RE: Closing of File #'s R-2009-04 and RM-2009-07 and Second Story Code Enforcement at
10163 Byrne Avenue
Dear Ms. Chen:
This letter is to confirm the Planning Division's official closing of Residential Design Review file
# R-2009-04 and Minor Residential Permit file # RM-2009-07. 10 percent of the original
application fees will be refunded.
As you know, the entire existing second story is illegal. To legalize it, you would have to go
through the second story permitting process again and propose plans where the second story
meets the current zoning code standards. This would entail paying the $2,687 application fees,
relocating the south side second story wall inward at least two feet, and demolishing the entire
second story deck. There would also be a litany of building code issues to address as well. The
best solution would be to completely demolish the illegal additions to the house.
The process towards resolving the illegal second story must be addressed expeditiously, since
this is a code enforcement matter. You were also notified in October 2009 that the existing
second story was illegal. Therefore, plans to resolve the illegal second story must be received by
Friday, February 5, 2010. Failure to take action by February 5~~ will result in further code
enforcement action. Please do not hesitate to contact me at (408) 777-7601 or by e-mail at
georges@cupertino.org for any questions.
Sincerely,
