RECOMMENDATION: Staff recommends approval of the Use Permit per the model resolution enclosed. Planning Commission action is final, unless appealed to the City Council. BACKGROUND: The applicant, Gordon Bell, representing Clearwire, is proposing to install a personal wireless service facility with antennas mounted on a new treepole and an equipment enclosure located in the south/central portion of the PG&E corporation yard. (See photo below and Attachment 1). Clearwire, a subsidiary of Clearwire Communications and Sprint-Nextel Communications, is proposing to develop anew, high speed, wireless voice and Internet communications network in the San Francisco Bay Area and other parts of the country. The project site is surrounded by a townhouse development to the west, single-family residences and apartments to the north of Homestead Road (in the City of Sunnyvale), single-family residences to the east (in the City of Sunnyvale) and Highway 280 to the south. The project site is depicted by the green circle in the aerial photo. 2-1 Gordon Bell (for Clearwire) U-2009-03 February 9, 2010 Page 2 ----------------------------------------------------------------------------- ----------------------------------------------------------------------------- ~~~[ ~~~ ~~ DISCUSSION: LocationlSetback The Cupertino Wireless Facilities Master Plan prefers personal wireless facilities to be located in non-residential areas. Since there are no structures tall enough to accommodate the Clearwire antenna height requirements, the applicant has proposed a 55-foot tall treepole that will be sited behind a band of existing, shorter trees, primarily Coastal Redwoods, that grow on the periphery of the corporation yard site. The antenna setback to the closest residential property is 359 feet, which is swell above the minimum requirement of 75 feet. Visi~i~itylDesigta The specific location in the corporation yard has minimal to no vls~blllty to public streets in Cupertino because of the distance from public streets and intervening 2-2 Gordon Bell (for Clearwire) U-2009-03 February 9, 2010 Page 3 buildings, sound walls and landscaping that block views into the property (Attachment 2). There are partial views from Homestead Road, the Blaney Avenue bridge over Highway 280 and Heron Avenue in Sunnyvale. From these locations it will appear to be part of the grove of trees or the top of a single tree (Attachment 2). The most complete view of the personal wireless facility will be the short span of time motorists spend on northbound Highway 280 as they drive by the corporation yard. The treepole will be taller than the foreground trees, which are topped and trimmed to maintain safety clearances from the overhead high voltage electrical lines. Staff believes that at normal highway vehicle speeds, the tree will visually blend in with the other trees from the viewpoint of the passing motorist. The newer generation treepole is required as part of the conditions of approval. This includes textured faux bark and camouflage needle covers for all of the antennas. Sample materials will be presented at the hearing. Radio Frequency Energy (RFE) Assessment The applicant has commissioned the preparation of a RFE report prepared by Hammett & Edison, Consulting Engineers (Attachment 3). The report calculated the maximum effective radiated power, estimated the aggregated exposures from an adjacent wireless facility and calculated the exposure levels at ground level. The exposure data was evaluated against the adopted federal exposure standards. The report concluded that the proposed facility will meet the federal safety standards for RFE of 1.0 mW/cm2. The calculated, project ground level exposure is 0.25% of the applicable public exposure limit, and the aggregated exposure for all nearby facilities was estimated to be 6.8 % of the applicable public exposure limit. Since this project meets the federal safety standard for RFE, Federal Telecommunications Law prohibits local governments from denying such a wireless facility based on the environmental effects of its RFE generation. The attached chart depicts the RFE exposures that are generated by various household devices and compares it to a typical personal wireless service facility (Attachment 4). A calculation of the second floor residential exposure to RFE was not necessary because the distance is over 350 feet. Ground floor exposures in closer proximity to the antennas would be expected to be more severe and those exposures are already well below Federal safety standards. TECHNOLOGY, INFORMATION AND COMMUNICATION COMMISSION (TICC) COMMENTS: Per Ordinance requirements, TICC provides technical advice to the Planning Commission on personal wireless service facilities. The TIC Commissioners reviewed the treepole design and recommended approval. PUBLIC NOTICING: Public hearing notices were mailed to property owners owning land within a 1,000-foot radius of the project property. EXPIRATION DATE This use permit shall expire ten (10) years after the effective date of the permit. The applicant may apply for a renewal of the use permit at which time the Planning Commission may review the state of wireless communication technologies, camouflage techniques and maintenance to determine if the visual impact of the aerial facility can be reduced. 6. TREE POLE APPEARANCE AND MAINTENANCE The applicant shall use a sufficient number of artificial branches to obscure the appearance of the panel antennae and any associated mounting framework. The top portion of the tree pole shall have branches of varying length to give the tree pole a conical form. Panel antennae and microwave dishes mounted away from the mast shall have needle covers to blend with the green foliage of the artificial branches. The mast and any antennae mounted close to the mast shall be painted brown to mimic a tree trunk. The foliage shall have a mottled green coloration and the mast shall be clad in a faux bark. The building permit shall be reviewed and approved to the satisfaction of the Community Development Director to ensure the above conditions are met. The applicant shall perform regular maintenance of the tree pole to maintain its appearance and obscure the panel antennae from public view. Project Components The proposed project would consist of installation of antennas and radio equipment on a proposed monopine and within a ground lease area as shown on the attached plans. The proposed project components would consist of the following elements to be contained within a 100.0 (10' x 10') square foot lease area: • One outdoor radio equipment cabinet (approximately 30" x 30" x 54"(H)) to be installed on a concrete slab and enclosed inside an existing 6'-high wooden fence. • One GPS antenna to be mounted on the radio cabinet within the equipment compound. • 3 panel antennas and 6 RF heads and 3 microwave antennas to be on a 60-foot tall monopine (60 feet to top of branches, 55 feet to top of steel) at a centerline of 53'. Antennas and RF heads would be covered with antenna socks or painted to match proposed pine needles. • Associated electrical wiring run from power source at the point of contact as shown on the plans, and radio cabinets to the antennas via underground conduit to the monopine and then inside the pole to the antennas. Access is provided via a driveway from East Homestead Road. Blaney Avenue. Electrical service is provided by PG&E from the point of contact shown on the plans. Collocation/Alternatives Analysis Clearwire has a master lease agreement with PG&E, which makes PG&E facilities the first choice when identifying potential sites. In most cases, existing telecom facilities are already located on the property, and thus, consistent with most jurisdictional objectives, it is the first choice for siting a facility. In this instance, the PG&E was our first alternative. Our first design alternative was to locate on one of the existing transmission towers/poles. However, the poles are at capacity and do not afford space for an additional carrier. Nor was there room at other locations for our equipment with easy access to electrical service. Given these parameters, it was decided that replacing an existing vertical element at a location that was out of the way of daily PG&E operations was the preferred alternative. This was our second alternative, which was a replacement light pole is designed to accomplish Clearwire's objectives of providing sufficient RF coverage to the surrounding neighborhood and to allow for microwave links to other facilities in the area. The height of the facility is designed to see over existing trees and blanket the desired coverage area with service. This alternative, after submittal to the City, was determined to have a potentially significant visual impact given the. increase in height and large diameter of our radome. Thus, we opted for a third alternative, which is the proposed monopine. This collocatable facility will blend 2-9 Page 3 City of Cupertino CA-SJC0126 1 /6/ l 0 in with adjacent trees and is designed to provide the desired coverage while also allowing for future collocation opportunities. Public Services Public services such as fire and law enforcement are not required given that the facilities are designed to be vandalism resistant (fenced and located on a secured facilities yard) and are uninhabitable. The project does not require school or transit facilities, as it is an unmanned wireless communications facility. Operations The site is an unmanned facility that will not generate any noise, dust, or odors. It is expected that a service technician may visit the site once a month or so for routine maintenance if needed. Ample parking is available adjacent to the site in the PG&E yard. III. Land Use Zonin The project parcel is zoned BA, Public Building. The project site is bounded on the west, north, and east by medium to high-density residential uses. Highway 280 bounds the site on the south. See figure below which shows the project location and surrounding land uses. 2-10 Figure 1. Aerial Photo Showing Project Location and Surrounding Land Uses Page 4 City of Cupertino CA-SJC0126 1/6/10 Environmental Setting The project is located on a relatively level publicly-zoned parcel that has been developed entirely with a PG&E facilities yard. While the parcel is surrounded by residential uses on three sides, the proposed facility is located just about as far away from these uses as possible. The closest residence is located to the east approximately 423 feet away. Uses on this parcel are industrial in nature. As such, there are no sensitive resources on the site and no sensitive species are expected to inhabit the site. The facility is located in an area outside of the daily operations of PG&E and will not impact circulation on site. The project is designed to minimize visual impacts to surrounding residences, as it will blend in with existing adjacent trees. Given that access is restricted to this site and matching trees bound the site on the south, it is not expected that the facility will be readily visible from surrounding roadways. Conclusion In conclusion, the proposed project is a compatible use with the surrounding land uses as demonstrated by the fact that there are existing facilities on towers on this property. The proposed project will provide valuable communications services to area residents and businesses. Prevailing Exposure Standards The U.S. Congress requires that the Federal Communications Commission ("FCC") evaluate its actions for possible significant impact on the environment. In Docket 93-62, effective October 15, 1997, the FCC adopted the human exposure limits for field strength and power density recommended in Report No. 86, "Biological Effects and Exposure Criteria for Radiofrequency Electromagnetic Fields," published in 1986 by the Congressionally chartered National Council on Radiation Protection and Measurements ("NCRP"). Separate limits apply for occupational and public exposure conditions, with the latter limits generally five times more restrictive. The more recent standard, developed by the Institute of Electrical and Electronics Engineers and approved as American National Standard ANSI/IEEE C95.1-2006, "Safety Levels with Respect to Hutnan Exposure to Radio Frequency Electromagnetic Fields, 3 kHz to 300 GHz," includes similar exposure limits. A summary of the FCC's exposure limits is shown in Figure 1. These limits apply for continuous exposures and are intended to provide a prudent margin of safety for all persons, regardless of age, gender, size, or health. The most restrictive FCC limit for exposures of unlimited duration to radio frequency energy for several personal wireless services are as follows: Personal Wireless Service Approx. CONSUL"1'LNG ENGINEERS SAN FRANCISCO CW0126~96.1 Page 1 of 4 2-14 Clearwire, LLC • Proposed Base Station (Site No. CA-SJC0126A) 10900 North Blaney Avenue • Cupertino, California General Facility Requirements Base stations typically consist of two distinct parts: the electronic transceivers (also called "radios" or "channels") that are connected to the traditional wired telephone lines, and the passive antennas that send the wireless signals created by the radios out to be received by individual subscriber units. The transceivers are often located at ground level and are connected to the antennas by coaxial cables about 1 inch thick. Because of the short wavelength of the frequencies assigned by the FCC for wireless services, the antennas require line-of--sight paths for their signals to propagate well and so are installed at some height above ground. The antennas are designed to concentrate their energy toward the horizon, with very little energy wasted toward the sky or the ground. Along with the low power of such facilities, this means that it is generally not possible for exposure conditions to approach the maximum permissible exposure limits without being physically very near the antennas. Computer Modeling Method The FCC provides direction for determining compliance in its Office of Engineering and Technology Bulletin No. 65, "Evaluating Compliance with FCC-Specified Guidelines for Human Exposure to Radio Frequency Radiation," dated August 1997. Figure 2 attached describes the calculation methodologies, reflecting the facts that a directional antenna's radiation pattern is not fully formed at locations very close by (the "near-field" effect) and that at greater distances the power level from an energy source decreases with the square of the distance from it (the "inverse square law"). The conservative nature of this method for evaluating exposure conditions has been verified by numerous field tests. Site and Facility Description Based upon information provided by Clearwire, including zoning drawings by Delta Groups Engineering, Inc., dated December 22, 2009, it is proposed to mount three Kathrein Model 840-10054 directional panel antennas on a new 55-foot pole, configured to resemble a pine tree, to be sited next to the PG&E substation located at 10900 North Blaney Avenue in Cupertino, alongside Highway 280. The antennas would be mounted with 2° downtilt at an effective height of about 53 feet above ground and would be oriented at about 120° spacing, to provide service in all directions. The maximum effective radiated power in any direction would be about 970 watts. Also proposed to be mounted on the same pole are three microwave "dish" antennas, for interconnection of this site with others in the Clearwire network. Presently located on another pole about 75 feet to the southeast are similar antennas for use by another wireless telecommunications carrier. For the limited purpose of this study, that carrier is assumed to be Verizon Wireless, with Andrew Model 731DG65 dualband antennas mounted at an effective height HAMMETT & EDISON, INC. Study Results For a person anywhere at ground, the maximum ambient level of RF exposure due to the proposed Clearwire operation by itself, including the contributions of the microwave antennas, would be 0.0025 mW/cm2, which is 0.25% of the applicable public limit. The maximum calculated cumulative level anywhere at ground, for the simultaneous operation of both carriers, is 6.8% of the applicable public limit. It should be noted that these results include several "worst-case" assumptions and therefore are expected to overstate actual power density levels. No Recommended Mitigation Measures Due to their mounting locations, the Clearwire antennas would not be accessible to the general public, and so no mitigation measures are necessary to comply with the FCC public exposure guidelines. It is presumed that Clearwire will, as an FCC licensee, take adequate steps to ensure that its employees or contractors comply with FCC occupational exposure guidelines whenever work is required near the antennas themselves. Conclusion Based on the information and analysis above, it is the undersigned's professional opinion that the base station proposed by Clearwire, LLC at 10900 North Blaney Avenue in Cupertino, California, will comply with the prevailing standards for limiting public exposure to radio frequency energy and, therefore, will not for this reason cause a significant impact on the environment. The highest calculated level in publicly accessible areas is much less than the prevailing standards allow for exposures of unlimited duration. This finding is consistent with measurements of actual exposure conditions taken at other operating base stations. HAMMETT & EDISON, INC.
