Authorize support of AB 1784 regarding local roadway projects.
BACKGROUND
AB 1784 authorizes the Santa Clara Valley Transportation Authority (VTA) to enter into
agreements with any city within its territory or ufthin the County of Santa Clara to improve a
street, road, highway, or expressway under the jurisdiction of the city or county. Some smaller
cities in Santa Clara County may not have the in- -house resources within its Public Works
Department to be able to manage the constructiona of a particular capital improvement project on
its local roadway system, even when they have the funds for the project itself. VTA has a
Construction Division that is responsible for, and has extensive experience in, managing the
construction of transportation capital improvement projects.
To avoid having local roadway capital improvement projects delayed or not get done at all
because a particular city does not have the in -house resources to deliver it, VTA could step in
and help the city, if the city so requests.
AB 1784 will jump -start stalled local roadway projects and allow the VTA to partner with local
governments to provide the necessary expertise on construction management. This bill will
make local roadway capital improvement projects shovel -ready and ready to hire.
LEGISLATIVE COMMITTEE RECOMMENDATION
Based on e -mail communications received from Vice Mayor Wong and Councilmember
Mahoney in support, it is the recommendation of the Legislative Committee that the council
support SB 1784 as it is currently written.

Purpose of Bill:

assistance.
Background:
The Santa Clara Valley Transportation Authority (VTA) is a statutorily created special district.
It was created by the Legislature and Governor to perform a wide variety of transportation
functions for the communities and residents of Santa Clara County.
However, VTA's current enabling statutes do no specifically authorize VTA to manage the
construction of improvement projects on local roadways under the jurisdiction of the 15 cities
within Santa Clara County.
In some cases, particularly with regard to the smeller cities in Santa Clara County, the local
agency may not have the in -house resources within its Public Works Department to be able to
manage the construction of a particular capital improvement project on its local roadway system,
even when they have the funds for the project its-.If.

SUBJECT Santa Clara Valley Transportation Authority: work for
others
SUMMARY Authorizes the Santa Clara Valley Transportation
Authority (VTA) to enter into agreements with cities within its
boundaries or with the County of Santa Clara to improve city- or
county -owned streets, roads, highways, or expressways.
EXISTING LAN:
1)EStablishes VTA as the transit district and the congestion
management agency in Santa Clara County.
2)AUthorizes VIA to construct and improve state and local
highways for projects identified in a countywide
transportation expenditure plan associated with a local
transportation sales tax program.
3)Authorizes cities and counties, generally, to enter into
agreements to construct, repair and maintain each other's
highways.
FISCAL EFFECT Unknown
COMMENTS According to the author, some of the smaller cities
in Santa Clara County may not have the in -house resources to
manage construction of local road improvements. VTA, however,
is responsible for, and has extensive experience in, managing
construction of transportation capital improvement projects. By
granting VIA the authority to do work for others within the
county, the author asserts that this bill could avoid having
local transportation capital improvement projects delayed for
the lack of in -house city or county resources.
Author's amendments: The author has agreed to take amendments
at the request of the Professional Engineers in California
Government (PECG). These amendments will clarify the author's
intent and specifically state that the bill does not give VTA
any additional authority to do work on the state highway system.
