(Ord. 1974, § 4 (part), 2006; Ord. 1787, § 1 (part), 1998) 2.32.030 Vacancy or Removal. Any appointed member may be removed by a majority vote of the City Council. If a vacancy occurs other than by expiration of a term, it shall be filled by the Mayor's appointment for the unexpired portion of the term. (Ord. 1787, § 1 (part), 1998) 2.32.040 Chairperson. The commission shall elect its Chairperson and Vice- Chairperson from among its members. The terms of the Chairperson and Vice-Chairperson shall be for one year. (Ord. 2015, § 7, 2008; Ord. 1787, § 1 (part), 1998) 2.32.010 Established. The City Planning Commission is established. The City Planning Commission shall consist of five members, none of whom shall be officials or employees of the City and none of whom shall cohabit with as defined by law, nor be related by blood or marriage to any other member of the Commission, the City Manager or the staff person(s) assigned to this Commission. The five members shall be appointed by the City Council. Each member shall be a qualified elector in and resident of the City. Each member shall receive compensation as established by resolution of the City Council. (Ord. 1787, § 1 (part), 1998) 2.32.020 Term of Office of Members. A. Commissioners serve at the pleasure of the City Council. The term of office of the members of the Planning Commission shall be four years and shall end on January 30th of the year their term is due to expire. No commissioner shall serve more than two consecutive terms except that a commissioner may serve more than two consecutive terms if he or she has been appointed to the Commission to fill an unexpired term of less than two years. B. The appointment, reappointment and rules governing incumbent members of the Commission are 2.32.050 Meetings. A. The City Planning Commission shall hold regular meetings on the second and fourth Tuesdays of each month at six forty-five p.m. and may adjourn any regular meeting to a date certain, which shall be specified in the order of adjournment and when so adjourned, such adjourned meeting shall be a regular meeting for all purposes. Such adjourned meetings may likewise be adjourned and any so adjourned meeting shall be a regular meeting for all purposes. City Planning Commission meetings that fall on legal holidays shall automatically be moved to the following day. B. Special meetings of the Commission may be called at any time by the Chairperson or by any three or more members of the Commission upon written notice being given to all members of the Commission and received by them at least twenty-four hours prior to the meeting, unless notice requirement is waived in writing by the member. The affirmative vote of not less than a majority of its total voting members is required to approve a recommendation to amend the zoning ordinance; the affirmative vote of a majority present with a quorum present is required to take any other action. 2008 S-16 29 2.32.060 Cupertino -Administration and Personnel 30 B. The Commission shall keep an accurate record of its proceedings and transactions, and shall render such reports to the Council as may be required by ordinance or resolution, and shall submit an annual report to the Mayor. To accomplish this the Commission shall be furnished with a secretary employed by the City to keep accurate records of the Commission. All records so prepared by the secretary shall be filed with the City Clerk. (Ord. 1787, § 1 (part), 1998) 2.32.070 Powers and Functions. The powers and functions of the City Planning Commission shall be as follows: A. Prepare, periodically review, and revise as necessary, the General Plan; B. Implement the General Plan through actions including, but not limited to, the administration of specific plans and zoning, subdivisions, and sign ordinances; C. Annually review the capital improvement program of the City and the local public works projects of other local agencies for their consistency with the General Plan (pursuant to Sections 65400 et seq. of the California Government Code); D. Endeavor to promote public interest in, comment upon, and understanding of the General Plan, and regulation relating to it; E. Consult and advise with public officials and agencies, public utility companies, civic, educational, professional, and other organizations and citizens generally concerning implementation of the General Plan; F. Promote the coordination of local plans and programs with the plans and programs of other agencies; G. Perform other functions as the City Council provides including conducting studies and preparing plans other than those required or authorized by state law; H. Establish as needed a standing subcommittee of the Commission for Design Review. The Planning Commission shall decide appeals of the Design Review Committee for the purposes of conducting design review on projects that properly come before the Design Review Committee for review, and conduct design review of a project as required by Chapters 2.90, 19.132, 19.134 and of the Cupertino Municipal Code. The Planning Commission may adopt from time to time such rules of procedure as it may deem necessary to properly exercise its powers and duties. Such rules shall be subject to approval by the Council before becoming effective. All such rules shall be kept on file with the Chairperson of the Planning Commission and the Mayor and a copy thereof shall be furnished to any person upon request. The Parks and Recreation Commission of the City is established. The Parks and Recreation Commission shall consist of five members who are residents of the City, none of whom shall be officials or employees of the City, nor cohabit with as defined by law, nor be related by blood or marriage to any member of the Commission, the City Manager or the staff person(s) assigned to this Commission. The five members shall be appointed by the City Council. If personal notice cannot be given, written notice must be mailed to such members at least twenty-four hours prior to the meeting, unless the notice requirement is waived in writing to the member. A majority vote is required to approve a recommendation or on any matter that is presented to the Commission which requires a vote. The Commission shall keep an accurate record of its proceedings and transactions, and through the Director of Parks and Recreation shall render such reports to the City Council as may be required. (Ord. 303, § 7.2, 1965) 2.36.080 Powers and Functions. The powers and functions of the City Park and Recreation Commission shall be as follows: A. To hold hearings on matters pertaining to planning and development of parks, cultural activities, historical resources, recreation and capital expenditures related to community activities and facilities; B. To conduct such other hearings as are necessary and in accordance with its own rules and regulations; C. To report its decisions and recommendations in writing to the City Council; D. To consider, formulate and propose programs, activities, resources, plans and development designed to provide for, regulate and direct the future growth and development of community activities, parks and a recreation system in order to secure to the City and its inhabitants better service; E. To make investigations and reports for future acquisition of park sites; F. To make, in its advisory capacity, any and all recommendations to the City Council relating to the above matters, including the extension of the parks, recreation system and community activities to outlying areas of the City; G. In cooperation with the Director of Parks and Recreation, the Commission will consider, review, and evaluate all parks, recreation programs, and community activities; H. To consider, formulate, and propose cultural activities and historical preservation for the City and its residents. Nothing in this chapter shall be construed as restricting or curtailing any of the powers of the City Council or City Officers, or the delegation to the Parks and Recreation Commission of any authority or discretionary powers imposed by law in such Council or officers. The City Council declares that the public interest and convenience require the appointment of a Parks and Recreation Commission to act in a purely advisory capacity to such Council. (Ord. 1083, (part), 1980) 2.36.090 Procedural Rules. The City Park and Recreation Commission may adopt from time to time such rules of procedure as it may deem necessary to properly exercise its functions. Such rules shall be recommended to the Director of Parks and Recreation and shall be subject to approval by the City Council before becoming effective. All such rules shall be kept on file with the Chairman of the City Park and Recreation Commission, the department office, and the Mayor, and a copy thereof shall be furnished each Commissioner and any other person upon request. The Public Safety Commission of the City is established. The Public Safety Commission shall consist of five members, all of whom shall reside within the City and shall be appointed by the City Council. None shall be officials or employees of the City, members of the Sheriff's Department of the County, either regular or reserve, nor shall they be members of the Central Fire Protection District. No members of the Public Safety Commission shall cohabit with, as defined by law, nor be related by blood or marriage to any member of the Commission, the City Manager or the staff person(s) assigned to this Commission. Consult with the City Council, the City staff and the Santa Clara County Library Joint Powers Authority and staff regarding the Cupertino Library programs and services to the community and shall make recommendations from time to time for improvements or modifications thereof; C. Consult with and act as liaison with private community groups supportive of the library program; D. Consult with the architect and the City Council in the planning of any main or branch library building facilities, including locations, building layout, architecture, landscaping and furnishings; E. Hold hearings, formulate policies and make rules and procedures with respect to the foregoing for approval by the City Council; F. The Fine Arts Commission shall consist of five members, none of whom shall be officials or employees of the City, nor cohabit with as defined by law, nor be related by blood or marriage to any member of the Commission, the City Manager or the staff person(s) assigned to this Commission. At least three members shall be City of Cupertino residents. Members of the Fine Arts Commission shall be appointed by the City Council. Membership will be drawn to represent the arts, citizens and business community on an approximately equal basis. B. To fulfill their mission, the Commission may involve itself in the following activities: 1. Act as a catalyst for the promotion of fine arts activities; 2. Provide liaison between various fine arts activities; 4. Provide a means for coordination for fine arts groups or facilities which may exist within the community; 5. Maintain an inventory of facilities available for related fine arts activities within the community; 6. Provide screening and/or review for fine arts activities wishing to obtain city funds or utilize public facilities; 7. Provide information to the community relating to the arts; 8. Foster the development of public art within the community; 9. Be vigilant in exploring and advancing the range of fine arts activities available to the community; 10. Enhance the interaction between arts and business; 11. Any other activity which may be deemed appropriate and necessary. (Ord. 1401, (part), 1987) 2.80.090 Compensation-Expenses. The Housing Commission of the City is established. The Housing Commission shall consist of five members as follows: 1. Representative from a Cupertino financial institution, 2. Representative from a Cupertino business, 3. Two community members, 4. City's appointed representative to the Santa Clara County Community Development Block Grant (CDBG) Citizens Advisory Committee. B. The representatives from a financial institution and a business, the community members, and the City's representative to the County CDBG Citizens Advisory Committee shall not be officials or employees of the City, nor cohabit with, as defined by law, nor be related by blood or marriage, to any member of the Commission, the City Manager or the staff person(s) assigned to this Commission. C. The Director of Community Development shall provide technical assistance to the Commission. Housing Committee members who are representatives of a financial institution or a business are not required to be Cupertino residents, but the financial institution and the business represented must be located in Cupertino. The two community members and the City's appointed representative to the Santa Clara County CDBG Citizens Advisory Committee must be residents of Cupertino. B. In selection of community members, the City Council may give priority to: 1. Applicants who are familiar with the operation of affordable housing; 2. Applicants who represent community organizations; and 3. Applicants who are knowledgeable about the housing needs of groups targeted for affordable housing development which include, but are not limited to, the following: 1. Seniors, 2. Single parent families, 3. Homeless persons, 4. Families of low income, 5. Disabled persons, 6. Renters, 7. First time homebuyers. Housing commissioners serve at the pleasure of the City Council. The term of office of the members of the Housing Commission shall be for four years commencing on the date of their respective appointments to the Housing Commission or its predecessor Commission and shall end on January 30th of the year their terms are due to expire. No member shall serve more than two consecutive terms except that a member may serve more than two consecutive terms if he or she has been appointed to the Commission to fill an unexpired term of less than two years. B. The Commission shall keep an accurate record of its proceedings and transactions and shall render such reports to the City Council and Planning Commission as may be required. The powers and functions of the Housing Commission shall be as follows: 2008 S-16 A. To assist the Planning Commission and the City Council in developing housing policies and strategies for implementation of general plan housing element goals; B. To recommend policies for implementation and monitoring of affordable housing projects; C. To facilitate innovative approaches to affordable housing development and to generate ideas and interest in pursuing a variety of housing options; D. When requested by the Director of Community Development or the City Council, to make recommendations to the Planning Commission and the City Council regarding affordable housing proposals in connection with applications for development including, but not limited to, recommendations for possible fee waivers, other incentives, the number and type of affordable units and the target groups to be served. Any referral to the Housing Commission shall be limited to consideration of affordable housing proposals which exceed normal housing requirements under the applicable provisions of the City's general plan or ordinances related thereto; E. To make recommendations regarding requests for money from the Affordable Housing Fund; F. To provide information about affordable housing; G. To meet with neighborhood, community, regional and business groups as necessary to receive input and assist in generating affordable housing; H. To help identify sources of funds to develop and build affordable housing; I. To perform any other advisory functions authorized by the City Council. An Audit Committee at large member is not required to be a Cupertino resident. In selecting an at large member, the City Council shall give priority to individuals who have substantial accounting, audit, or investment experience, preferably in connection with a governmental agency. The Audit Committee shall have available to it such assistance of City staff as may be required to perform its functions, the staff assignments and administrative procedures to be under the general direction and supervision of the Director of Administrative Services. Such rules shall be subject to approval by the Council before becoming effective. All such rules shall -be kept on file with the chairperson of the Audit Committee, the Mayor, and the City Clerk and a copy thereof shall be furnished to any person upon request. The Bicycle Pedestrian Commission shall consist of five members, none of whom shall be officials or employees of the City, nor cohabit with as defined by law, nor be related by blood or marriage to any member of the Commission, the City Manager or any staff person(s) who may be assigned by the City Manager to assist this Commission. Members of the Bicycle Pedestrian Commission shall be appointed by the City Council. (Ord. 1895, (part), 2002) 2.92.020 Members-Terms. A. Commissioners serve at the pleasure of the City Council. The term of office of the members of the Bicycle Pedestrian Commission shall be for four years and shall end on January 30th of the year their term is due to expire. No commissioner shall serve more than two consecutive terms, except that a commissioner may serve more than two consecutive terms if he or she has been appointed to the Commission to fill an unexpired term of less than two years. B. The appointment, reappointment and rules governing incumbent members of the Commission are governed by Resolution No. 7571 of the Cupertino City Council. To receive public input pertaining to bicycle and pedestrian transportation and infrastructure issues; 4. To make recommendations regarding the implementation of roadway and transportation improvements as it pertains to bicycle and pedestrian needs; 5. To make recommendations regarding the allocation of funds for capital expenditures relating to bicycle and pedestrian transportation; 6. Upon the granting of a permit under this chapter, any fees or deposits required for the use of City personnel, building, equipment, and facilities shall be contained in said permit and said fees or deposits shall be paid by the applicant within ten days of the receipt of said permit. If said fees or deposits are not paid within said ten days, then, in that event, the permit therefor issued shall be null and void: A. Building fees and charges have been established and are regulated by the type of organization or individual usage proposed by the application and such fees are subject to change as required by personnel or City costs; B. Building deposit fees are refundable upon to incite violence, crime or disorderly conduct; approval of the City Manager, providing no damage arises from the applicant's usage. (Ord. 531, § 9, 1972) 13.04.100 Park and/or Building Permit-Liability. Persons to whom an exclusive use permit has been granted must agree in writing to hold the City harmless and indemnify the City from any and all liability for injury to persons or property occurring as a result of the activity sponsored by the permittee and said person shall be liable to the City for any and all damage to parks, facilities, and buildings owned by the City, which results from the activity of permittee or is caused by any participant in said activity. (Ord. 531 § 10,1972) 13.04.110 Park and/or building permit-Revocation. The City Manager shall have the authority to refuse a permit upon a finding that any use or activity is in violation of the provisions of this chapter, or any other ordinance of the City, or of any rule promulgated hereunder, or upon good cause shown. (Ord. 531, § 11, 1972) 13.04.120 Use of Park Property. No person in a park shall do any of the following: A. Wilfully mark, deface, disfigure, injure, tamper with or displace or remove any buildings, bridges, tables, benches, fireplaces, railing, paving or paving material, water lines or other public utilities or parts or appurtenances whatsoever, either real or personal; B. Litter, soil or defile restrooms. No person over the age of six years shall use restrooms and washrooms designed for the opposite sex; C. Dig or remove any soil, rock, stones, trees, shrubs or plants, down timber or other wood or materials, or make any excavation by tool, equipment, blasting or other means or agency. It is unlawful to gather firewood or to collect within the park any type of plant material for the purpose of building a campfire; 13.04.090 D. Construct or erect any building or structure of whatever kind, whether permanent or temporary in character, or run or string any public service utility into, upon or across such lands, except on special written permit issued under this chapter; E. Go upon any lawn or grass plot, where prohibited by the parks and recreation department, and where such prohibition is indicated by proper and legible signs; F. Damage, cut, carve, transplant or remove any tree or plant, or injure the bark, or pick the flowers or seeds of any tree or plant. Nor shall any person attach any rope, wire, or other contrivance to any tree or plant. No person shall dig in, or otherwise disturb any grass area, or in any way injure or impair the natural beauty or usefulness of any areas; G. Climb any tree or walk, stand or sit upon any monuments, vases, fountains, railing, fences, or upon any other property not designated or customarily used for such purposes; H. Hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or throw missiles at any animal, reptile, or bird; nor shall any person remove or have in his possession the young of any wild animal, or the eggs or nest or young of any reptile or bird. Exception to the foregoing is made in that snakes known to be deadly poisonous, such as rattlesnakes, or other deadly reptiles may be killed on sight; I. Use any system for amplifying sounds, whether for speech or music or otherwise, unless an exclusive use permit is first secured. (Ord. 531, § 12, 1972) 13.04.130 Behavior of Persons in Parks. No person in a park shall do any of the following: A. Bring to a park any alcoholic beverages, and no person may drink alcoholic beverages at any time in a park, except picknickers, who may bring to a park, and drink, beer or wine with their picnic meal, so long as they conduct themselves in an orderly manner; B. Enter or remain in a park while under the influence of intoxicating liquor or any drug; C. Have brought, or have in his possession, or set off, or otherwise cause to explode or discharge or burn, any firecrackers, torpedoes, rockets, or other fireworks or explosives of inflammable material, or discharge them or throw them into any such area from land or any highway adjacent thereto. This prohibition includes any substance, compound, mixture or article that, in conjunction with any other substance or compound would be dangerous from any of the foregoing standpoints; D. No person having the control or care of any dog shall suffer or permit such dog to enter or remain in a park, unless posted for such use, and then only if it is led by a leash of suitable strength not more than six feet in length; and the owner and the attendant shall be responsible for any damage caused, in any event, by such dog, even if on leash; 13.04.130 Cupertino -Parks E. Lead, ride, drive, keep or let loose any animal, reptile or fowl of any kind, without a permit to do so from the Director of parks and recreation; F. Make or kindle a fire for any purpose, except at places provided for such purpose, unless prior special permission be obtained therefor from the Director; G. Enter an area posted as "Closed to the Public," and no person shall use, or abet the use of, any area in violation of posted notices; H. Play or bet at or against any game which is played, conducted, dealt, or carried on for money, chips, shell, credit or any other representative of value, or maintain or exhibit any gambling table or other instrument of gambling or gaming, or play any game prohibited by any other ordinance of the City; I. Sleep, or protractedly lounge, on the seats, benches, or other areas, or engage in loud, boisterous, threatening, abusive, insulting, or indecent language, or engage in any disorderly conduct or behavior tending to a breach of the public peace; J. Use, carry, or possess firearms of any description, or air rifles, spring guns, bow and arrows, slings or any other forms of weapons potentially dangerous to wild life or to human safety. Shooting into park areas from beyond park boundaries is prohibited; K. Solicit alms or contributions for any purpose, whether public or private, without prior permission from the City Council; L. Use or allow the use of powered model airplanes except in areas so designated by the department of parks and recreation; M. Play or practice golf or use golf clubs in any area of the park not designated for such use; N. Indulge in riotous, boisterous, threatening or indecent conduct. O. No person shall skate or rollerblade in a manner that causes damage to park amenities or threatens the safety or well being of park patrons. Skating or rollerblading is prohibited on raised surfaces where signed. (Ord. 1945, 2004; Ord. 1886, (part), 2001; Ord. 531, § 13, 1972) 13.04.140 Sanitation Requirements. No person in a park shah do any of the following: A. Throw, discharge or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream, bay or other body of water in or adjacent to any park or any tributary, stream, storm sewer or drain flowing into such waters, any substance, matter or thing, liquid or solid, which will or may result in the pollution of such waters; B. Dump, depositor leave any bottles, broken glass, ashes, paper, boxes, cans, refuse or trash on the grounds thereof. Such items shall be placed in the proper receptacles where these are provided; and, where such receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence, and properly disposed of elsewhere. (Ord. 531, § 14, 1972) 13.04.150 Vehicle Requirements. No person in the park shall do any of the following: A. Fail to comply with all applicable provisions of the Vehicle Code of the state in regard to equipment and operation of vehicles, together with such regulations as are contained in this chapter and any other ordinances of the City regulating traffic; B. Fail to obey all traffic officers and park employees who are hereafter authorized and instructed to direct traffic in the parks in accordance with the provisions of this chapter and such supplementary regulations as may be issued by the Director; C. Fail to observe carefully all traffic signs indicating speed, direction, caution, stopping or parking and all other signs posted for proper control and to safeguard life and property; D. Ride or drive a vehicle at a rate of speed exceeding fifteen miles an hour, except upon such roads as the City may designate by posted signs for speedier travel; E. Drive any vehicle on any area except paved roads or parking areas, or such other areas as may be specifically designated as temporary parking areas by the department of parks and recreation; F. Park a vehicle in other than an established or designated parking area, and such use shall be in accordance with the posted directions there, and with the instructions of any attendant who may be present; G. Ride a motorcycle, motor bike, or similar vehicle in any park, except where used to transport invalid persons; H. Ride a bicycle on other than a paved road or path. Notwithstanding the foregoing, no person may ride a bicycle on a paved road or path where such activity is prohibited by posted signage. A bicyclist may wheel or push a bicycle by hand over any grassy area, wooded trail, or over any other area in which bicycle riding is otherwise prohibited; I. Ride a bicycle other than on the righthand side of the road paving as close as conditions permit, and bicycles shall be kept in single file when two or more are operating as a group. Bicyclists shall at all times operate their machine with reasonable regard to the safety of others, signal all turns, pass to the left of any vehicle they are overtaking and pass to the right of any vehicles they may be meeting; J. Ride any other person on a bicycle, except where the bicycle is built for operation by more than one person; K. Leave a bicycle in a place other than a bicycle rack where a bicycle rack is provided and there is space available; L. Leave a bicycle lying on the ground or paving, or set against trees, or in any place or position where other persons may trip over or be injured by it. A. Under California law as embodied in the California Waste Management Act of 1989 (California Public Resources Code Sections 40000 et seq.), the city is required to prepare, adopt and implement source reduction and recycling plans to reach landfill diversion goals, and is required to make substantial reductions in the volume of waste materials going to the landfills; B. In order to meet these goals it is necessary that the city promote the reduction of solid waste, and reduces the stream of solid waste going to landfills; and C. Waste from construction, demolition, and renovation of buildings represents a significant portion of the volume of waste presently coming from the city and much of this waste is particularly suitable for recycling and reuse; D. The city's commitment to the reduction of waste requires the establishment of programs for recycling and salvaging of construction and demolition (C&D) waste. (Ord. 2022 (part), 2008) 16.72.020 Definitions. For the purposes of this chapter, the following words and phrases shall have the meanings ascribed to them by this section, unless the context or the provision clearly requires otherwise. 1. "Applicant" means any individual, firm, limited liability company, association, partnership, political subdivision, government agency, municipality, industry, public or private corporation, or any other entity whatsoever who applies to the City for the applicable permits to undertake construction, demolition, or renovation project within the City. 2. "Construction" means the building of any facility or structure or any portion thereof including tenant improvements to an existing facility or structure. 3. "Construction" and "demolition debris" or "C&D debris" means used or discarded materials removed from premises during construction or renovation of a structure resulting from construction, remodeling, repair, or demolition operations on any pavement, house, commercial building, or other structure. 4. "Covered project" means project meeting the specifications of § 16.72.030 of this section. 5. "Demolition" means the decimating, razing, ruining, tearing down or wrecking of any facility, structure, pavement or building, whether in whole or in part, whether interior or exterior. 6. "Director of Public Works" shall be the Director of Public Works and his or her duly authorized agents and representatives. 7. "Divert" means to use material for any purpose other than disposal in a landfill or transformation facility. 8. "Diversion requirement" means the diversion of a percentage, as determined from time to time by the Director of Public Works, of the total construction and demolition debris generated by a project via reuse or recycling. 9. "Project" means any activity, which requires an application for a building or demolition permit, or any similar permit from the city. 10. "Recycling" means the process of collecting, sorting, cleansing, treating, and reconstituting materials that would otherwise become solid waste, and returning them to the economic mainstream in the form of raw material for new, reused, or reconstituted products which meet the quality standards necessary to be used in the marketplace. 11. "Renovation" means any change, addition, or modification in an existing structure. 12. "Reuse" means further or repeated use of construction or demolition debris. 13. "Salvage" means the controlled removal of construction or demolition debris from a permitted building or demolition site for the purpose of recycling, reuse, or storage for later recycling or reuse. 2008 S-16 99 16.72.020 Cupertino -Buildings and Construction 100 14. "Waste Management plan" means a plan, prepared in a form approved by the Director of Public Works, that identifies the amounts of all construction and demolition debris generated by the project, the amounts recycled or diverted, and the intended salvage, reuse, and recycling facilities chosen formalist of City approved facilities. Copies of supporting documentation shall be required and included as a part of the final construction and demolition debris recycling reporting. (Ord. 2022 (part), 2008) 16.72.030 Covered Projects. A. All construction, demolition and renovation projects within the city, which involve the construction, demolition or renovation of 3,000 square feet or more, shall comply with this section. For the purposes of determining whether a project meets the foregoing thresholds, all phases of a project and all related projects taking place on single or adjoining parcels, as determined by the Director of Public Works, shall be deemed a single project. B. Compliance with this chapter shall be listed as a condition of approval on any building or demolition permit issued for a covered project. (Ord. 2022 (part), 2008) 16.72.040 Diversion Requirement. A. Applicants for any covered project are required to recycle or divert at least 60% of all generated C&D tonnage from demolition projects to an approved facility or by salvage. B. If an Applicant for a Covered Project experiences circumstances that the Applicant believes make it impossible to comply with the Diversion Requirement, the Applicant shall submit written justification with the Waste Management Plan. The Director of Public Works will determine, in writing, whether any diversion requirements shall be waived in whole or in part on grounds of impracticability or impossibility. (Ord. 2022 (part), 2008) C. The vendor that the applicant proposes to use to haul the materials; D. The facility to which the materials will be hauled chosen from a list of facilities approved by the city; E. The estimated volume or weight of construction and demolition debris that will be land-filled. In estimating the volume or weight of materials identified in the waste management plan, the applicant shall use the standardized conversion rates approved by the City for this purpose. Approval of alternative facilities or special salvage or reuse options may be requested of the Director of Public Works. Approval by the Director of Public Works, or designee, of the Waste Management Plan as complying with this chapter shall be a condition precedent to the issuance of any building or demolition permit for a covered project. (Ord. 2022 (part), 2008) 16.72.060 Administrative Fee. As a condition precedent to the issuance of any building or demolition permit for a covered project, the applicant shall pay to the City an application fee as set forth in the municipal fee schedule. (Ord. 2022 (part), 2008) 16.72.070 Reporting. Within 60 days after the completion of any covered project, the applicant shall submit to the Public Works Department a final completed Waste Management Plan including reporting documentation demonstrating that the applicant has met the diversion requirement for the project. Documentation shall consist of a final completed report in a format provided by the City and shall comply with the requirements of this chapter. Copies of all facility weight tickets and/or disposal receipts must be submitted with the report. (Ord. 2022 (part), 2008) 16.72.050 Information Required Before Issuance of Permit. Every applicant shall submit a properly completed "Waste Management Plan" on a form prescribed by the city, as a portion of the building or demolition permit application process for a covered project.
