions are located throughout the text. Asubject-matter index, with complete cross-referencing, locates specific code provisions by individual section numbers. The Environmental Review Committee (ERC) of the City is established. ERC shall consist of one City Council person, one Planning Commissioner, the City Manager, the Director of Public Works and the Director of Community Development or their designated alternates. (Ord. 1535 (part), 1990) 2.84.020 Terms of office. The terms of staff members are ongoing unless changed by action of the City Council. The term of the City Council person and Planning Commis- sioner shall be reviewed periodically by the City Council and Planning Commission respectively for reappointment or a new appointment. Be- cause this Committee is composed of staff and members of other bodies it is not directly governed by Resolution Number 7571 of the Cupertino City Council. (Ord. 1535 (part), 1990) 2.84.030 Chairperson. The Committee shall elect its chairperson and vice-chairperson from among its members and shall appoint a secretary. The secretary need not 2.84.040 Meetings-Quorum. A. The Environmental Review Committee shall establish a regular time and place of meeting and rules of conduct thereof and shall hold at least two regular meetings each month. B. A majority of the Environmental Review Committee shall constitute a quorum for the pur- pose oftransactingthe business of the Committee. (Ord. 1535 (part), 1990) 2.84.050 Compensation-Expenses. Members shall serve on the Environmental Re- view Committee without compensation but all necessary expenses reasonably incurred by them while acting in their official capacity shall be paid following appropriate action by the City Council. (Ord. 1535 (part), 1990) 2.84.060 Majority vote required. A majority vote of the quorum is required to approve a recommendation on any matter that is presented to the Committee which requires a vote. (Ord. 1535 (part), 1990) 2.84.070 Records. The Committee shall keep an accurate record of its proceedings and transactions and shall render such reports to the City Council and Plan- ning Commission as may be required. (Ord. 1535 (part), 1990) 2.84.080 Duties-Powers-Responsibilities. A. All discretionary projects which are not cat- egorically exempt or otherwise exempted from further environmental assessment, shall be for- warded to the Environmental Review Committee for evaluation under the California Environmen- tal Quality Act. B. The Committee shall evaluate the initial study of a proposed project to determine whether ','0-3 tcu~~c~,o i-9i> 2.84.080 the project may or may not have a significant effect on the environment. C. If a determination is made that the project will not have a significant impact on the environ- ment, the Committee will recommend that the final reviewing authority (decisionmaker) grant a negative declaration. D. If a determination is made that the project may have a significant impact on the environment, the Committee shall require preparation of an environmental impact report (EIR). The major areas of concern, the selection of the preparer and the preparation of the EIR shall be coordinated by the ERC not including the City Council and Planning Commission members. (Ord. 1535 (part), 1990) 2.84.090 Guidelines-CEQA. California Environmental Quality Act guide- lines promulgated by the California Secretary of Resources and as subsequently amended are adopted by this reference. (Ord. 1535 (part), 1990) 2.84.100 Appeals. The project sponsor may appeal a decision to prepare an EIR to the City Council. The appeal shall be filed in writing with the City Clerk within five working days of the Committee's decision. If the City Council determines that an EIR is not necessary, the project shall be returned to the ERC for further consideration. (Ord. 1535 (part), 1990) 2.84.110 Fees. The City Council may, by resolution, establish an environmental assessment fee. (Ord. 1535 (part), 1990) 2.84.120 Effect. Nothing in this chapter shall be construed as restricting or curtailing any powers of the City Council, Planning Commission or City officers. (Ord. 1535 (part), 1990) tcu~~o i-9i> 70-4 10.26.080 calendar year as the first, a service charge shall be assessed against the owner for every such subse- quent false alarm occurring within that calendar year. In the event that the owner of the alarm system is not also the responsible occupant of the prem- ises wherein such alarm system is installed, then the responsible occupant shall, upon receipt of notice immediately: A. Inform the owner of the alarm system and cause the notice to be delivered to the owner; and B. Notify the Code Enforcement Officer of the identity of the owner of the alarm and that the notice has been delivered to the owner. In the event of failure of the responsible occu- pant, when not the owner, to comply with the above notification procedure, then the responsi- ble occupant shall bear the responsibility of the owner of the alarm as provided in this chapter. (Ord. 1207 § 3(part),1982: Ord. 953 (part), 1979) tice shall describe the date and time of the alleged false alarm, and whether police personnel re- sponded thereto. Said notice shall also request payment of the assessment charge within thirty days from the date of the notice and shall indicate the existence and terms of the hearing provisions contained in this chapter. (Ord. 1526 (part), 1990: Ord. 953 (part), 1979) 10.26.110 Payment and hearing. On or before thirty days following issuance of the notice of assessment described in Section 10.26.100, the recipient of such notice shall cause to be remitted to the office of the City Treasurer the full amount of such service charge. The service charge shall be considered delinquent fifteen days after the date to request a hearing before the City Manager or City Council, as the case may be, has expired. (Ord. 1526 (part), 1990: Ord. 953 (part), 1979) 10.26.090 False alarm service charge. There is imposed a service charge upon every owner who reports, causes to be or permits to be reported a false alarm as defined in this chapter. Said service charge shall be according to a sched- ule adopted by the City Manager to reflect the total cost of administering the police response and collection costs for a false alarm. Said charges shall bear interest at the legal rate from the date thirty days following the giving of notice, as pro- vided in Section 10.26.080. (Ord. 1526 (part), 1990: Ord. 1207 § 3 (part), 1982: Ord. 953 (part), 1979) 10.26.100 Assessment of service charge. The City Manager is empowered and author- ized todesignate such person or persons who shall enforce the provisions of this chapter. Upon re- ceipt by said enforcement officer of a report of a false alarm originating from premises to which was sent a notice as described in Section 10.26.080, he shall cause to be served a notice of assessment of the above-described service charge, which no- 10.26.120 Bearing procedure. A. Hearing Before the City Manager. Any per- son dissatisfied with the assessment may file a written request with the City Manager, within ten days from the date of the notice, for a hearing regarding the investigation and determination of the assessment. Upon receipt of a request for a hearing, a hearing shall be scheduled before the City Manager or his or her designee within fifteen days from receipt of the request. The City Man- ager shall cause notice of the hearing date, place and time to be mailed to the person requesting the hearing. At the hearing, evidence shall be heard informally and written findings of fact shall be made by the City Manager or his or her designee. The City Manager shall then notify the person who requested the hearing of the written findings to- gether with a recommendation that the assess- mentcharge besetaside orconfirmed inwhole or in part. In the event that it is recommended that the assessment charge be confirmed in whole or in part, the notice shall request payment within fifteen days of the date of the notice and shall L:57 (C~pertino 1-91) 10.26.120 indicate the existence of an procedure for appeal- ing the City Manager's recommendation to the City Council. B. Hearing Before the City Council. Any per- son dissatisfied at the City Manager's recommen- dation toset aside or confirm the assessment may, within fifteen days from the date of notification of the City Manager's recommendation, file with the City Clerk a written request for a hearing before the City Council. A public hearing shall be sched- uled within thirty days of the date of the filing of the request for a City Council hearing. Notice of the time and place of the hearing shall be given not less than ten days prior to the hearing to the party requesting the hearing. The City Council shall hold a hearing and upon consideration of the City Manager's findings, recommendation and such other evidence as it deems relevant, set aside or confirm the assessment in whole or in part. (Ord. 1526 (part),1990: Ord. 953 (part), 1979) 10.26.130 Failure to request hearing. In the event that any person to whom a notice as described in Section 10.26.100 was mailed fails to either to remit the full amount of the assess- ment or torequest ahearing onsuch matter within the time allowed, the City Manager shall make such findings and recommendation as is war- ranted by the evidence. (Ord. 1526 (part), 1990: Ord. 953 (part), 1979) 10.26.140 Collection of charges. In the event of the failure of any person to pay the charges assessed pursuant to the provisions of this chapter, the City may institute an action in any court of competent jurisdiction to collect said charges together with interest and all administra- tivecosts ofcollection. (Ord. 1207 § 3(part),1982: Ord. 953 (part), 1979) 10.26.150 Reimbursement for wilful conduct. In the event that any owner or other person is convicted of intentionally reporting a false emer- gencyalarm, as prescribed by Penal Code § 148.4, the enforcement officer designated by the City Manager is authorized to forward to the office of the District Attorney, Probation Departments, or Court having jurisdiction, a record of proceedings conducted pursuant to this chapter, including a statement of any delinquent service charges as- sessed,for the purpose of obtaining restitution of said amounts to City as an element of any criminal penalty thereby imposed. (Ord. 953 (part), 1979) 10.26.160 Separability. If any section, subsection, sentence, clause, or phrase of this chapter is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, then such deci- sion shall not affect the validity of the remaining portions of this chapter. Application. Form of application for special permit. Fee for processing application. Issuance of special permit. 1137.060 Restrictions. 1137.070 Appeals. 1137.080 Severability. 1137.010 Purpose. The purpose of this chapter is to set forth the form and necessary fees for filing an application for a special permit authorizing the applicant to operate or move a vehicle or combination of vehi- cles of asize orweight orwith aload exceeding the maximum as specified by the California Vehicle Code. (Ord. 1538 § 1(part), 1990) 1137.020 Application. This chapter shall apply to any vehicle which exceeds the size, weight and load allowances as set forth in Division 15 of the California Vehicle Code. (Ord. 1538 § 1(part),1990) 1137.030 Form of application for special permit. Any applicant who is subject to this chapter and wishes a special permit authorizing the applicant to, with respect to streets and highways under Cupertino's jurisdiction, operate or move a vehi- cle or combination of vehicles or special mobile equipment of a size or weight of vehicle or load exceeding the maximum specified in Division 15 of the California Vehicle Code, shall submit an application in the form as set forth in California Vehicle Code Section 35781, attached to the ordi- nance codified in this chapter as Exhibit A, which form application shall be available from the Cu- pertino Department of Public Works. (Ord. 1538 § 1(part),1990) 1137.040 Fee for processing application. A. The fees for processing and issuing a special permit pursuant to this chapter shall be as follows: Single trip permit or rider .... $15.00 Annual permit .............. 70.00 B. The charge per permit issued for repetitive loads of ten or more trips will be the same amount as is charged for the annual permit. To qualify as a repetitive load, the commodity must be of the same size and description, with evidence pre- sented with the application of the anticipated number of loads and an estimate of the antici- pated total time involved in the shipment. This type of permit shall also be limited to travel from the specified point of origin to the destination, i.e., restricted haul from point A to point B only. No charge shall be imposed on governmental agen- cies using their own equipment. Special services necessitated by unusually large or heavy loads requiring engineering investigations, escorts, tree trimming or other services shall be billed sepa- rately. (Ord. 1538 § 1(part),1990) 1137.050 Issuance of special permit. The Director of Public Works may, at his or her discretion, upon the submittal of a complete ap- plicationand ifgood cause appears, issue a special permit authorizing the applicant to operate or move a vehicle or combination of vehicles or spe- cial mobile equipment of a size and a weight of vehicle or load exceeding the maximum specified in Section 15 of the California Vehicle Code. (Ord. 1538 § 1(part),1990) 1137.060 Restrictions. The Director of Public Works may withhold a special permit or, if the special permit is issued, limit the number of trips or establish seasonal or other time limitations within which the vehicle or vehicles described in this chapter may be oper- ated, or otherwise limit or prescribe conditions of 342-1 (c~percuo i-9i~ 11.37.060 operation, when necessary to assure against undue damages to the road foundations, surfaces, structures, or roadside and overhead facilities, and may require an undertaking or other security necessary to protect the streets and highways from injury or to provide indemnity from any injury resulting from the operation of the vehicle. (Ord. 1538 § 1(part),1990) 1137.070 Appeals. A. Any person aggrieved by a decision of the Director of Public Works under the provisions of this chapter may appeal such decision to the City Council by filing a written notice of the appeal with the City Clerk within five days after the date of the decision. B. Said notice of appeal must state: 1. The asserted error; 2. The grounds upon which said appeal is taken; and 3. The name and address of the party appeal- ing. Said notice of appeal must be signed by the party appealing, or by his agent. Said notice of appeal shall not be effective unless it is filed with the City Clerk within the time required by subsec- tion A of this section. C. A public hearing shall be held by the City Council within thirty days from the date of the filing of the notice. D. Notice of the time and place of the hearing shall be given by mail, postage prepaid, and dis- patchednot less than ten days prior to the hearing to the applicant at his address as shown upon the notice of appeal. E. The City Council shall hear the appeal. At the conclusion of the hearing, the Council may affirm, reverse or modify the action appealed; subj ect, however, to the provisions of this chapter. The findings and decisions of the City Council shall be entered upon the minutes of the City Council, and the decision shall be final and shall take effect as directed by the City Council. (Ord. 1538 § 1(part),1990) 1137.080 Severability. If any section, subsection, sentence, clause or phrase of the ordinance codified in this chapter is for any reason held to be unconstitutional, such decision shall not affect the validity of the remain- ing portions of this chapter. The legislative body declares that it would have passed the ordinance codified in this chapter and each section, subsec- tion, sentence, clause or phrase thereof, irrespec- tive of the fact that any one or more sections, subsections, sentences, clauses or phrases be de- clared unconstitutional.
