As you know, the entire existing second story is illegal. To legalize it, you would have to go through the second story permitting process again and propose plans where the second story meets the current zoning code standards. This would entail paying the $2,687 application fees, relocating the south side second story wall inward at least two feet, and demolishing the entire second story deck. There would also be a litany of building code issues to address as well. The best solution would be to completely demolish the illegal additions to the house. The process towards resolving the illegal second story must be addressed expeditiously, since this is a code enforcement matter. You were also notified in October 2009 that the existing second story was illegal. Therefore, plans to resolve the illegal second story must be received by Friday, February 5, 2010.
