WHEREAS, Andy A. Tu and Lily L. Miao, husband and wife as to an undivided 1/3
interest and Cai -Xing Xie, a married man as to undivided 1/3 interest and Andy Cheng, a
married man as to undivided 1/3 interest all as tenants in common, have executed a Grant of
Easement for Roadway Purposes which is in good and sufficient form, granting to the City of
Cupertino, County of Santa Clara, State of California, easement over certain real property for
roadway purposes, situate in the City of Cupertino, more particularly described in Exhibit "A"
and Exhibit "8", attached hereto and made a part hereof, which is as follows:
All that certain real property situate in the City of Cupertino, County of
Santa Clara, State of California, located at 10690 MERRIMAN ROAD,
APN 342-16-120.
NOW, THEREFORE, BE IT RESOLVED that the City of Cupertino accept said grant so
tendered; and
IT IS FURTHER RESOLVED that the City Clerk is hereby authorized to record said
grant and this resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 20th day of June, 2006, by the following vote:

A portion of Lot 30 and a portion of lot 56, as shown on that certain map entitled, "Map
of Inspiration Heights, MontaVista,", which map was filed for record in the Office of the
Recorder of the County of Santa Clara, State of California on April 11, 1917 in Book "P"
of Maps, at page 13, and more particularly described as follows:
Commencing at a point in the center line of Merriman Road, formerly Alhambra Road, at
the westerly common comer to Lots 56 and 57, as said road and lots are shown upon the
map above referred to; running thence easterly along the dividing line between said Lots
56 and 57, a distance of20.00 feet to a line drawn parallel to said center line and to the
True Point of Beginning; running thence northerly along said line drawn parallel a
distanceof70.12 feet to a line drawn parallel to said dividing line between Lots S6 and
