SUBJECT: Residential Design Review Action Letter - Application RM-2010-02:
This letter confirms the decision of the Director of Community Development, given on
April 9, 2010; approving a Minor Residential Permit to allow a new 2,472 square foot,
single story residence with a 10-foot reduced rear yard setback, located at 10355 Calvert
Drive, with the following conditions:
1. APPROVED PROJECT
' This approval is based on a plan set entitled, "Oskamp Residence, 10355 Calvert Dr.,
Cupertino Ca 95014" consisting of three sheets dated February 24, 2010 except as
may be amended by conditions in this resolution.
2. TREE PROTECTION
As part of the demolition or building permit drawings, a tree protection plan shall
be prepared for the existing Ash tree in the front yard to be retained. In addition,
the following measures shall be added to the protection plan:
➢ For tree to be retained, chain link fencing and other root protection shall be installed
around the dripline of the tree prior to any project site z��ork.
➢ No parking or z�ehicle traffic shall be alloz��ed under root zones, unless using buffers
approved by an Arborist.
➢ No trenching zi�ithin the critical root zone arecz is allozoed. If trenching is needed in the
z�icinity of trees to be retained, the City's consulting arborist shall be consulted before ccny
trenching or root cutting beneath the dripline of the tree.
➢ Wood chip mulch shall be evenly spread inside the tree projection fence to a four-incli
depth.
➢ Tree protection conditions shall be posted on the tree protection barriers.
➢ Retained tree shall be znatered to maintain good health.
The tree protection measures shall require inspection and approval by a certified
arborist prior to issuance of building permits. A report ascertaining the good health
of the tree mentioned above shall be required prior to issuance of final occupancy.
3. PLAN REVISIONS
Final architectural drawings shall be submitted to the Planning Department for
review and approval prior to issuance of building permits. The applicant has agreed
to revise the plans to address the following:
➢ The zc�indozi� seats shoz��ing on the left elevation z��ill be adjusted to 24" so as to break-i�p
the mass of the architectural feature
➢ The height of the proposed home shall be measured from natural grade
➢ The lot area shall be confirmed by a license civil engineering and/or surveJor. In the
event if the lot area is less than zc�hat is shoznn on the approved plans, the applicant shall
make the necessary adjustments to the house plan to comply zoith the R1 Ordinance
(including but not limited to setbacks and floor area ratio)
, 3. CONSTRUCTION MANAGEMENT PLAN
A construction management plan shall be prepared by the applicant and approved
by staff prior to issuance of building permits. The construction management plan
shall address, but not be limited to:
➢ The staging, unloading, or parking of construction equipment or z�ehicles shall not
obstruct, or otherznise make unsafe, any public right-of-znay
➢ Delineate tree protection measures for the presen�ation of existing trees on the property
➢ Conformance zuith Construction Best Management Practices as prescribed b� the Public
Works Department of the City of Cupertino
4. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with
regard to the proposed project for additional conditions and requirements. Any
misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
5. EXTERIOR BUILDING MATERIALS/TREATMENTS
Final building exterior treatment plan (including but not limited to details on
exterior color, material, architectural treatments and/ or embellishments) shall be
� reviewed and approved by the Director of Community Development prior to
issuance of building permits. The final building exterior plan shall closely resemble
the details shown on the original approved plans. Any exterior changes determined
to be substantial by the Director of Community Development shall require a minor
modification approval with neighborhood input.
6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66020(d) (1), these Conditions constitute written notice of
a statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you

fail to file a protest within this 90-day period complying with all of the requirements
of Section 66020, you will be legally barred from later challenging such exactions.
Please be aware that if this permit is not used within one year, it shall expire on April 9,
2011.
Staff received comments from neighbors expressing concerns about potential tree,
privacy, construction, natural grade, and rear yard setback impacts. Their concerns
have been noted. The City does not require privacy plantings for one-story additions,
but the applicant is willing to work with the neighbors to come up with potential
mitigation measures. As conditions of approval, the existing Ash tree must be
preserved and a construction management plan is required to ensure potential
construction impacts are minimized. The proposed reduced rear yard setback is
permitted by the R1 Ordinance and the project does not involve any exceptions.
Staff has made all the findings that are required for approval of a Minor Residential
Permit as required by the of Cupertino's Municipal Code, Chapter 19.28.090 (B). Also,
please note that an appeal of this decision can be made within 14 calendar days from
� the date of this letter. If this happens, you will be notified of a public hearing, which
will be scheduled before the Planning Commission.
