Staff recommends approval of the Director's Minor Modification and Height Exception
per the model resolutions enclosed. Planning Commission action is final, unless
appealed to the City Council.

BACKGROUND:
The applicant, representing Clearwire, is proposing to install a personal wireless service
facility with antennas on top of an existing PGB~E lattice tower located in the southwest
corner of an existing self-storage facility, Cupertino Loc-N-Stor (Attachment 1).
Clearwire, a subsidiary of Clearwire Communications and Sprint-Nextel
Communications, is proposing to develop a new, high speed, wireless voice and
Internet communications network in the San Francisco Bay Area and other parts of the
country. The network is separate from the Sprint-Nextel network, so it will not use the
same antennas, but will share the same enclosure for the base equipment when feasible
(Attachment 2}.
The six antel~ulas are proposed to be mounted at the top of a 12-foot tall "top hat"
extension to the PGB~E lattice, which is located between Highway 85 (at the Highway
280 intersection) and several private storage buildings. The closest residential
dwellings are 428 feet away to the soutl~. Sprint-Nextel has a set of three antennas
mounted on the legs of this tower at 55 feet. In addition, five other wireless carriers
have facilities on this property and the abutting City Service Center property.

DISCUS-SIGN:
Applications
Typically Director Minor Modification applications are approved by the Director of
Community Development. When such an application is accompanied by a different
application that is approved by a higher decision-making body, such as, the Planning
Commission, then the Commission reviews both applications. Since the height
exception requires Planning Commission approval, both applications are being
reviewed by the Commission.
Location
The Wireless Facilities Master Plan expresses a clear, preference for such facilities to be
located in non-residential areas on existing structures whenever possible.
Six wireless companies have facilities on this property and the adjacent city-owned lot.
Design
The applicant has proposed a "top-hat" design for its facility with the antennas
mounted on a rectangular framework on top of the PG&E lattice tower. This type of
design requires a height exception because the antenna height is always above the
ordinance maximum of 55 feet. It should be noted that the existing lattice tower is 138
feet and that the "top-hat" will add 12 feet to it, bringing the total height to 150 feet.
This represents a 8.7% increase in the overall height of the lattice tower. This type of
design has been approved by the Planning Commission in three other areas:
1) Monta Vista PG&E substation at California Oak Way,
2) PG&E substation at Homestead Road near Stelling Road,
3) 10655 Mary Avenue (same tower, approved Metricom facility was not built)
The rectangular panel antenna visually blends in with the lattice tower extension. The
circular microwave dishes are normally more apparent, but less so because of the height
and bulk of the tower extension. See the photosimulations (Attachment 3).
Other Facilities
Clearwire is in its initial phase of its Bay Area network development. Staff has
preliminarily reviewed more than half a dozen different Clearwire plans across the
City. Many will require Commission review at a later date.
Height Exception Request
The applicant is seeking a height exception for the antennas to locate them above the
top of the lattice tower. The Clearwire network was designed such that the network site
connectivity relies entirely on microwave communications, versus, other
communication carriers whose networks rely on telephone lines for connectivity
(Attachment 1). It is imperative that the microwave dishes obtain maximum height

over the surrounding clutter (buildings and trees) and topography to ensure a clear line
of sight, point-to-point connection with other sites in the system. Therefore, the
Clearwire facilities would only be located on the tallest buildings, the tops of lattice
towers and other very tall structures.
The tower extension is 12 feet when only 6 feet is needed. The applicant submitted the
attached PG&E tower policy (Attaclunent 4), which requires communication carriers to
ask for 12-foot tall tower extensions in order to promote collocation on PG&E towers.
Encouraging collocation of wireless company antennas on existing PG&E towers
forgoes the future need to erect new monopoles in the community.
Technology, Information and Communications Commission (TICC) Comments
Per ordinance requirements, plans and documents are distributed to designated
Technology, Information and Communications Commissioners for their input. One TIC
Commissioner, Avinash Gadre, responded (Attachment 5). He supports the project and
noted the following:
• The top of the tower antenna locations were needed to obtain better radio signals
for customers; and
• The height and location were okay as it was away from residential areas.
Public Noticing
The ordinance requires 1,000-foot radius public hearing notices mailed to property
owners. To date one email response has been received(Attachment 6).

WHEREAS, in order to provide height flexibility in situations where practical difficulties,

in the tower height,
3. The proposed development will not create a hazardous condition for pedestrian or vehicular
traffic because it is not sited within the travel ways or sight lines of pedestrian or vehicular
traffic.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted
in this matter, application no. EXC-2009-07 is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this Resolution are

the permit. The applicant may apply for a renewal of the minor modification at which
time the Director of Community Development may review the state of wireless
communication and camouflage technologies to determine if the visual impact of the
personal wireless facility can be reduced.
5. CAMOUFLAGING OF EQUIPMENT
The antennas, mounting brackets, and cables that run from the antennas to the base
equipment shall be painted to match the color of the lattice tower.

Project Location
The proposed project is located at 10655 Mary Avenue in the City of Cupertino. The
proposed communications facility will be located on an existing PG&E lattice tower and
within an existing storage unit. The project site is located on Assessor's Parce1326-06-050.
Geographic coordinates (NAD 83) for the proposed tower site are Latitude: 37°19' 53.11 ";
Longitude: -122° 03' 08.17", at an elevation of approximately 282' AMSL (above mean sea
level).
Project Components
The proposed project would consist of installation of antennas and radio equipment on an
existing PG&E lattice tower and within an existing equipment shelter as shown on the
attached plans. The proposed project components would consist of the following elements
to be contained within a 30.0 (5' x 6') square foot lease area:
• A 12'-tall top hat extension to the lattice tower for a total overall height of,3.1~2" j5b ~
• One indoor radio equipment cabinet (approximately 2' x 2' footprint) to be installed
within the existing SprintlNextel equipment shelter
• One GPS antenna to be mounted on the rooftop of the existing equipment shelter
• 3 panel antennas and 3 microwave antennas to be mounted on the lattice tower as shown
on the attached plans with an antenna centerline of 1.99'' 14~' ~. I~}~~
• Associated coax cabling to be run from the equipment shelter to the tower legs (via
underground conduit) and up the tower legs.
• Power would be provided from the existing power panel within the shelter.
Access is provided via an existing driveway from Mary Avenue.
Collocation
The lattice tower already supports communications facilities and is capable of handling
additional antennas should other wireless communications companies be interested in
collocation on the tower.
Public Services
Public services such as fire and law enforcement are not required given that the facilities aze
designed to be vandalism resistant (fenced and on the tower) and are uninhabitable. The project
does not require school or transit facilities, as it is an unmanned wireless communications
facility.

The site is an unmanned facility that will not generate any noise, dust, or odors. It is
expected that a service technician may visit the site once a month or so for routine
maintenance if needed. Ample parking is available adj acent to the tower.
III. Land Use
Zoning
The project parcel is zoned P, Mixed Use Planned Development. The project site is
bounded on the north and west by Highway X80 and Highway 85, respectively. It is
bounded on the south by a similar industrial use, and on the east by single-family residential
uses.

Environmental Setting
The proj ect is located on a relatively level, industrial parcel that has been entirely developed
with aself-storage facility. There are no sensitive resources within the immediate vicinity
of the project site. The project is located on and adjacent to an existing PG~iE lattice and
will not have any environmental impacts on area resources, Antennas are proposed to be
mounted on the tower and will not significantly change the visual appearance of the tower
as seen from surrounding viewsheds.

received your incomplete letters today regarding the site at Blaney and Mary Avenue. I just wanted to briefly answer
your generalized questions about Clearwire so you understand the network better as you're reviewing our projects.
Clearwire offers a robust suite of advanced voice, high-speed Internet services to consumers and businesses.
The company is building the first Mobile WiMax 4G network in the San Francisco Bay area bringing together an
unprecedented combination of speed and mobility. Clearwire is licensed by the FCC to operate the Mobile WiMax
Network in the 2.5-2.7GHz frequency range in San Francisco market. Clearwire will be using microwave backhaul
for the Mobile WiMax network.
The Clearwire network is designed upon utilization of microwave backhaul throughout the network of hundreds of
sites in the Bay area. This is a 100 percent backhaul solution, with no hardline connections within the system.
What this means is that the majority of the sites transport a signal to at least three other sites with "hubs" located
at the center of some of the rings to transport an initial signal. Because sites are inextricably linked by these
microwave connections, it is imperative that the MW dishes obtain maximum height over the surrounding clutter
and topography to ensure apoint-to-point connection with other sites in the system. Thus, the need to obtain rad
centers above conductors on PG&E sites, as this provided clear line of sight to other sites within the network.
There are some sites which are "stranded (may only have one point of connection without transporting a signal to
other sites)" but these are going to be on the fringes of the network.
In terms of Clearwire's relationship to other carriers and their networks, it should be known that Clearwire is a
subsidiary of Sprint/Nextel (Sprint owns 51 %), but the systems are not integrated. Clearwire's network is an
entirely new network. Eventually, Clearwire's subscribers may have roaming agreements with Sprint/Nextel
where Clearwire is not present, but the systems are not integrated to support each other. Because of the
ownership relationship, Clearwire's footprint is very similar to Sprint's in the Bay area because we know that it is
possible to utilize Sprint/Nextel's shelters, mounting brackets, coax cable trays, etc. with the appropriate
collocation agreement with Sprint/Nextel. We also know we're more likely to have willing landlords were
Sprint/Nextel is already located.
I hope this information is helpful. Obviously it would be preferable from a planning perspective to use a hardline telco
solution, as it allows for stealthier sites. However, Clearwire's system is not designed as such, and the MW backhaul
solution provides a more reliable network for them, as the system's connectivity is entirely within Clearwire's control.
I'll give you a call to discuss site specifics at the Blaney yard (CA-SJC0126) and the Mary Avenue site(CA-SJC0057).

To Whom It May Concern:
The purpose of this letter is to notify effected jurisdictions that it is PG&E's current policy that wireless
communication carriers propose an overall extension (Top Hat) on our lattice towers of 12-feet ~~~hen
going above our conductors ui an effort to promote collocation on towers suitable for multi-carrier
installations. In many itistartces, there is an existing 6-foot top hat which would be replaced with a 12-
foot top hat as a result of a proposed project. In oilier cases, PG&E is requiring. an itutial 12-foot top hat
extension if no previous extension exists for fiihtre growth.
PG&E recognizes that wireless cotnmuiucations carriers have similar coverage objectives atld tl}us have
the desu•e to collocate on facilities already suitable for wireless communications installations. In the
past, PG&)/ has improved its towers on a case-by-case basis, necessitatuig the improvement of lattice
towers many times over. These improvements are not cost efficient and require existing carriers on the
tower to go "off-air" during the improvement phase which requires removal of antetvlas, and coaxial
cables i.n order to install the "top hat" extension and new ante~tnas. Existing carriers and their customers
are thus compromised during this collocation process, which is not a satisfactory solution to future
collocation efforts. Thus, PG&E is anticipating future collocation by making these proposed
improvements and avoiding the need to remove existuig/fuhtre carrier's atrtetuias and coaxial cables
during the collocation process. This policy seems to be consistent with most jurisdictions' policies
directing carriers to collocate on existing sh•uctures, thus avoiding the need to construct new facilities on
raw land sites.

1. Clearwire may be going to the top to provide better signal to customers. Their website covers several cases
of poor signal under faq. So probably they are facing signal problem more often.
2. Height and location seems to be ok since it is away from residential area.

This is a new broadband wireless network being developed by Clearwire in the SF Bay Area. Sprint/Nextel is somehow
involved. The installation is proposed at the top of an existing PG&E lattice tower at the Cupertino Loc-N-Stor facility at
10655 Mary Avenue.
It is not clear why Clearwire needs to go on top of the tower, especially when there is plenty of room below the
conductors at a height that doesn't need a height exception.
