First St. San Jose, CA 95113 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 777-3308 FAX: (408) 777-3333 COMMUNITY DEVELOPMENT planning@cupertino. org SUBJECT: MINOR RESIDENTIAL PERMIT ACTION LETTER- Application RM-2009-13: This letter confirms the decision of the Director of Community Development, given on October 16, 2009; approving a Minor Residential Permit to allow a 753 square foot one-story addition to encroach 10 feet into the required 20 foot rear yard setback area, located at 21971 Columbus Avenue, with the following conditions: 1. APPROVED PROTECT This approval is based on a plan set entitled, "Greif Residence, 21971 Columbus Ave, Cupertino, CA" consisting of five sheets labeled "SP"; "1 "; " 2"; " 3"; and "4" dated September 25, 2009 except as maybe amended by conditions in this resolution. 2. SILK MIMOSA TREE Prior to the issuance of building permits, the applicant shall submit a protection plan to protect the Silk Mimosa tree with the following protection standards written on the plan: - A four-foot high chain link fence and other root protection shall be installed around the drip line of the tree prior to any project site work. - No construction operations shall be carried on within the drip line area of any tree designated to be saved except as authorized by the Director of Community Development. - No trenching within the critical root zone area is allowed. If trenching is needed in the vicinity of trees to be retained, the City's consulting arborist shall lie consulted before any trenching or root cutting beneath the drip line of the tree. ' - Wood chip mulch shall be evenly spread inside the tree projection fence to a four- inch depth. - No branches or roots shall be cut unless at first reviewed by the landscape architect/arborist with approval of staff. - The tree shall be watered to maintain it in good health. - No storage of construction materials or chemical solvents shall be permitted within the drip line area of the tree. The above tree protection regulations shall be posted on protective fencing around the Silk Mimosa tree. In the event that the Silk Mimosa tree dies, it shall be replaced with either one (1) 36" box or two (2) 24" box trees that are identified on PG&E's approved tree list as screen and non-invasive trees. The property owner is also encouraged, but not required, to plant additional trees on the property, preferably to provide screening from other properties. 3. TREE PROTECTION CERTIFICATION A certified arborist's certification ascertaining the good health of the Silk Mimosa tree mentioned above shall be provided prior to issuance of final occupancy. 4. OUTDOOR LIGHTING Any outdoor lighting shall be oriented and designed to preclude any light and direct glare to adjacent residential properties, including the adjoining fence. 5. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 6. EXTERIOR BUILDING MATERIALS/TREATMENTS Final building exterior treatment plan (including but not Iimited to details on exterior color, material, architectural treatments and/or embellishments) shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. The final building exterior plan shall closely resemble the details shown on the original approved plans. Any exterior changes determined to be substantial by the Director of Community Development shall require a minor modification approval with neighborhood input. 7. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90- day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Please be aware that if this permit is not used within one year, it shall expire on October 16, 2010. Staff received comments from neighbors expressing concerns regarding outdoor lighting, the removal of the Silk Mimosa tree, and the proximity of the addition to the rear property line and PG&E easement. The owner has agreed to retain and protect the Silk Mimosa tree; therefore a condition of approval has been added to protect the tree during construction. A condition of approval has also been added to orient any outdoor lighting away from adjacent properties. The City allows the rear yard setback to be reduced to 10 feet, provided that the usable rear yard requirement is met and that the findings stated in CMC section 19.28.090 (B) are made. The addition will not encroach into the PG&E easement, and will leave adequate room for service workers in the event of an emergency. Staff has made all the findings that are required for approval of a Minor Residential Permit as required by the of Cupertino's Municipal Code, Chapter 19.28.090 (B). Also, please note that an appeal of this decision can be made within 14 calendar days from the date of this letter. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission.
