BACKGROUND At its Juiy 21, 2009 meeting, the Cupertino City Council voted to consider anine-month trial for unfenced, off-leash dog exercise areas in four City Parks, if approved by over 50% of the households within 1500 feet of the parks and park users surveyed for 30 consecutive days. The Council also voted to discuss the possibility of an arrangement with the Santa Clara County Parks to build a fenced dog exercise area at Stevens Creek County Park. The Cupertino Parks and Recreation Department contracted with Godbe Research Associates to prepare and manage the surveys. Godbe Research Associates developed the surveys with the assistance of aneight-member citizen group (foixr members for each perspective). Godbe Research Associates mailed surveys, in English and Mandarin, to the properties within 1500 feet of each park. Godbe Research worked with a De Anna College Political Science class for the park user survey. Godbe Research designed the survey and the students conducted the park user surveys as a service learning project. Block leader Debbie Stephens Stauffer and Mark Linder, Cupertino Parks and Recreation Director met with the class to di:>cuss the issue and the importance of the park user survey. Bryan Godbe and Gayatri Kuber, from Godbe Research Associates, met with the class to discuss survey methodology. Godbe Research ~~ssociates analyzed the results of both surveys. Several members of the Citizen Group, along with Senior Recreation Supervisor Julia Lamy, met with representatives from Santa Clara County Perks and Recreation to walk through possible sites for a fenced off-leash dog exercise area at Stevens Creek Park. The Parks and Recreation Department sent a letter to the Santa Clara County Parks and Recreation Department indicating an 17-1 interest in exploring this partnership for the fenced, off leash area. Santa Clara County Parks and Recreation has assigned one of its senior staff members to work with Julia. The following are the results of the surveys and an update on current status of a possible dog park at Stevens Creek County Park. ANALYSIS Mail Survey Data collection was conducted via a mailed survey, which consisted of eight questions. A sample of one of the surveys is attached to this report as Attachment A. There were four different versions of the survey based on the City parks selected for the trial period. Questionnaires, along with a cover letter and a prepaid self addressed return envelope were mailed to a total of 5,17$ households located within 1,500 feet of the four City parks on September 24, 2009. Every household received a cover letter and survey in English and Mandarin. Overall, 1367 residents returned their completed surveys by October 16, 2409. Household surveys received after October 16, were not included in the analyses. The following table shows the breakdown of the number of surveys mailed, the responses received, and the margin of error for each park: The results of the mail survey are as follows: 361 ~ "'482 30% ,. 31% :~,,~. A sample of the bark user survey is attached as Attachment C. Groups of two De Anza students were assigned to interview park users in Jollyman Parts, Library Field, Linda Vista Park, and Memorial Park befi~veen 7 - 9 a.m. Monday -Friday and 9 -11 a.m. Saturday and Sunday. The students interviewed park users at Jollyman, Linda Vista, and Library from 4 - 6 p.m. Sunday -Saturday. Memorial Park was not included in the afternoon as Memorial was not included as a trial park in the afternoon:; due to existing active programming. The data collection took place from October 12 to November 13, 2009. As with the household surveys, the park users surveys were in Mandarin and English. Overall, 960 unique park users completed the survey. The breakdown per park is as follows: Jollyman Park - 281 Library Field -190 Linda Vista Park - 239 Memorial Park - 250 The results of the are as follows: The entire top line report of the park users' survey is found as Attachment D. Representatives from Godbe Research Associatf:s will be present at the December 15 Council meeting to answer questions. Combined Results The City Council asked that the fmal survey results. be combined. A total of 2,327 surveys were submitted. Overall, 853 or 37% support the off leash trial and 1,474 or 63% opposed the trial. The results are as follows: 17-3 Status of possible partnership with County Parks and Recreation Update on County Park Option for Fenced Dog Park At the July 21 meeting, City Council authorized a subcommittee from members of the citizens group to work with Santa Clara County to conduct a study for a fenced dog park at Stevens Creek County Park. The subcommittee group met with County Parks on September 25, 2009 to tour four possible sites at Stevens Creek County Park for the City to consider leasing for a fenced dog park. After viewing the four sites, the subcommittee determined that there was potential within the County Park for a fenced facility. The following describes the County's process for the pre-construction planning for the fenced dog park. All actions noted below assume that the City would take the lead on implementation, in coordination with the County Parks Department. Proposal presentation The City would present an outline proposal for a fenced dog park to the County Parks and Recreation Advisory Commissions, and the County Board's Housing, Land Use, Environment and Transportation Committee {HLUET}. The presentation would include: o The City has designated $580,000 in the Recreation Enterprise Fund reserve for "Linda Vista water feature and dog park projects" (page 80 of the 2009-10 Adopted Budget) o County would consider leasing a section of Stevens Creek County Park to the City. The lease agreement would be similar to the agreement between the County and City of Milpitas for a fenced dog park at Ed Levin County Park. The terms in the City of Milpitas lease are fifteen years plus a ten year extension provision. o Approximate size for a fenced dog park: One to Two Acres o Design Capacity: Small Dog Area -Minimum of 4,000 square feet; Large Dog Area -remaining area o Amenities: Five foot high vinyl clad perimeter fencing; double gate entry area; maintenance gate; artificial turf; landscaping with shade trees; irrigation system; drinking fountain; benches; dog waste dispenser; garbage cans; and signage o Maintenance: The City would be responsible for maintenance of the fenced dog park. Roger Lee, Assistant Public Works Director, estimates the annual budget cost to maintain a site at the county park would be a .5 maintenance worker at $35,000 per year. The maintenance tasks to be performed are frequent washing of artificial turf and furnishings; empty trash; replenish doggie bags; remove graffiti; irrigation system maintenance; trim trees; repair and replace park amenities as needed. Public outreach and input Assuming positive reception from the two County commissions, the next step would be to invite the public to participate in the planning of this facility. The public outreach would include a forum for evaluating the project's goals and objectives, opportunities and constraints, and facility design and management. The desired end product from this phase would be to develop a preferred concept plan that addresses public and agency needs. 4 17-4 . Preferred concept plan review Present the preferred concept plan to the County Parks and Recreation Advisory Commissions, HLUET, and other bodies deemed appropriate, and incorporate changes as may be required. Depending on the complexity of issues presented in this review, seek input from the City Council and County Board of Supervisors. The desired end product from this phase would be authorization to proceed with the preparation of CEQA and lease documents. • CEQA and lease documents preparation Develop an initial study (CEQA analysis) fir the preferred concept plan and work with County planning staff on the public notification and. State Clearinghouse submission process. In tandem with the CEQA work, negotiate a lease agreement with the County real estate staff to meet all parties' needs and objectives. • Final approval Present final plan, CEQA document and lease agreement for adoption/approval by the City Council and the County Board of Supervisors. It may be necessary to present the final documents to the County Parks and Recreation Advisory Commissions and HLUET, depending on the Level of public interest in the process. County staff advises us that the entire planning process will take at least a year. The planning process for the City of Milpitas project was almost a year and a half. The oppostion forced the hours to discouraage residents Honorable City Council Members, Welcome to a new council! Unfortunately, we have old b~.~siness which is still unresolved. The people opposed to the dog under voice control times forced the hours for the trial to be when mothers are out with their preschoolers and when many older people are out for their walks -- during the nice part of the day. Most (not all) of the dog owners would prefer early (6 to 7 or 6:30 to 7:30 AM) and late (the last hour before the park closes) to walk their dogs. Why --> because that is when the park is most lightly used most days. It is also the only time which people who work days have time to walk their dogs. As was pointed out when the surveys were distributed, the actual hours in the survey are not what most of us wanted. These hours were chosen because it increased the likelihood of failure for getting approval. Even then, the actual park users were evenly split on the question. It was the smear campaign which talked about rabies, wild animals and other exaggerations which poisoned the well against the dog off leash trial. The city wide survey (which had not had misinformation distorting the actual feelings) completed last year was nearly 2 to 1 in favor of off leash areas (and times). Why ~~id so many people change their minds -- a dirty campaign was run against it using lies and exaggerations. No one wants children nor grandparents to be attacked. That is why any rationally thinking person would prefer set hours and locations for people to play with their dogs. Please do the trial and THEN do a survey. It is logical way to actually see what issues there really are. Thank you for your consideration! If they had participate in a collaborative and cooperative way to develop a plan that they could support why are they working to have the trial be anon-starter? It seems like they pushed for expanding the areas and times so the trial would be unattractive to more people and now they are working to have what they co-created defeated. If the individual park surveys fail to pass, I feel we should declare a mistrial. At that point, I think a trial should be authorized by the city council (with some rational rules, locations and times). Of course, I hope this will not be needed -- all we need to do is have permission to do the trial through the survey. Thanks for listening!
